Independent Contractor Reporting Requirements and Deadlines

If your business paid an independent contractor $2,000 or more during 2026, you have to report those payments to the IRS on Form 1099-NEC, and copies are due to both the IRS and the contractor by January 31, 2027. That $2,000 figure is new. Congress raised the reporting threshold from $600 for payments made after December 31, 2025, and the amount will adjust for inflation starting in 2027.1Office of the Law Revision Counsel. 26 U.S. Code 6041 – Information at Source The independent contractor reporting requirements below walk through who you file for, what goes on the form, how to submit it, and what happens if you get it wrong.

Who You Have to File a 1099-NEC For

The rule covers any individual, partnership, or estate you paid $2,000 or more in nonemployee compensation during the calendar year for services performed in the course of your trade or business.2Internal Revenue Service. Reporting Payments to Independent Contractors Fees, commissions, prizes, and awards all count. The threshold is cumulative: $500 in March plus $1,600 in September puts you at $2,100, and you file.

Payments to C-corporations and S-corporations are generally exempt. The exception that catches people off guard is legal fees. If you paid an attorney $2,000 or more, you file a 1099-NEC whether the law firm is incorporated or not.3Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC

Not every payment to a non-employee goes on the NEC. Rent of $2,000 or more belongs on Form 1099-MISC.4Internal Revenue Service. About Form 1099-MISC Payments for merchandise, inventory, or freight are not reportable on either form. The IRS treats a wrong-form filing the same as a late one for penalty purposes, so it’s worth sorting out before you start.

Confirm the Worker Really Is a Contractor

Reporting on the wrong form is one problem. Reporting on the wrong tax form because you misclassified an employee as a contractor is a bigger one. The IRS weighs three categories of evidence: behavioral control (whether you direct how the work is done), financial control (whether the worker can profit or lose money independently), and the type of relationship (contracts, benefits, expectation of ongoing work).5Internal Revenue Service. Independent Contractor (Self-Employed) or Employee? No single factor decides it.

Getting this wrong exposes your business to back income tax withholding, the employer’s share of Social Security and Medicare, unemployment taxes, and interest and penalties on all of it.6Internal Revenue Service. Worker Classification 101 – Employee or Independent Contractor Employees receive Form W-2. Contractors receive Form 1099-NEC. If you genuinely cannot tell, either you or the worker can file Form SS-8 and ask the IRS to make the determination.7Internal Revenue Service. Collect Form W-9 Before You Pay

Get a completed Form W-9 from every contractor before the first payment goes out.8Internal Revenue Service. About Form W-9, Request for Taxpayer Identification Number and Certification The W-9 gives you the two things you’ll need at filing time: the contractor’s taxpayer identification number (SSN or EIN) and their tax classification. Keep completed forms on file for at least four years.

If a contractor refuses to give you a TIN, provides one that turns out to be wrong, or is flagged by the IRS for underreporting, you have to begin backup withholding at 24% on every payment. You then remit that withheld tax to the IRS using Form 945.9Internal Revenue Service. Instructions for Form 945 Chasing a W-9 down after the fact is the kind of task that drags on for months. Build it into onboarding.

Foreign Contractors Follow a Different Track

If you’re paying a nonresident alien or a foreign entity for services, none of the above applies. Skip the W-9 and the 1099-NEC. Collect Form W-8BEN from foreign individuals or W-8BEN-E from foreign entities before making payment.10Internal Revenue Service. Instructions for Form W-8BEN Without one, you withhold 30% of the payment.11Internal Revenue Service. Federal Income Tax Withholding and Reporting on Other Kinds of U.S. Source Income Paid to Nonresident Aliens You report those payments on Form 1042-S and file Form 1042 as the annual summary.12Internal Revenue Service. Filling Out Form 1099-NEC

Once a contractor has crossed the $2,000 threshold and you have their W-9, complete the form for the tax year.

In the payer section, enter your business’s legal name, address, phone, and EIN. Transcribe the contractor’s name, address, and TIN exactly as they appear on the W-9. A mismatch between what you file and what the IRS has on record generates a notice and can trigger penalties.

Box 1: Nonemployee compensation. Report the total you paid the contractor during the calendar year. Include payments by check, direct deposit, cash, or property. Expense reimbursements are the wrinkle here. If the contractor submitted receipts, the expenses had a business connection, and any excess was returned, those reimbursements stay out of Box 1. A flat allowance with no accountability requirement is compensation and goes in Box 1.

