How to Sue eBay: Arbitration, Opt-Out, and Small Claims

To sue eBay, you generally can’t file a traditional lawsuit at all. The User Agreement funnels almost every dispute into binding arbitration, and before you can even start that, you must complete eBay’s Money Back Guarantee process and send a written Notice of Dispute that triggers a mandatory 45-day informal resolution period. After that, your realistic options are arbitration through the American Arbitration Association or, for smaller amounts, small claims court in your own county. A regular courtroom lawsuit is only available if you mailed an opt-out notice within 30 days of first accepting the User Agreement, or if your claim falls into one of the narrow categories the arbitration clause doesn’t cover.

Use the Money Back Guarantee First

The Money Back Guarantee covers most buyer problems, including items that never arrive and items that don’t match the listing. For an item that didn’t arrive, you can report the problem once the estimated delivery date has passed and have up to 30 calendar days after that date to file. For an item that doesn’t match its listing, you can request a return within 30 days of delivery or the seller’s return window, whichever is longer. The seller then has three business days to respond, and if nothing gets fixed, you can ask eBay to step in and decide.1eBay. eBay Money Back Guarantee Policy

Skip this step and you lose it. If you go straight to a chargeback with your credit card company, eBay closes your internal case and the platform’s help disappears. Any later arbitrator or judge will also expect to see that you tried the platform’s own channels. Save screenshots, messages, case numbers, and every eBay response from day one.

Send the 45-Day Notice of Dispute

If the internal process doesn’t fix things, you still cannot jump to arbitration or small claims court. eBay’s User Agreement, effective February 20, 2026, requires both sides to attempt informal resolution first through a written Notice of Dispute.2eBay. User Agreement

The notice has to carry your personal signature, a description of your claims, the specific relief you’re seeking, and the username, email address, and phone number linked to your account. Send it by email to DisputeNotice@eBay.com or by mail to 339 W. 13490 S., Ste. 500, Draper, UT 84020. Once eBay receives a valid notice, a 45-day informal resolution period runs, and any applicable statute of limitations is paused during that window, so you don’t lose your right to file while you negotiate.2eBay. User Agreement

Treat the notice as a real settlement demand, not a formality. A vague complaint letter is easy to ignore. A notice that spells out your losses, attaches evidence, and states a specific dollar figure forces a substantive response, and a lot of disputes settle right here.

Arbitration or Small Claims Court

After the 45 days, if there’s no resolution, you pick your forum. The default under the User Agreement is binding arbitration, which uses a private decision-maker instead of a judge or jury, and the outcome is final with almost no appeal.2eBay. User Agreement

The Federal Arbitration Act makes these clauses enforceable, and courts routinely uphold them.3Legal Information Institute (LII) / Cornell Law School. Federal Arbitration Act The User Agreement also includes a class action waiver, so you cannot join or lead a group lawsuit against eBay, and the Supreme Court has held that this kind of waiver is valid and that federal arbitration law overrides state law that would forbid it.4Justia U.S. Supreme Court Center. AT&T Mobility LLC v Concepcion, 563 US 333 (2011)

The Small Claims Carve-Out

The User Agreement allows either party to file in small claims court instead of arbitration, provided the case qualifies and stays within that court’s limits.2eBay. User Agreement Maximum claim amounts vary by state, ranging roughly from $2,500 to $25,000. If your dispute fits, this is usually the most practical route: no lawyer required, modest filing fees, hearings scheduled in weeks rather than months, and you file in your own local court. The 45-day informal resolution requirement still applies before you file.

The 30-Day Opt-Out for New Users

New eBay users have a narrow window to preserve their right to sue in regular court. Within 30 days of first accepting the User Agreement, you can mail a signed opt-out notice to eBay’s Litigation Department at the Draper, Utah address; it must be postmarked within the deadline.5eBay. eBay Opt-Out Notice Miss it and you’re locked in for the life of the account. If you just joined, mailing the opt-out costs nothing and keeps your options open; you can still use arbitration later if you prefer.

Who Pays for Arbitration

For claims of $10,000 or less, the User Agreement provides that eBay will cover the filing, administration, and arbitrator fees at your request. For larger claims, the American Arbitration Association’s consumer fee schedule applies and costs are split under AAA rules. That fee structure means smaller disputes won’t cost you more out of pocket in arbitration than they would in small claims court.

What Kind of Claim You Actually Have

Your claim type drives your evidence, your deadline, and where you can realistically win.

Contract Disputes

The most common claims involve transactions gone wrong: items that don’t ship, products that don’t match their description, or missing payments. When you buy or sell on eBay you enter a binding contract governed by the Uniform Commercial Code in most states. If a seller fails to deliver what was described, you can seek the difference in value between what was promised and what you received, or a refund plus additional losses.

Under the UCC, you generally have four years from the date of the breach to file, and the clock starts when the breach happens, not when you discover it. The original purchase agreement can shorten this to as little as one year.6Legal Information Institute (LII) / Cornell Law School. UCC 2-725 Statute of Limitations in Contracts for Sale Save order confirmations, listing screenshots, seller messages, tracking data, and photos of what actually arrived.

