I-512 Advance Parole: Eligibility, Filing, and Re-Entry

An I-512 advance parole document is the travel authorization USCIS issues after approving Form I-131, and it lets you leave the United States temporarily and return without abandoning a pending immigration case. It does not guarantee re-entry, because Customs and Border Protection makes the final call at the port of entry, but for most people with a pending green card, asylum, TPS, or DACA case, leaving without it can sink the underlying application.

Who Needs an I-512

The largest group of applicants is people with a pending Form I-485, Application to Register Permanent Residence or Adjust Status. If you leave the country while your I-485 is pending and you don’t have an approved advance parole document, USCIS treats the application as abandoned.1U.S. Citizenship and Immigration Services. While Your Green Card Application Is Pending with USCIS Abandonment is grounds for termination, and recovering from it is extremely difficult.2GovInfo. 8 CFR 245.2 – Application

You also need advance parole if you have a pending asylum application (Form I-589). USCIS will presume you abandoned the asylum claim if you travel abroad without it.3U.S. Citizenship and Immigration Services. Travel Documents People with Temporary Protected Status can apply as well; USCIS issues a Form I-512T for approved TPS beneficiaries and a Form I-512L for those whose initial TPS application is still pending.4U.S. Citizenship and Immigration Services. Application for Travel Documents, Parole Documents, and Arrival/Departure Records

DACA recipients can apply, but travel has to fit one of three categories: humanitarian (such as visiting a gravely ill relative), educational (such as a study-abroad program or academic conference), or employment (such as an overseas work assignment or professional training).5U.S. Citizenship and Immigration Services. Consideration of Deferred Action for Childhood Arrivals (DACA) Traveling without advance parole and re-entering without inspection can lead USCIS to terminate DACA. Policy in this area shifts, so confirm current availability before you file.

When You Might Not Need One

USCIS recognizes a narrow exception for certain nonimmigrant visa holders with a pending I-485.3U.S. Citizenship and Immigration Services. Travel Documents Holders of H-1B, H-4, L-1, and L-2 visas can generally travel on a valid visa stamp and return without triggering abandonment. Using advance parole to re-enter instead of your H or L visa can cost you the underlying nonimmigrant status, which becomes a serious problem if your I-485 is later denied and you have nothing to fall back on.

K-3 and K-4 visa holders can travel and re-enter on the K visa as long as it hasn’t expired. If it will be expired when you return and your I-485 is pending, you need advance parole approved before you leave.6U.S. Citizenship and Immigration Services. K-3/K-4 Nonimmigrant Visas

How to File Form I-131

You apply by filing Form I-131, Application for Travel Documents, Parole Documents, and Arrival/Departure Records. Download the current edition from the USCIS website; older editions are rejected. You’ll submit two passport-style photos and evidence supporting the underlying benefit, such as the I-797 receipt notice for a pending I-485 or I-589.7U.S. Citizenship and Immigration Services. Form I-131 Instructions

The filing goes to the USCIS lockbox designated for your case type, which the I-131 instructions identify. USCIS will send a Form I-797C receipt notice with a case number you can use to check status. Do not book travel until you physically hold the approved I-512. A receipt notice is not authorization to leave.

Filing Fees and Payment

The Form I-131 fee for advance parole with a pending I-485 is $630 for paper filing or $580 online. A fee exemption that many applicants miss: if you filed your I-485 on or after July 30, 2007, and before April 1, 2024, paid the required I-485 fee, and your I-485 is still pending, the advance parole fee is $0.8U.S. Citizenship and Immigration Services. Approved T-visa and U-visa applicants and their qualifying family members also file at $0.8U.S. Citizenship and Immigration Services. Processing Times and the End of the Combo Card

Processing times for Form I-131 vary by service center, case type, and current backlog. USCIS publishes estimates on its website, and waits of several months have been common, with spikes when USCIS faces funding or staffing disruptions.

