Immigration RFE: Reasons, Deadlines, and How to Respond

A Request for Evidence, or RFE, in immigration is a letter from U.S. Citizenship and Immigration Services asking you to send more documents or information before the agency decides your case. It is not a denial. USCIS issues an RFE when what you filed doesn’t fully prove you qualify, but the officer isn’t ready to reject the application outright.1U.S. Citizenship and Immigration Services. Request for Evidence (RFE) You get one chance to fill the gap, the deadline is fixed, and officers are not allowed to extend it.2eCFR. 8 CFR 103.2 – Submission and Adjudication of Benefit Requests

Why You Got an RFE

An RFE means the officer looked at your file and found something missing, unclear, or insufficient to establish eligibility. A few triggers show up again and again.

Missing or Incomplete Documents

Something the form instructions required is not in the file. Long-form birth certificates, valid marriage licenses, passport copies, and photos are common oversights. In family-based petitions, officers look for extensive proof of a genuine shared life, so thin relationship evidence — no joint bank statements, no shared lease, few photos together — often prompts a request for more.

Problems with the Affidavit of Support

Form I-864 is one of the biggest sources of RFEs in family cases. Officers compare the sponsor’s income to the Federal Poverty Guidelines for the stated household size and check whether IRS tax transcripts match what the form reports. Mismatched household size, missing tax returns, or income that falls short without a joint sponsor almost always triggers questions.

Foreign-Language Documents Without Certified Translations

Every non-English document must come with a full English translation, plus a written certification from the translator stating that the translation is complete and accurate and that they are competent in both languages. The certification needs the translator’s name, signature, address, and date. Missing that certification is one of the most avoidable reasons for an RFE.

Medical Exam Issues

Form I-693 causes more problems than applicants expect. Common defects include missing vaccination records, an expired form, or a deficient civil surgeon signature. For I-693s signed on or after November 1, 2023, the form stays valid as long as the underlying application is pending; forms signed before that date were valid for two years from the civil surgeon’s signature.3U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 8 Part B Chapter 4 – Review of Medical Examination Documentation An officer who has reason to believe your medical condition has changed can request a new exam even if the form is otherwise valid.

Employer Ability to Pay

In employment-based petitions, USCIS frequently asks the sponsoring employer to prove it can pay the offered wage from the priority date through the beneficiary’s grant of permanent residence. Acceptable initial evidence includes annual reports, audited financial statements, or federal tax returns with all schedules. W-2s, quarterly Form 941 filings, and bank records can fill in gaps.4U.S. Citizenship and Immigration Services. Request for Evidence Template – Ability to Pay Wage

Read the Notice Like a Checklist

The RFE letter is more useful than most people realize. It cites the specific laws applied to your case, lists exactly what evidence is missing or insufficient, and explains why what you submitted didn’t meet the standard. Every item the officer asks for is something you have to address directly. Skip one, and the officer can decide your case on whatever incomplete record you provide.

How Long You Have to Respond

The response deadline is printed on the notice and it is a hard cutoff. Federal regulation caps the maximum response window at 12 weeks — 84 days — and specifically forbids officers from extending it.2eCFR. 8 CFR 103.2 – Submission and Adjudication of Benefit Requests In practice, USCIS uses different windows for different forms:

  • 30 days for Form I-539 (extension or change of nonimmigrant status) and Form I-601A (provisional unlawful presence waiver).
  • 84 days for most other form types, whether the evidence is domestic or overseas.
  • 3 extra calendar days when USCIS sends the RFE by regular mail, and 14 extra days for applicants residing outside the United States or cases from international field offices.5U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part E Chapter 6 – Evidence

There is no process to ask for more time. If you can’t gather everything in time, you have to choose between submitting what you have and risking denial for abandonment.

Building the Response

Go through the letter item by item and match each request to a specific document. Write a short cover letter that lists every enclosed item and cross-references it to the officer’s requests. That single page cuts the risk that something in your package gets overlooked during review.

If a birth certificate or other primary civil document is unavailable, USCIS will consider secondary evidence — baptismal certificates, school records, hospital records, immunization records — as long as you can show the primary document doesn’t exist or can’t be obtained.6U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 Part J Chapter 3 – Documentation and Evidence A letter from the appropriate civil authority in your home country confirming the record is unavailable strengthens that argument.