Box 4: Federal income tax withheld. Complete this only if you actually withheld, which for most businesses means backup withholding. Otherwise leave it blank.

Boxes 5 through 7: State reporting. Box 5 reports state income tax withheld; Box 7 reports state-level income. These are optional at the federal level but should be completed if you withheld state tax or if your state requires the information. Box 2 is a separate flag for direct sales of $5,000 or more of consumer products for resale and is irrelevant for most service contracts.3Internal Revenue Service. Deadlines and How to File

January 31 is the deadline for both furnishing recipient copies and filing with the IRS. For 2026 payments, everything is due January 31, 2027. There is no automatic extension, and the date is the same whether you file on paper or electronically.13Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC

Electronic Filing Through IRIS

If your business files ten or more information returns of any type during the year, electronic filing is mandatory. All W-2s, 1099s, and other information returns count toward that ten.14Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically A company with five employees and five contractors already hits the threshold.

For tax year 2026 filings, the IRS’s Information Returns Intake System (IRIS) is the sole electronic platform for 1099 forms. The older FIRE system is being retired after the 2025 filing season.15Internal Revenue Service. E-File Information Returns With IRIS IRIS offers a Taxpayer Portal where you can key in data or upload CSV files without special software, and an Application-to-Application channel for bulk XML transmissions. Both require an IRIS-specific Transmitter Control Code, which can take up to 45 days to issue. Apply well before January.

Paper Filing

Businesses filing fewer than ten total information returns can still file on paper. Paper filing requires the official scannable Copy A printed in red ink; a version downloaded and printed from the IRS website is not acceptable. Include Form 1096 as a cover sheet summarizing the batch.16Internal Revenue Service. Form 1096 – Annual Summary and Transmittal of U.S. Information Returns

Getting the Contractor’s Copy to Them

You can send recipient copies by mail or electronically, but electronic delivery requires the contractor’s affirmative consent first. That consent process has specific requirements: inform the contractor of the hardware and software needed to view the form, explain how to withdraw consent, describe how to request a paper copy, and specify whether the consent covers one year or several.17Internal Revenue Service. General Instructions for Certain Information Returns Without proper consent on file, mail the form to the contractor’s last known address.

Penalties for Late or Incorrect Filing

Penalties are assessed per form and scale with how late you are, so they add up fast across a stack of contractors. For returns due in 2026:18Internal Revenue Service. Information Return Penalties

  • Filed within 30 days of the deadline: $60 per return
  • Filed 31 days late through August 1: $130 per return
  • Filed after August 1 or never filed: $340 per return
  • Intentional disregard: $680 per return with no annual cap

Annual caps apply to every tier except intentional disregard, and businesses with $5 million or less in gross receipts get lower caps. The same penalty structure applies separately to the payee statement you owe the contractor, so a single missed contractor can generate two penalties: one for the IRS copy and one for the recipient copy.

Fixing Mistakes After Filing

If you spot an error on a 1099-NEC you already submitted, file a corrected return quickly. Use the same form type, check the “CORRECTED” box at the top, enter the correct information, and submit through the same channel you used originally. Do not check “VOID” on a correction; IRS scanners skip voided forms entirely.13Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Paper corrections need a new Form 1096 with the batch. There’s no hard correction deadline, but filing sooner keeps you in the lower penalty tiers.

If the error is bigger, meaning you’ve been treating people as contractors who should have been employees, the Voluntary Classification Settlement Program lets you reclassify going forward with reduced back-tax liability. You must have treated the workers consistently as contractors, filed all required 1099s for the past three years, and not currently be under employment tax audit.19Internal Revenue Service. Voluntary Classification Settlement Program Section 530 can also shield you from employment tax liability for past misclassification if you filed the required 1099s, never treated the position as an employee role after 1977, and had a reasonable basis for the classification at the time you made it.20Internal Revenue Service. State Filing Is a Separate Obligation

Filing with the IRS does not close out your state responsibilities. Many states require their own copy of Form 1099-NEC, and state deadlines and thresholds don’t always match federal ones.

The Combined Federal/State Filing Program can forward your electronically filed returns to participating states, which eliminates a separate state submission in those jurisdictions.21Internal Revenue Service. Topic No. 804, FIRE System Test Files and Combined Federal/State Filing (CF/SF) Program Not every state participates. Check your state’s status before you assume the federal filing covered you, and if it doesn’t participate, file directly with the state tax authority on its schedule.
