It isn&#8217;t. Some cite the ADA&#8217;s dogs-only rule to reject an emotional support cat, or demand the level of proof a business might ask for at the door. That argument misapplies the law. In housing, the FHA controls, and it is broader than the ADA in almost every direction that matters to a tenant.<\/p>\n<h2>Which Animals the No-Fee Rule Covers<\/h2>\n<p>The FHA uses the term &#8220;assistance animal,&#8221; and it covers two groups:<\/p>\n<ul>\n<li>Trained service animals \u2014 for example, a dog trained to guide someone who is blind, alert someone who is deaf, pull a wheelchair, remind a person to take medication, or detect the onset of a seizure or panic attack and respond with a specific action.<sup class=\"modern-footnotes-footnote \" data-mfn=\"4\" data-mfn-post-scope=\"00000000000001670000000000000000_107\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_107-4\">4<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_107-4\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"4\">U.S. Department of Justice. <a href=\"https:\/\/www.ada.gov\/resources\/service-animals-2010-requirements\/\" target=\"_blank\" rel=\"noopener\">ADA Requirements &#8211; Service Animals<\/a><\/span><\/li>\n<li>Emotional support animals, which provide therapeutic benefit through companionship and don&#8217;t need task-specific training.<sup class=\"modern-footnotes-footnote \" data-mfn=\"5\" data-mfn-post-scope=\"00000000000001670000000000000000_107\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_107-5\">5<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_107-5\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"5\">U.S. Department of Housing and Urban Development. <a href=\"https:\/\/www.hud.gov\/sites\/dfiles\/PA\/documents\/AsstAnimalsGuidFS1-24-20.pdf\" target=\"_blank\" rel=\"noopener\">Fact Sheet on HUDs Assistance Animals Notice<\/a><\/span><\/li>\n<\/ul>\n<p>Unlike the ADA, the FHA is not limited to dogs. An assistance animal can be any species commonly kept in a household, as long as it is necessary to give a person with a disability equal opportunity to use and enjoy the home. The no-pet-fee rule applies to both categories equally. A landlord who normally collects a $300 pet deposit and $25 in monthly pet rent cannot apply either charge to an assistance animal, and cannot enforce a blanket no-pets policy against one.<sup class=\"modern-footnotes-footnote \" data-mfn=\"1\" data-mfn-post-scope=\"00000000000001670000000000000000_107\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_107-1\">1<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_107-1\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"1\">U.S. Department of Housing and Urban Development. <a href=\"http:\/\/www.hud.gov\/helping-americans\/assistance-animals\" target=\"_blank\" rel=\"noopener\">Assistance Animals<\/a><\/span><\/p>\n<h2>What the Landlord Can Ask For<\/h2>\n<p>If your disability and your need for the animal are obvious \u2014 you use a wheelchair and the dog retrieves objects, for instance \u2014 the landlord generally shouldn&#8217;t need any paperwork. A landlord cannot demand your diagnosis, review your medical records, require a particular form, or make your provider swear anything under penalty of perjury. The right kind of documentation is a note from a licensed health care professional who actually knows you and your condition.<\/p>\n<p>HUD has been direct about the online ESA &#8220;registration&#8221; industry: certificates sold to anyone who fills out a questionnaire are &#8220;not meaningful and a waste of money,&#8221; and they don&#8217;t reliably establish disability or need.<sup class=\"modern-footnotes-footnote \" data-mfn=\"5\" data-mfn-post-scope=\"00000000000001670000000000000000_107\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_107-5\">5<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_107-5\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"5\">U.S. Department of Housing and Urban Development. <a href=\"https:\/\/www.hud.gov\/sites\/dfiles\/PA\/documents\/AsstAnimalsGuidFS1-24-20.pdf\" target=\"_blank\" rel=\"noopener\">Fact Sheet on HUDs Assistance Animals Notice<\/a><\/span> If you&#8217;re relying on one of those, expect a landlord to push back and expect HUD to back the landlord on that specific point.<\/p>\n<p>You don&#8217;t have to submit your request in writing or use any particular form. It creates a record if the landlord later claims they never heard from you.<\/p>\n<h2>You Still Owe for Actual Damage<\/h2>\n<p>No deposit does not mean no liability. You keep the money that would have gone into a pet deposit, but there&#8217;s no deposit cushion sitting there to absorb the cost if something goes wrong. What the landlord cannot do is collect money upfront specifically because you have the animal.<\/p>\n<h2>When a Landlord Can Still Say No<\/h2>\n<p>Assistance animal protections have limits. If the landlord refuses, retaliates, or ignores you, file a housing discrimination complaint with HUD&#8217;s Office of Fair Housing and Equal Opportunity. You can file online, call 1-800-669-9777, or mail a complaint form to your regional office.<sup class=\"modern-footnotes-footnote \" data-mfn=\"10\" data-mfn-post-scope=\"00000000000001670000000000000000_107\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000001670000000000000000_107-10\">10<\/a><\/sup><span id=\"mfn-content-00000000000001670000000000000000_107-10\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"10\">U.S. Department of Housing and Urban Development. <a href=\"http:\/\/www.hud.gov\/reporthousingdiscrimination\" target=\"_blank\" rel=\"noopener\">Report Housing Discrimination<\/a><\/span> Filing costs nothing, but there are time limits, so don&#8217;t sit on it.<\/p>\n<p>You can also sue in federal court.
