If your husband forged your signature on a 401(k) form, you have three moves to make quickly: notify the plan administrator in writing, hire an attorney who handles ERISA cases, and file a police report. Forging a spouse’s signature on a retirement plan document is a federal crime, and federal law gives you a direct route to have the money put back.
Why Your Signature Was Required
The Employee Retirement Income Security Act of 1974 sets the rules for private employer-sponsored retirement plans, including 401(k)s.1U.S. Department of Labor. Employee Retirement Income Security Act (ERISA) Under those rules, a surviving spouse is automatically entitled to the full death benefit, and your husband cannot name a different beneficiary without your written consent.
Whether your consent was also required for a withdrawal depends on the plan’s structure. Plans that pay benefits as an annuity must follow the qualified joint and survivor annuity rules and need your written, witnessed consent before any distribution.2Office of the Law Revision Counsel. 26 USC 401 – Qualified Pension, Profit-Sharing, and Stock Bonus Plans Many 401(k) plans are structured as profit-sharing plans and are exempt from that withdrawal consent requirement, as long as the full death benefit still goes to the surviving spouse and no annuity option has been elected.3Internal Revenue Service. Fixing Common Plan Mistakes – Failure to Obtain Spousal Consent
That distinction shapes how strong your claim against the administrator is. If consent was required and the plan processed the distribution on a forged form, the transaction was never properly authorized. If consent was not required for the withdrawal but your signature was forged on a beneficiary change, that change is still invalid. Either way, the forgery is illegal.
When consent is required, it must be in writing and witnessed by a plan representative or a notary public.4eCFR. 26 CFR 1.401(a)-20 – Requirements of Qualified Joint and Survivor Annuity A prenuptial agreement does not substitute for that consent, even if it addresses retirement assets.
Build Your File Before You Call Anyone
Write out a timeline first: when you noticed something was wrong, the date and amount of the unauthorized transaction, and any conversations with your husband about the account before and after.
You have a federal right to request copies of plan documents from the administrator, including the withdrawal or loan application carrying the forged signature.5U.S. Department of Labor. Plan Information Send that request in writing so you have proof. Under ERISA, the administrator must provide the documents on written request, either free or at a reasonable copying fee.
Also pull account statements showing the balance before the transaction, bank records that might show where the money landed, and any texts, emails, or voicemails touching the withdrawal. A written admission from your husband can be decisive.
Who to Notify, and in What Order
The Plan Administrator
Call the plan administrator, then follow up the same day with a certified letter. State plainly that a withdrawal was processed using a forged signature, that you did not consent, and that you are requesting an investigation and restoration of the funds. Keep it factual. Include the transaction date, the amount, and a request for all documents related to the distribution.
The administrator owes a fiduciary duty to plan participants and beneficiaries. If your consent was required and the administrator processed the distribution on a forged form, the administrator may share liability. Good-faith reliance on a document that turns out to be fraudulent is limited protection, not blanket immunity.
An ERISA Attorney
ERISA litigation is specialized. You need a lawyer who regularly handles retirement plan disputes, not a general family practitioner. An ERISA attorney can read the plan’s specific consent language, judge whether the administrator failed in its duties, and file suit under the federal civil enforcement provisions, which let a participant or beneficiary sue to recover benefits, enforce plan rights, or obtain relief for fiduciary breaches.6Office of the Law Revision Counsel. 29 USC 1132 – Civil Enforcement
The Police
Forging a signature is a crime in every state. File a police report for forgery and, if it fits your facts, identity theft. Local officers may not immediately dig into a retirement plan dispute, but the report itself matters: plan administrators and financial institutions routinely require a police report number before opening a fraud investigation.
The Department of Labor

The Tax Problem You May Not See Coming
A fraudulent withdrawal creates a tax problem that catches many people off guard. The plan issues a Form 1099-R to the IRS reporting the distribution as taxable income. If you filed a joint return with your husband for that year, you could be jointly liable for the income tax on money you never authorized and never received.
The tax code does not treat fraud or theft as an exception to the 10% early withdrawal penalty that applies to distributions before age 59½.9Office of the Law Revision Counsel. 26 USC 72 – Annuities; Certain Proceeds of Endowment and Life Insurance Contracts If your husband was under 59½, the distribution can trigger regular income tax and the 10% penalty, both potentially landing on a joint return you signed.
If the administrator restores the funds, the tax issue may resolve through a corrected 1099-R. If restoration doesn’t happen quickly, consider filing Form 8857 for innocent spouse relief, which can separate your tax liability from your husband’s when a joint return understated taxes because of errors you didn’t know about. The IRS also recognizes an exception for domestic abuse victims who signed returns under pressure.10Internal Revenue Service. Innocent Spouse Relief Form 8857 must be filed within two years of receiving an IRS notice of taxes due tied to the erroneous return.
What Restoration Looks Like
If the administrator’s investigation confirms the forgery, the plan may be obligated to restore the improperly distributed funds. That obligation is clearest when your consent was required and the administrator processed the transaction without valid authorization. Restoration is not limited to the dollar amount withdrawn. Under the Department of Labor’s correction framework, the plan must also account for lost earnings, calculated using daily compounding at IRS underpayment rates.11U.S. Department of Labor. Criminal Exposure for the Forger
Stealing from a retirement plan is a federal crime. Anyone who embezzles or steals assets from an employee benefit plan subject to ERISA faces up to five years in prison, a fine, or both.12Office of the Law Revision Counsel. 18 USC 664 – Theft or Embezzlement From Employee Benefit Plan EBSA investigators regularly refer these cases to the U.S. Attorney’s Office for prosecution, and courts have imposed prison time and restitution orders on people who forged signatures on plan distribution forms and redirected the money to themselves.13U.S. Department of Labor. Deadlines That Matter
ERISA imposes strict time limits, and missing them can forfeit your claim entirely. A suit for fiduciary breach must generally be brought within three years of the date you gained actual knowledge of the violation, or within six years of when the breach occurred, whichever comes first.14GovInfo. 29 USC 1113 – Limitation of Actions When the breach involves fraud or concealment, you get up to six years from the date you actually discovered it. A forged signature is, by definition, concealed.
For a joint return, the innocent spouse relief window is two years from receiving an IRS notice of audit or taxes due tied to the error.10Internal Revenue Service. Innocent Spouse Relief Don’t wait for the IRS to write to you before talking to a tax professional. State statutes for civil fraud claims generally run three to six years, but the specifics vary; your attorney can tell you which apply.
If Divorce Is on the Table
A forged withdrawal is powerful evidence in a property division. A family court can issue a Qualified Domestic Relations Order directing the plan to pay a portion of the account directly to you, and distributions under a QDRO are exempt from the 10% early withdrawal penalty even if you are under 59½.15U.S. Department of Labor. QDROs – An Overview FAQs9Office of the Law Revision Counsel. 26 USC 72 – Annuities; Certain Proceeds of Endowment and Life Insurance Contracts
A judge can also account for the wrongfully withdrawn funds when dividing marital property. If the money has been restored through the administrator’s investigation, the QDRO simply divides the full account. If it hasn’t, your attorney can argue the missing funds should be credited to your share of the marital estate. Even if divorce is not currently in play, consulting a family lawyer alongside your ERISA attorney preserves your options.
