A facility cannot run both standard IDR and IIDR on the same citation from the same survey, unless the standard IDR was completed before CMS imposed the penalty.2eCFR. 42 CFR 488.331 – Informal Dispute Resolution If a standard IDR is already underway when the penalty notice lands, the facility has to decide whether to let it finish or pivot.
The 10-Day Deadline
The facility has 10 days from CMS’s offer to request IIDR in writing.2eCFR. 42 CFR 488.331 – Informal Dispute Resolution The offer is contained in the civil money penalty imposition notice itself, so in most cases the clock starts on the day the penalty notice arrives. Miss the window and the right to an independent review is gone. The regulation contains no extension mechanism.

Penalty Amounts in 2026
The reason IIDR matters is the size of the check. Federal penalty ranges are adjusted for inflation each year, and the 2026 figures are these:

For immediate jeopardy citations, per-day and per-instance penalties can run at the same time. Total exposure from a single survey can climb into six or seven figures quickly, which is what makes a fast independent review worth pursuing.
Building the Written Challenge
The core document in any IIDR case is Form CMS-2567, the Statement of Deficiencies produced by the survey team. A useful written argument shows one of three things: that the facility was actually in compliance at the time of the survey, that the deficiency should not have been cited under the applicable regulation, or that the factual information in the CMS-2567 is inaccurate.5Centers for Medicare & Medicaid Services. The point is to place objective documentation directly against the surveyor’s narrative for each disputed tag.
Federal regulations do not address whether attorneys can prepare or present the argument. Some states allow it, others restrict it. Check the state’s written IIDR policy before assuming counsel can participate.
Who Reviews and How Long It Takes
The reviewer must be independent from the state survey agency and free of conflicts. Before the review starts, the state notifies affected residents or their representatives and the state long-term care ombudsman program. That written record is a recommendation, not a decision. If the state agrees, it notifies the facility within 10 calendar days. If the state disagrees with any recommendation, it sends the full record to the CMS Regional Office, which makes the final call within 10 calendar days. Escrow Collection Does Not Pause
Requesting IIDR does not stop CMS from collecting the penalty. CMS may deposit the funds into escrow on whichever comes first: the date the IIDR is completed, or 90 days after the imposition notice.1eCFR. 42 CFR 488.431 – Civil Money Penalties Imposed by CMS and Independent Informal Dispute Resolution A facility that requests IIDR promptly may see the process finish before the 90-day mark. A facility that delays may find collection starting while the review is still underway.
Once notice of collection arrives, the facility has 30 calendar days to deposit the funds into escrow. The Citation Stays Public During Review
CMS posts deficiency citations on Medicare Care Compare while IDR or IIDR is pending.6Centers for Medicare & Medicaid Services. If citations are removed or reclassified through IIDR, CMS updates Care Compare accordingly.
If IIDR Doesn’t Resolve the Dispute

At the ALJ level, the scope of review in civil money penalty cases is narrow. CMS’s determination of the level of noncompliance must be upheld unless it is clearly erroneous, which is a high bar for the facility.9eCFR. 42 CFR Part 498 – Appeals Procedures for Determinations An ALJ decision can be appealed to the Departmental Appeals Board, which reviews legal questions and can issue a new decision or send the case back. Beyond the DAB, judicial review in federal court is the last step.
Formal appeals often take months or years, which is why IIDR remains the faster option even with its limitations. Many facilities pursue IIDR first and hold the formal hearing in reserve.
