HUD Inspection Requirements: NSPIRE Tiers and Deadlines

HUD inspection requirements set the physical condition every federally assisted rental unit must meet before a landlord can collect subsidy payments and at recurring intervals afterward. Local Public Housing Agencies carry out the inspections for the Housing Choice Voucher (Section 8), Public Housing, and Project-Based Voucher programs.1eCFR. 24 CFR Part 982 – Section 8 Tenant-Based Assistance: Housing Choice Voucher Program The standard inspectors apply is shifting from the older Housing Quality Standards to a newer framework called NSPIRE, and which one governs your unit right now depends on the program and on choices your local PHA has made.

Which Standard Applies to Your Property

NSPIRE — the National Standards for the Physical Inspection of Real Estate, codified at 24 CFR Part 5, Subpart G — merges the old Housing Quality Standards used for vouchers and the Uniform Physical Condition Standards used for Public Housing into a single framework.2eCFR. 24 CFR 5.703 – National Standards for the Condition of HUD Housing The core change is how deficiencies are ranked. Instead of treating every failed item alike, NSPIRE sorts problems into four severity tiers and ties the correction deadline to how dangerous the deficiency is.

For Public Housing and most project-based HUD programs, NSPIRE is already in effect. For the Housing Choice Voucher, Project-Based Voucher, and Moderate Rehabilitation programs, HUD has extended the compliance deadline through January 31, 2027.3Federal Register. Ask your PHA which one it currently follows before you rely on any specific rule below.

What Inspectors Actually Check

NSPIRE organizes every property into three inspectable areas.

The Unit

Inspectors verify that appliances function, outlets work, windows and doors open and lock, bathrooms ventilate, and the unit has a permanent heat source. For voucher properties, the inspection is limited to the assisted unit and the building systems that directly serve it.2eCFR. 24 CFR 5.703 – National Standards for the Condition of HUD Housing

Inside Common Areas

In multi-unit buildings, hallways, stairwells, laundry rooms, basements, and mechanical spaces are inspected, along with building-wide plumbing, electrical, elevators, fire protection, HVAC, and sanitary systems. Each level must have a working smoke alarm, and any outlet within six feet of a water source must have GFCI protection. Unvented gas, oil, or kerosene space heaters are prohibited inside.

Outside and Site

The exterior review covers roof, walls, foundation, windows, grounds, fencing, retaining walls, parking, and drainage, along with trip hazards, missing guardrails, and blocked emergency exits. For voucher properties, it also covers the primary and secondary paths from the unit’s entry door to the public way.

When Inspections Happen

Before the Tenancy Starts

A unit must pass inspection before the PHA executes a Housing Assistance Payment contract. For PHAs with up to 1,250 voucher units, the inspection must be completed within 15 days after the family and owner request tenancy approval; larger PHAs are held to a “reasonable time,” with 15 days as the target.4eCFR. 24 CFR 982.305 – PHA Approval of Assisted Tenancy All utilities must be on at the time of the inspection.

A unit does not always need a clean report to start a tenancy. PHAs can use a “non-life-threatening” option that lets them approve a unit, sign the HAP contract, and begin subsidy payments even when the unit has failed, provided no life-threatening deficiencies exist.5eCFR. 24 CFR 982.405 – PHA Unit Inspection The owner then has 30 days from the HAP contract’s effective date to fix the remaining problems. If repairs stall, the PHA withholds payments and can terminate the contract, with an outer limit of 180 days. The family must be told about the deficiencies and can decline the unit.

Periodic Inspections

Under HQS, PHAs must inspect every assisted unit at least once every two years, or once every three years for small rural PHAs.5eCFR. 24 CFR 982.405 – PHA Unit Inspection

Under NSPIRE, the default is annual, but properties earn longer intervals based on their score:6eCFR. 24 CFR 5.705 – Timing and Frequency of Physical Condition Inspections

  • Score of 90 or above: inspected once every three years.
  • Score of 80 to 89: inspected once every two years.
  • Score below 80: inspected annually.

Complaint Inspections

A tenant or third party can trigger an inspection outside the normal schedule by reporting conditions that may violate the standards. PHAs must follow up, and the results can lead to the same enforcement actions as a failed periodic inspection.

Deficiency Tiers and Correction Deadlines

This is where landlords most often go wrong. NSPIRE does not give you 30 days for everything. Every finding is placed in one of four tiers:7HUD. NSPIRE Final Standards

  • Life-threatening — 24 hours. High risk of death. Examples: gas leak, missing smoke alarm, non-functioning carbon monoxide detector.
  • Severe — 24 hours. High risk of serious injury, permanent disability, or serious loss of physical security. Examples: major structural failures and certain electrical hazards.
  • Moderate — 30 days. Moderate risk of an adverse health event or temporary harm, or a condition that could worsen a chronic health issue if ignored.
  • Low — 60 days. Important to habitability, but not a substantive health or safety risk.

For life-threatening and severe items, the owner or PHA must electronically certify within two business days after the deadline that the problem has been fixed, or that the hazard has been blocked pending permanent repairs.8eCFR. 24 CFR Part 5 Subpart G – Physical Inspection of Real Estate If a permanent fix will take longer, the owner submits a proposed timeline for HUD approval.

