File Within 30 Business Days of Entering Mexico
The deadline is 30 business days from the date you crossed into Mexico. That means weekdays only, not counting holidays, so you generally have around six weeks.1UNHCR Mexico. Not knowing the process existed, language barriers, and being unable to reach a COMAR office are accepted explanations. Start as soon as you can.
Who Can Apply
Mexican law recognizes two grounds for protection. The first is the traditional refugee definition: a well-founded fear of persecution based on race, religion, nationality, gender, membership in a particular social group, or political opinion.2Honorable Cámara de Diputados. The second is complementary protection. What to Bring
You do not need a valid passport or any identification to apply. COMAR will accept your application even if you have no documents.4COMAR. Procedure to Be Recognized as a Refugee in Mexico Anything you do have helps: a passport, national ID card, or birth certificate, even if expired.
Evidence of what happened to you carries more weight than identification. Bring police reports, threatening messages, medical records showing injuries, news articles about conditions you fled, photographs, or written statements from witnesses. If family members are traveling with you, gather their names, dates of birth, and relationship details so they can be included in your application from the start rather than filed separately.
The Interview and the Decision

COMAR will then schedule one or more in-person interviews about why you left your country and why you cannot return. If you do not speak Spanish, you have the right to an interpreter at no cost.5UNHCR Mexico. Rights and Obligations of Asylum Seekers Specific dates, names, and locations matter far more than general statements about country conditions. Expect COMAR to ask for additional documents or evidence afterward.
The law gives COMAR 45 business days to decide, extendable to 90 in exceptional circumstances.2Honorable Cámara de Diputados. Ley Sobre Refugiados, Protección Complementaria y Asilo Político In practice, backlogs make the wait longer, often several months.
Rules You Must Follow While Your Case Is Pending
Three obligations can end your case if you ignore them:5UNHCR Mexico. Rights and Obligations of Asylum Seekers
- Stay in the state where you filed. Moving without written authorization from COMAR causes your case to be declared abandoned.
- Sign in on the dates COMAR or INM specifies at the office where you started. Missing a sign-in also triggers abandonment.
- Attend every interview COMAR schedules.
If your case is declared abandoned, you lose the pending application and the protections that came with it. If you genuinely need to move to another state, request authorization from COMAR before you go.
On the rights side, Mexico cannot return you to your home country while your application is pending. You are also entitled to apply through INM for a Visitor Card for Humanitarian Reasons (TVRH), which is free, valid for up to one year, and lets you stay in Mexico and work formally.6UNHCR Mexico. If You Need to Leave Mexico Temporarily
You can apply to INM for an exit and entry permit, valid for 60 calendar days, at the office where your immigration process started.8Instituto Nacional de Migración. If You Are Recognized as a Refugee
Once COMAR grants refugee status, you go to INM to process permanent residence in Mexico.1UNHCR Mexico. As a permanent resident you can work, travel within Mexico, and access public healthcare and education.

If You Are Denied
You have 15 business days from the date you are notified to ask COMAR to review the decision.1UNHCR Mexico. How to Apply for Refugee Status in Mexico That deadline is strict. If COMAR denies you again on review, you can still challenge the decision before a federal judge. Non-refoulement protection stays in place while an appeal or judicial challenge is active, so Mexico cannot deport you during that time.
