To set up a self-managed super fund in Australia, you choose your members and trustee structure, sign a trust deed, register the fund with the Australian Taxation Office within 60 days, open a dedicated bank account, obtain an electronic service address, prepare a written investment strategy, and roll over any existing super. Each step has rules attached, and getting one wrong can cost the fund its concessional tax status before it ever receives a contribution.
An SMSF is a private superannuation structure regulated by the ATO. You and your fellow members act as trustees, meaning you make every investment decision and carry full legal responsibility for compliance. The payoff is control; the cost is that errors fall on you personally.
Pick Your Members and Trustee Structure
An SMSF can have up to six members, a limit that increased from four on 1 July 2021. Every member must also be a trustee, or a director of the corporate trustee if you go that route. No member can be an employee of another member unless they are related.
Not everyone is eligible. The Superannuation Industry (Supervision) Act 1993 disqualifies anyone convicted of an offence involving dishonesty, anyone who is an undischarged bankrupt, and anyone otherwise insolvent. Acting as a trustee while disqualified is a criminal offence. If a past legal issue might affect your eligibility, get legal advice before you start, not after.
You also need to meet residency rules throughout each financial year. The fund must be established in Australia or hold at least one asset here, its central management and control must ordinarily be in Australia, and at least 50% of the market value of assets attributable to super interests must belong to Australian-resident members.1Australian Taxation Office. Check Your SMSF Is an Australian Super Fund A trustee who temporarily moves overseas can still meet the central management test for up to two years; longer absences risk the fund becoming non-complying.
Individual Trustees or a Corporate Trustee
You have two structural options. With individual trustees, each member is personally named on the fund’s assets and legal documents. With a corporate trustee, you register a proprietary limited company with the Australian Securities and Investments Commission (ASIC) and that company holds the fund’s assets.
The corporate route costs more upfront. ASIC charges $611 to register a special purpose company, plus an annual review fee of roughly $329.2Australian Securities & Investments Commission. Fee Payments and Queries It makes adding or removing members far simpler, though, because the company name on asset titles stays the same when membership changes. If you choose a corporate trustee, every director must obtain a Director Identification Number before registering the fund. The ATO will not process your SMSF registration without it.3Australian Taxation Office. Choose Your SMSF Trustee Structure
Draft and Sign the Trust Deed
The trust deed is the fund’s constitution. It sets the rules for membership, contributions, benefit payments, and how trustees make decisions. It must comply with the SIS Act and should be tailored to your circumstances. A generic template may miss provisions you need, such as non-lapsing binding death benefit nominations or pension payment rules. Having a specialist draft or review the deed is worth the cost, because a defective deed can make the fund invalid.
In most Australian jurisdictions, each trustee must sign the deed in the presence of an adult witness who is not a party to it. Victoria and Queensland do not require witnessing for deeds. The original document is not lodged with any government agency, but it must be stored securely because the fund cannot operate without it.
Everything you decide to do with the fund will be measured against one overriding rule. Section 62 of the SIS Act requires trustees to maintain the fund solely to provide retirement benefits to members or their dependants.4AustLII. Superannuation Industry (Supervision) Act 1993 – Sect 62 Buying a holiday house through the fund and letting family stay there, for example, would fail this sole purpose test even if the property also generated rental income. Breaching it is one of the fastest ways to lose complying status and the 15% concessional tax rate.
Prepare the Investment Strategy and Trustee Declaration
SIS Regulation 4.09 requires trustees to prepare a written investment strategy and review it regularly. The strategy must address the risk and likely return of investments, diversification across asset classes, liquidity (whether the fund can convert assets to cash quickly enough to pay benefits and expenses), and the ability to meet the fund’s liabilities as they fall due.5Australian Taxation Office. Create Your SMSF Investment Strategy You must also consider whether to hold insurance for each member, such as life or total and permanent disability cover. If you decide against insurance, document why.
Each trustee (or director of a corporate trustee) must also sign a Trustee Declaration (NAT 71089) within 21 days of being appointed. You don’t send the signed declaration to the ATO, but you must keep the original on file for the life of the fund.6Australian Taxation Office. Trustee Declaration Auditors will ask for it.