The Items That Fail Inspections Most Often

Smoke Alarms

Every unit must have working smoke alarms. For units built before December 29, 2022 (and not substantially rehabilitated after that date), the alarm must be hardwired or a sealed, tamper-resistant unit with a 10-year non-rechargeable battery. Units built or substantially rehabilitated after that date must have hardwired alarms.9Federal Register. National Standards for the Physical Inspection of Real Estate, Carbon Monoxide Detection Requirements, and Smoke Alarm Requirements Missing or non-functional smoke alarms are life-threatening and carry a 24-hour deadline.

Carbon Monoxide Alarms

Carbon monoxide alarms are required whenever the unit, the building, or an attached garage could expose residents to combustion byproducts. Triggering situations include fuel-burning appliances or fireplaces, bedrooms served by a forced-air furnace located elsewhere in the building, and units within one story of an enclosed attached garage without adequate ventilation.10HUD. NSPIRE Standard – Carbon Monoxide Alarm When required, the alarm must be installed near or inside each bedroom. Missing CO alarms carry the 24-hour clock.

Electrical Hazards

Exposed wiring, missing outlet covers, and overloaded circuits are frequent failure points. Any outlet within six feet of a water source needs GFCI protection, and kitchens and bathrooms must have permanently mounted light fixtures. Shock and fire hazards are typically classified as life-threatening or severe.

Heat, Plumbing, and Structure

The unit must have a permanent heat source capable of holding adequate temperatures in cold months. Unvented gas, oil, or kerosene space heaters are banned. Plumbing must deliver hot and cold running water, and the sanitary system must function without leaks or blockages. A compromised roof, foundation failure, or blocked egress reaches life-threatening or severe status.

Deteriorated Paint in Pre-1978 Housing

Any unit built before 1978 gets a visual assessment of all painted surfaces. Chipping, peeling, or otherwise deteriorated paint is a deficiency. Repairs must follow lead-safe work practices when the affected area is more than 2 square feet in any single interior room, more than 20 square feet on exterior surfaces, or more than 10 percent of a small component like a window sill or baseboard.11HUD. Open-flame torching, uncontrolled machine sanding, and dry scraping of large areas are prohibited.

Pests and Mold

Active infestations and visible mold cause failures. Pest problems are typically moderate or severe depending on extent, and mold across large areas or tied to ongoing moisture intrusion can reach severe. Both need documented remediation before the unit passes re-inspection.

What Happens When a Unit Fails

The owner and the tenant both receive a notice listing every deficiency. What follows depends on who caused the problem.

Owner Responsibilities

The owner must correct all deficiencies within the deadlines tied to each severity tier. Missing a deadline triggers withholding of Housing Assistance Payments. If the unit still fails standards within 60 days of the initial non-compliance determination (or a longer period the PHA considers reasonable), the PHA must terminate the HAP contract and remove the unit from the program.12eCFR. 24 CFR 982.404 – Maintenance: Owner and Family Responsibility; PHA Remedies

When the Tenant Caused the Problem

If the PHA determines that a deficiency was caused by the tenant, a household member, or a guest, beyond normal wear and tear, the PHA can waive the owner’s obligation to fix it. The owner’s subsidy payments are not withheld.12eCFR. 24 CFR 982.404 – Maintenance: Owner and Family Responsibility; PHA Remedies Responsibility shifts to the tenant, who must correct life-threatening items within 24 hours and everything else within 30 days. If the tenant does not, the PHA can terminate the family’s assistance.

Common tenant-caused deficiencies include failing to pay for utilities the tenant is responsible for, not supplying or maintaining appliances the tenant agreed to provide, and damage beyond ordinary use.

Disputing an Inspection Finding

NSPIRE includes a formal technical review process for inspection findings you believe are wrong. The request must be submitted electronically through the NSPIRE system within 45 calendar days after HUD provides the inspection report.13HUD. NSPIRE Technical Review Guidance – for Property Representatives Grounds include a non-existent deficiency, a building data error affecting the sample, conditions beyond the owner’s control such as a natural disaster, a HUD-approved rehabilitation project in progress, or a conflict with local building code. Technical review can adjust the score and remove specific findings — which matters most for properties near a scoring tier boundary.

How Scoring Affects You Beyond the Next Inspection

The numerical score does more than set the next inspection cycle. A property scoring below 60 on two consecutive inspections may be referred to HUD’s Departmental Enforcement Center. A score of 30 or below triggers automatic referral.14eCFR. 24 CFR 5.711 – Scoring, Ranking Criteria, and Appeals Properties scoring at or above 60 can limit their follow-up survey to the specific deficiencies cited; properties scoring below 60 must survey the entire project and submit the results electronically to HUD.

Preparing for the Inspection

Inspectors must respect resident privacy and personal belongings, but they need access to every room, closet, and inspectable area. The property representative — not the tenant — is responsible for providing access and for making sure appliances are plugged in and ready to test. Stoves and ovens must be turned on and off in the inspector’s presence by the property representative.15HUD. NSPIRE Inspection Protocol and Guidance

One boundary worth knowing: other than primary appliances, items owned by the tenant cannot be cited unless they affect a fire safety system or put the building at risk. A tenant’s furniture will not fail the unit; a tenant-owned appliance blocking the electrical panel or an egress path is a different matter.

The most useful preparation is walking the unit against the NSPIRE checklist before the inspector arrives. Test every smoke alarm and carbon monoxide detector. Run hot and cold water at each fixture. Confirm that GFCI outlets trip and reset. Verify that windows open, doors lock, and no painted surface is visibly deteriorating, especially in pre-1978 buildings where deteriorated paint automatically pulls in lead-paint protocols. The items that fail inspections most often are the easiest ones to fix in advance.