One change catches many I-485 applicants off guard. USCIS previously issued a “combo card” combining work authorization (EAD) and advance parole on a single card, but it has returned to issuing the two documents separately to ease EAD backlogs. An EAD by itself does not authorize travel. You still need the separate approved I-512 in hand before you leave.

Emergency Advance Parole

If a family member is gravely ill, a close relative has died, or another urgent situation requires immediate travel, you can request emergency processing. Call the USCIS Contact Center at 800-375-5283 or request a field office appointment through the USCIS website.12U.S. Citizenship and Immigration Services. Emergency Travel

USCIS considers emergency issuance in situations such as:

  • Medical emergencies where you need treatment abroad within a limited timeframe.
  • The death or serious illness of a family member or close friend.
  • A pending I-131 you filed on time and asked to expedite, where you must travel within 15 days for a critical commitment.

Even with a pending I-131, you’ll file a new Form I-131 with the applicable fee at your field office appointment. Bring supporting evidence of the emergency (medical documentation, a death certificate, or similar proof), two passport-style photos, and evidence of your underlying immigration case. Any documents not in English need a certified English translation.12U.S. Citizenship and Immigration Services. Emergency Travel

Traveling With the Document and Re-Entering

Carry the original I-512 and a valid passport. Border officials will not accept photocopies. At the U.S. port of entry, a Customs and Border Protection officer will inspect you for admissibility. Referrals to secondary inspection for a closer look at immigration and criminal history are routine; it adds time but isn’t cause for alarm.

Advance parole does not guarantee re-entry. CBP retains full discretion to deny parole at the border. If CBP lets you in, you’re “paroled” into the United States, which is legally distinct from being “admitted.”13U.S. Citizenship and Immigration Services. Parole The distinction matters for your pending case: you’re physically present and your I-485 keeps processing, but you have not been formally admitted as a permanent resident or in any other immigration category.14eCFR. 8 CFR 212.5 – Parole of Aliens Into the United States Prior immigration violations, criminal history, or outstanding removal orders can lead to a denial of parole at the border even if the I-512 is valid. If your I-485 is later denied after entry on parole, you’ll be treated as an applicant for admission and subject to inadmissibility grounds.2GovInfo. 8 CFR 245.2 – Application

Protection From the Three- and Ten-Year Bars

This is where advance parole does something many applicants don’t realize. Under federal immigration law, more than 180 days but less than one year of unlawful presence, followed by a departure, triggers a three-year bar on returning; one year or more triggers a ten-year bar.15U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility

The Board of Immigration Appeals held in Matter of Arrabally and Yerrabelly that leaving the United States on an approved advance parole document does not count as a “departure” that triggers these bars.16Department of Justice. Matter of Arrabally and Yerrabelly, 25 I&N Dec. 771 (BIA 2012) The BIA’s decision addressed the ten-year bar, but USCIS applies the same reasoning to the three-year bar,15U.S. Citizenship and Immigration Services. Unlawful Presence and Inadmissibility and USCIS policy guidance confirms that travel on advance parole for a pending adjustment applicant will not trigger the unlawful presence bar.17U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 7 Part M Chapter 3 – Admissibility and Waiver Requirements

The protection is significant for anyone who accrued unlawful presence before filing for adjustment. It is not a blank check. CBP can still find you inadmissible on other grounds at the border, and the protection only applies when you leave with the approved I-512 in hand. Leaving without it exposes you to the full weight of the bars.

If You Have Refugee or Asylee Status, Ask for a Different Document

Advance parole is not the right document for everyone. If you have refugee or asylee status but are not yet a lawful permanent resident, or you’re a derivative refugee or asylee, you need a Refugee Travel Document instead. Leaving without one can prevent re-entry or land you in removal proceedings.3U.S. Citizenship and Immigration Services. Travel Documents

You still use Form I-131 to request a Refugee Travel Document, but the fees differ. Refugees and permanent residents who got their green card through refugee status pay $0. Asylees and permanent residents who got their green card through asylee status pay $135 (under age 16) or $165 (age 16 and older).8U.S. Citizenship and Immigration Services.