Register the Fund With the ATO
Once the trust deed is signed, you have 60 days to register the fund with the ATO. Miss the window and you must explain the delay in writing or your application may be refused. Registration involves applying for both an Australian Business Number (ABN) and a Tax File Number (TFN) through the Australian Business Register. During the application, you formally elect for the fund to be regulated by the ATO. Without that election, the fund won’t receive concessional tax treatment and employers can’t claim deductions for contributions.7Australian Taxation Office. Register Your SMSF
Processing can be nearly instant for straightforward applications, but the ATO may take up to 20 business days if additional verification is needed, and sometimes conducts phone interviews with trustees to confirm identity and understanding of obligations. Once registration is complete, the fund appears on the Super Fund Lookup register as a complying fund, which signals to employers and other super funds that it is eligible to receive contributions and rollovers.8Australian Taxation Office. Every SMSF pays an annual supervisory levy to the ATO. The levy has been $259 per year since the 2014–15 financial year, but newly registered funds pay $518 with their first annual return, covering both the current and following financial year.9Australian Taxation Office. SMSF Supervisory Levy
Open a Bank Account and Get an Electronic Service Address
Your fund needs a dedicated bank account with assets kept completely separate from personal money. Open it in the name of the trustees using the format “[Trustee names] as trustee for [Fund name].” Banks typically ask for the signed trust deed, the fund’s ABN, and identification for each trustee.
To receive employer contributions and process rollovers through SuperStream (the mandatory electronic payment system), you also need an electronic service address, or ESA. You obtain one through an SMSF messaging provider. The ATO publishes a register of approved providers, which includes companies like BGL, Class Super, and SuperMate.10Australian Taxation Office. Get an Electronic Service Address If your fund needs to handle both contributions and rollovers, confirm your chosen provider supports both; some only handle contributions.11Australian Taxation Office. Register of SMSF Messaging Providers Without an active ESA, your fund cannot legally process employer contributions.
Roll Over Existing Super and Receive Contributions
Most people setting up an SMSF already have super in another fund. Rolling that balance into the new SMSF must happen electronically through SuperStream. The process requires your ESA to be active and recorded with the ATO, and your bank account details to be up to date. You can initiate a whole-of-balance transfer through ATO online services (myGov), or arrange it directly with the transferring fund. Once the money and data message arrive, the trustee must confirm receipt by sending an outcome response through the messaging provider within three business days.12Australian Taxation Office. For the 2025–26 financial year, the concessional contributions cap (employer contributions, salary sacrifice, and personal deductible contributions combined) is $30,000 per member.13Australian Taxation Office. Contributions Caps The non-concessional cap (after-tax contributions) is $120,000 per member, but if your total super balance across all funds was $2 million or more on 30 June of the previous financial year, your non-concessional cap drops to zero.14Australian Taxation Office. Non-Concessional Contributions Cap Track contributions across all your super accounts, not just the SMSF, because exceeding the caps triggers extra tax.
What You’re Signing Up For After Setup
Setting up the fund is the straightforward part. Running it is where most trustees underestimate the workload.
Every SMSF must be audited annually by an approved SMSF auditor registered with ASIC. The auditor cannot be a member, trustee, or anyone closely connected to the fund, and the audit must be completed before you lodge the fund’s annual return. If the auditor finds contraventions, they are legally required to report them to the ATO.15Australian Securities & Investments Commission. Applying for SMSF Auditor Registration
The SMSF annual return covers tax, regulatory, and member reporting in a single lodgment. Self-preparers generally lodge by 28 February following the end of the financial year. If a tax agent lodges the return, the deadline extends to 15 May. Newly registered funds face an earlier deadline of 31 October.16Australian Taxation Office. Know the Date Your SMSF Annual Return Is Due
Record keeping has its own rules. Financial records must be kept for at least five years. Trustee records, including meeting minutes, investment strategy reviews, changes of members, and the trustee declarations, must be kept for at least ten years.17Australian Taxation Office. SMSF Record-Keeping Requirements If you can’t produce a document the auditor asks for, that’s a contravention even if the underlying transaction was fine.
Investment restrictions also apply from day one. Loans to related parties, investments in related parties, and fund assets leased to related parties are classed as in-house assets, and their total market value cannot exceed 5% of the fund’s total assets at the end of any financial year.18Australian Taxation Office. What Are the SMSF Investment Restrictions All fund assets must be valued at market value for the annual financial statements.19Australian Taxation Office. Guide to Valuing SMSF Assets
None of this is prohibitive, but it is work. Before you sign the deed, be honest about whether you want the control enough to carry the obligations that come with it.
