How to Write a USCIS Expedite Request Letter

A USCIS expedite request letter asks the agency to move your pending application ahead of others in the queue, and to write one that works you need to identify which of USCIS’s recognized expedite criteria fits your situation, state it in plain terms with your receipt number, and attach independent evidence that proves the urgency is real. The decision is discretionary. Officers grant these requests sparingly because approving yours pushes someone else’s case back, so precision and proof matter more than length or emotion.

Match Your Situation to a Recognized Criterion

Before you draft anything, confirm your facts fit one of the grounds USCIS actually considers. The Policy Manual lists these as illustrative, but requests that sit outside them almost never succeed.1U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests

  • Severe financial loss to a company or person. A lost contract, imminent business failure, or forced layoffs can qualify. General financial inconvenience does not. This ground is unavailable if the time pressure came from your own late filing or missed response to a request for evidence.
  • Emergencies and urgent humanitarian situations. Serious illness, disability, death of a family member, or dangerous conditions from armed conflict or natural disasters. Urgent travel abroad for medical treatment or a family member’s grave illness fits here as well.
  • U.S. government interests. Public safety, national security, or other federal interests, generally raised by a government agency that identifies an articulable reason.
  • Nonprofit furthering U.S. cultural or social interests. An IRS-designated nonprofit can request an expedite tied to a specific beneficiary whose work advances those interests. A general labor shortage will not do; the letter has to explain why this particular person is needed now.

Pick the criterion that best describes your facts and build the letter around it. If more than one applies, lead with the strongest and treat the others as secondary.

What Goes in the Letter

Officers see a high volume of these requests, so the letter should read as a tight, factual case rather than a personal statement. Structure it so the reviewer can identify your case, your criterion, and your proof within the first page.

Identifying Information

Open with your full legal name, the 13-character receipt number for your pending application (three letters followed by ten digits), and the specific benefit at issue, such as Form I-765 employment authorization or Form I-131 travel document. This lets the officer pull up your file immediately.

The Criterion and the Facts

State plainly which expedite criterion your situation falls under. Then walk through the concrete facts that satisfy it. If you are claiming severe financial loss, name the contract at risk, the revenue impact, and the timeline. If you are claiming a medical emergency, give the diagnosis, the treatment required, and the reason your immigration status must be resolved for that treatment to move forward. Vague references to hardship fail. Officers are trained to look for specifics.1U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests

References to Your Evidence

Point to each attached document by name and date inside the letter. Instead of “see attached medical records,” write something like “the discharge summary from Dr. Rodriguez dated March 12, 2026, confirms the need for surgery within 60 days.” This guides the officer straight to the proof and makes it harder to overlook.

Tone and a Line About Timing

Keep it professional and factual. Where relevant, note that the urgency was not caused by delay on your side, because USCIS denies financial-loss and travel-related expedites when the applicant created the time pressure by filing late or missing agency deadlines.1U.S. Citizenship and Immigration Services. The Evidence You Attach

A letter without documentation is almost certain to fail. USCIS expects objective, third-party proof that independently confirms the urgency you describe. Gather everything before you start drafting, because gaps are the single most common reason these requests are denied, and any back-and-forth about missing evidence defeats the point of asking for speed.

For financial loss, that means bank statements, profit and loss reports, contracts in jeopardy, or notices from creditors or landlords. The evidence should show the harm is imminent, not speculative. For a medical or humanitarian claim, provide records from a treating physician or hospital explaining the diagnosis and why immediate action on the immigration case is necessary for care. A doctor’s letter should spell out the timeline and the consequences of waiting.

For a nonprofit request, the evidence should tie the specific beneficiary to a specific need. USCIS has recognized situations like a medical researcher urgently needed for a public health crisis, a professor needed for an imminent cultural program, or a religious worker whose particular skills are critical to a continuing social outreach program.1U.S. Citizenship and Immigration Services. How to Submit the Letter

USCIS accepts expedite requests through a few channels. The most common is calling the USCIS Contact Center at 1-800-375-5283 and asking the agent to create a service request for an expedite. You can also use the Emma chatbot on the USCIS website by typing “expedite” and following the prompts. If your case is tied to an online USCIS account, the secure messaging feature inside that account may let you submit the letter and upload supporting documents directly.

USCIS will sometimes direct you to fax or mail the letter and evidence to a specific service center after that first contact. If you mail it, use a trackable service so you have proof of receipt. Keep copies of everything and note any confirmation or service request numbers you receive.

Reasons Requests Get Denied

Knowing where these letters fail helps you avoid the same traps. The patterns officers see most often:

  • Self-created urgency. Late filings or missed evidence deadlines will not support an expedite. This limit is built into the financial loss criterion and applies to travel-related requests as well.
  • Humanitarian filings with nothing more. Filing an asylum application, refugee petition, or humanitarian parole request does not, on its own, justify an expedite. You need time-sensitive facts beyond the nature of the filing.
  • Thin documentation. A letter describing your situation without proof attached rarely succeeds.
  • Steps outside USCIS’s control. Cases waiting on a biometrics appointment, interview, medical exam, background check by another agency, or on-site inspection generally cannot be sped up because the delay is not on USCIS’s side.
  • Dependent cases. If your application depends on a principal applicant’s case being decided first, USCIS may not be able to move yours independently.
  • Nonprofit generality. A nonprofit pointing to a staffing shortage in the abstract, rather than explaining why a named person is urgently needed, will be denied.

These denial patterns all appear in the USCIS Policy Manual’s guidance on expedite requests.1U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests

After You Submit

USCIS does not publish a formal timeline for expedite decisions, but responses commonly take several weeks. The agency communicates the outcome by email or through your online account. If the request is granted, your case moves into a priority queue for adjudication. That is not the same as approval. An officer will look at your case sooner, but the normal eligibility rules still apply, and you could still receive a request for evidence or a denial on the merits.

Monitor your email and your online account after submitting. You can also check whether the expedite flag is showing on your file through the USCIS case status tool.3U.S. Citizenship and Immigration Services. e-Request – Check Case Processing – Case Status Online

If the Request Is Denied

A denied expedite cannot be formally appealed because the decision is discretionary. You can submit a new request if your circumstances change or you obtain stronger evidence, but the second version should fix whatever weakened the first, whether that was thin documentation, a mismatch with the criteria, or timing. Resubmitting the same letter unchanged is unlikely to produce a different result.

A congressional inquiry is another route. Your U.S. Senator or Representative can submit an inquiry to USCIS on your behalf, and their offices generally have staff dedicated to immigration casework. It is free. You cannot have active inquiries with more than one congressional office about the same case at the same time, so pick one.

The DHS Office of the Citizenship and Immigration Services Ombudsman also offers independent case assistance in narrower circumstances, including when USCIS granted an expedite more than two months ago but has not acted on it. The Ombudsman cannot help if USCIS recently denied your expedite request.4Homeland Security. How to Submit a Case Assistance Request

One Boundary: Premium Processing

If premium processing is available for your form type, USCIS expects you to use it rather than request a free expedite. Premium processing is a paid service under Form I-907 with a guaranteed response window; the discretionary expedite is free but entirely up to the officer. The exception runs to qualifying nonprofits, which can request a free expedite even where premium processing exists.1U.S. Citizenship and Immigration Services. Chapter 5 – Expedite Requests Before you invest time in drafting a letter, check whether your form is eligible for premium processing, because a request that should have gone through I-907 will usually be turned away.