Intellectual Property Infringement

If someone is selling counterfeits or using your copyrighted images, eBay’s Verified Rights Owner (VeRO) Program lets you report infringing listings directly, and eBay removes qualifying ones.7eBay. eBay Verified Rights Owner Program and Intellectual Property Policy Legal action becomes relevant when eBay doesn’t act on legitimate reports or when the infringement is too widespread for individual takedowns to address. Section 230 of the Communications Decency Act contains an explicit exception for intellectual property claims, so eBay doesn’t get the broad platform shield here that it enjoys elsewhere.8Office of the Law Revision Counsel. 47 USC 230 – Protection for Private Blocking and Screening of Offensive Material Remedies can include injunctions and monetary damages.

Fraud and Consumer Protection

Claims involving fraud, identity theft, or deceptive practices can involve significant losses. Federal law prohibits unfair or deceptive business practices, and the FTC enforces those rules, but the FTC does not litigate individual consumer disputes.9Federal Trade Commission. A Brief Overview of the Federal Trade Commission’s Investigative, Law Enforcement, and Rulemaking Authority An FTC complaint creates a paper trail but won’t get your money back. For personal recovery, you’ll go through arbitration, small claims court, or, if you opted out, a regular lawsuit. Remedies can include restitution and, in cases of intentional misconduct, punitive damages.

The Section 230 Problem

The single hardest legal obstacle to suing eBay for a seller’s conduct is Section 230 of the Communications Decency Act, which provides that online platforms cannot be treated as the publisher or speaker of content posted by their users. If a seller posts a fraudulent listing, eBay is generally not legally responsible for that listing’s content.8Office of the Law Revision Counsel. 47 USC 230 – Protection for Private Blocking and Screening of Offensive Material

The protection is broad but not absolute. Courts have found that platforms lose Section 230 immunity when they actively contribute to the development of illegal content rather than passively hosting it. The strongest claims against eBay focus on what eBay itself did or failed to do: knowledge of ongoing fraudulent activity, repeated reports, and a pattern of inaction. Pointing to a single bad listing isn’t enough. IP claims, as noted above, sit outside the shield entirely.

Filing in Court: Where and How

If you go the courtroom route (either because you opted out or because your claim is one the arbitration clause doesn’t cover), jurisdiction matters. eBay is incorporated in Delaware and headquartered in San Jose, California. Its User Agreement historically directs disputes to Santa Clara County, California, through a forum selection clause, and courts have generally upheld this type of clause, meaning you may have to litigate in California.10U.S. Securities and Exchange Commission. eBay Inc SEC Filing

Federal court requires a jurisdictional basis. A claim under federal law, like a copyright or trademark statute, supplies federal question jurisdiction. Otherwise you need diversity jurisdiction: different-state parties and more than $75,000 in controversy.11Office of the Law Revision Counsel. 28 USC 1332 – Diversity of Citizenship; Amount in Controversy; Costs Small claims is filed in your own county, which is a big part of why it’s the most practical option for most consumers. Check your state’s rules for serving an out-of-state corporation.

Filing starts with a complaint laying out who you are, what eBay did, the legal basis, and what you want. Serving eBay means delivering the complaint and summons to a person authorized to accept legal documents; under federal rules, that’s an officer, a managing or general agent, or a registered agent.12Cornell Law School. Federal Rules of Civil Procedure Rule 4 – Summons Registered agent information is available through the Delaware Division of Corporations or the California Secretary of State. Expect eBay to respond with a motion to compel arbitration if you didn’t opt out, or a motion to dismiss if it thinks your claims fall short.13Cornell Law School. Federal Rules of Civil Procedure Rule 12 – Defenses and Objections For anything beyond small claims, hiring an attorney is a practical necessity.

Getting eBay’s Records in Discovery

If a case survives the initial motions, discovery is where the real leverage sits, because eBay holds detailed records. Through a subpoena or discovery request you can obtain account registration details including billing and mailing addresses, IP addresses recorded at registration and at the time of specific listings, listing and bid histories going back up to two years, and financial account information linked to the account. Requests for related or linked accounts have to be specific and explain the connection, such as shared payment instruments or identical registration data.

eBay retains most account records indefinitely but transaction records only for about two years. Older disputes may have missing data. A litigation hold request early on preserves what still exists.

Taxes on a Settlement or Award

If you win money from eBay, it’s almost certainly taxable. The IRS treats all income as taxable unless a specific provision says otherwise, and the main exclusion is for damages received for personal physical injuries or physical sickness, which won’t fit a typical eBay dispute.14Internal Revenue Service. Tax Implications of Settlements and Judgments Compensation for emotional distress, lost profits, and breach of contract is included in gross income. If eBay pays you $600 or more in a settlement, expect a Form 1099-MISC.15IRS.gov. Instructions for Forms 1099-MISC and 1099-NEC If your attorney takes a contingency fee, you still owe tax on the full gross amount. Talk to a tax professional before signing anything.

What Actually Wins

Most disputes with eBay never see a courtroom, and that’s how the User Agreement is built to work. For smaller losses, small claims court is usually the fastest and cheapest path. For larger claims, arbitration through AAA is the likely forum unless you opted out within 30 days of creating your account. The strongest cases involve clear documentation, specific dollar losses, and evidence that eBay’s own action or inaction caused the harm. Vague complaints about platform fairness don’t translate into legal claims. Whatever route you take, start with a detailed Notice of Dispute and keep copies of every document from the moment the problem begins. The quality of your records matters more than any courtroom strategy.