For a mailed response, the RFE notice usually includes a cover sheet with a barcode that helps mailroom staff route your package to the correct file. Put it on top. If there’s no barcode sheet, place a copy of the RFE letter itself on top with the receipt number clearly visible. Skip heavy staples, binders, and plastic sleeves; they slow down intake staff who need to scan everything.

Where and How to Submit

How you send the response depends on how you originally filed. If you filed through the USCIS online portal, scan the documents and upload them through your account. Online submission gives you an instant timestamp and eliminates the risk of a lost package.

For paper-filed cases, mail the response to the exact address printed on the RFE notice. It may be different from where you originally filed, so check the letter rather than assuming.7U.S. Citizenship and Immigration Services. Lockbox and Service Center Filing Location Updates Use a tracked courier and request delivery signature. USCIS must physically receive the response by the deadline (plus any applicable mailing-time buffer). A postmark alone doesn’t count.

Don’t Send a Partial Response If You Can Avoid It

If you submit only some of the requested evidence, USCIS treats that partial response as a request for a decision on the existing record. The agency will not wait for a follow-up and will not issue another RFE just because your first response was incomplete.5U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 1 Part E Chapter 6 – Evidence This is where a lot of cases fall apart. Applicants send what they can gather quickly, planning to follow up, and learn the officer has already decided.

If the deadline is bearing down and you still don’t have everything, a partial response is still better than no response. No response can be treated as abandonment. Just understand that the officer will likely decide on whatever you’ve provided.

What Can Happen Next

The best outcome is straightforward approval. The officer reviews your supplemental evidence, finds it sufficient, and moves the case forward — an interview scheduling, transfer to the National Visa Center, approval of an I-140, or advancement of the adjustment application, depending on the case type.

Sometimes the officer will issue a second RFE if your response introduces new questions. This is uncommon and does not happen just because a first response was partial.

A more concerning outcome is a Notice of Intent to Deny (NOID). This means the officer plans to reject your case but is giving you one last chance to argue against the specific grounds. The maximum NOID response time is 30 days, and, like RFE deadlines, it cannot be extended.2eCFR. 8 CFR 103.2 – Submission and Adjudication of Benefit Requests

If you miss the RFE deadline entirely, USCIS can deny the case as abandoned, deny it on the existing record, or both.2eCFR. 8 CFR 103.2 – Submission and Adjudication of Benefit Requests There is no grace period.

Travel and Status While the RFE Is Pending

A pending RFE does not change your current immigration status, but processing on your application pauses until you respond, which can extend the overall wait. If you have a pending Form I-485 and need to travel internationally, you must have a valid advance parole document before leaving. Departing without one generally causes USCIS to treat the application as abandoned.8U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS Even with advance parole, traveling while an RFE is outstanding is risky. Mail delays and the inability to coordinate with a civil surgeon or employer from overseas can put the deadline out of reach. Resolve the RFE first if you can.

If the Case Is Denied

A denial isn’t automatically the end. You can file Form I-290B to request a motion to reopen (based on new facts) or a motion to reconsider (arguing the officer applied the law incorrectly). In most cases, the filing window is 30 calendar days from the denial, or 33 days if USCIS mailed the decision.9U.S. Citizenship and Immigration Services. I-290B, Notice of Appeal or Motion The Form I-290B filing fee applies and is non-refundable.10eCFR. 8 CFR 103.5 – Reopening and Reconsideration

A denial can also carry consequences beyond losing the benefit. Under a February 2025 USCIS policy memorandum, the agency no longer exempts broad categories of people from enforcement action after an unfavorable decision. USCIS may issue a Notice to Appear, which starts removal proceedings in immigration court, in several situations, including when the applicant is not lawfully present at the time of denial, when fraud or misrepresentation is part of the record, or when the applicant has a criminal history.11U.S. Citizenship and Immigration Services. Issuance of Notices to Appear (NTAs) in Cases Involving Inadmissible and Deportable Aliens Some case types, including denials of petitions to remove conditions on residence (Form I-751) and terminations of refugee status, carry mandatory NTA requirements by regulation.

That is why getting the RFE response right the first time matters so much. If the case is complex or the stakes are high, talking to an immigration attorney before you respond is worth the cost.
