How to Respond to IRS Form 8519: Deadlines, Exemptions, and Appeals

IRS Form 8519 is your copy of a Notice of Levy, and by the time it reaches your mailbox the IRS has already ordered a third party — your bank, your employer, or someone who owes you money — to hand over your property to satisfy an unpaid tax debt.1Internal Revenue Service. IRM 5.11.2 Serving Levies, Releasing Levies and Returning Property The levy itself was served on that third party through Form 668-A. Your funds may already be frozen. The IRS acts under Internal Revenue Code Section 6331, which lets it seize property without a court order after a taxpayer ignores a notice and demand for payment.2Office of the Law Revision Counsel. 26 USC 6331 – Levy and Distraint You have a narrow window to respond, and how narrow depends on what was levied.

Check the Form Against Your Records First

Form 8519 mirrors the levy notice sent to the third party, which is the point: you are meant to verify it. Confirm your name, address, and taxpayer identification number. Then work through the table showing each tax period, the type of tax, the assessment date, and the total amount to be paid, which includes interest and penalties. Assessment errors and wrong tax periods happen. Catching one is the fastest route to a release.

The right side of the form identifies the issuing IRS office, a phone number, and the employee identification number of the revenue officer or automated system behind it. That contact is your starting point. If anything about the notice looks off, call the IRS directly at the number on the form or at 1-800-829-1040 to confirm the levy is real before doing anything else.

How Much Time You Actually Have

The clock depends on what was levied. A bank levy is a one-time grab of whatever balance sits in the account when the bank receives the notice, and federal law requires the bank to hold those funds for 21 calendar days before sending them to the IRS.3Office of the Law Revision Counsel. 26 USC 6332 – Surrender of Property Subject to Levy4eCFR. 26 CFR 301.6332-3 – The 21-Day Holding Period Applicable to Property Held by Banks Deposits made after the levy date are not touched by that particular levy, though the IRS can issue a new one.5Taxpayer Advocate Service. Levies Do nothing during those 21 days and the bank sends the frozen balance, plus any interest that accrued during the hold, to the IRS.

The 21-day rule applies only to banks. A wage levy is continuous and attaches to every paycheck until the debt is paid or the IRS formally releases it.6Internal Revenue Service. What if I Get a Levy Against One of My Employees, Vendors, Customers or Other Third Parties Levies on accounts receivable, commissions, or other property held by non-bank third parties generally require immediate compliance. If those funds were levied, they may already be gone by the time Form 8519 arrives.

What to Do Right Now

Call the IRS office listed on the form. That first conversation opens the door to every other option, whether you want to correct a mistake in the assessment, argue hardship, set up a payment plan, or claim exempt income the levy is ignoring.

Gather documentation before or during that call. Depending on your grounds, you may need pay stubs, bank statements, bills, a canceled check proving payment, an account transcript, or a completed Collection Information Statement (Form 433-A) if you plan to argue economic hardship.7Internal Revenue Service. What if a Levy Is Causing a Hardship

If the levy hit your wages and your employer is withholding too much, ask the IRS about adjusting the exempt amount and, if needed, submit the Statement of Exemptions and Filing Status form that came with your employer’s levy paperwork, which lets you claim dependents and the correct filing status.8Office of the Law Revision Counsel. 26 U.S. Code 6334 – Property Exempt From Levy

A release from the IRS is not the same as your money being returned. Once the IRS agrees to release, it issues Form 668-D to the third party that received the original levy. Until that form reaches the bank or employer, they remain obligated to hold or surrender your property.6Internal Revenue Service. When the IRS Must Release the Levy

Section 6343 requires the IRS to release a levy under specific circumstances. These are not discretionary:9Office of the Law Revision Counsel. 26 USC 6343 – Authority to Release Levy and Return Property

  • The debt has been paid or the 10-year collection statute has expired. Proof can be a canceled check, payment confirmation, or account transcript showing a zero balance.
  • You have entered into an installment agreement under Section 6159, unless the agreement itself says the levy continues.
  • The levy is creating economic hardship, meaning it prevents you from meeting basic living expenses like rent, utilities, food, and medical care. Expect to submit financial documentation.
  • Releasing the levy will help the IRS collect, for example by letting you keep working so you can pay.
  • The property is worth substantially more than the tax debt, in which case the release applies to the excess.

An installment agreement is often the fastest reliable route to a release. An Offer in Compromise, by contrast, does not automatically stop a levy already in place; the IRS has discretion to keep it running while it evaluates your offer, though it may release a levy served after receiving the OIC.10Internal Revenue Service. Property the IRS Cannot Touch

Section 6334 puts certain property off-limits even when a valid levy is in place:8Office of the Law Revision Counsel. 26 U.S. Code 6334 – Property Exempt From Levy

  • A portion of your wages, calculated by adding your standard deduction to a per-dependent allowance and dividing by the number of pay periods in a year. IRS Publication 1494 gives your employer the tables for this.
  • Workers’ compensation payments, in full.
  • Unemployment insurance benefits, state and federal.
  • Railroad Retirement benefits, Railroad Unemployment Insurance payments, and military Medal of Honor pensions.
  • Court-ordered child support amounts.
  • Undelivered mail.
  • Basic personal items — clothing, schoolbooks, fuel, furniture, and tools of your trade — up to specified dollar limits.

Social Security is a partial exception rather than a full one. Under the Federal Payment Levy Program, the IRS can automatically redirect up to 15 percent of your monthly Social Security benefit, regardless of what the remainder would be.11Internal Revenue Service. Social Security Benefits Eligible for the Federal Payment Levy Program Retirement accounts like 401(k)s and IRAs are legally subject to levy, but IRS policy is to avoid seizing them absent what the agency calls flagrant conduct by the taxpayer.

Your Appeal Rights

Before the IRS could levy, it was required to send a separate pre-levy notice at least 30 days earlier, informing you of your right to a hearing.12Office of the Law Revision Counsel. 26 USC 6330 – Notice and Opportunity for Hearing Before Levy Form 8519 is what you get when that earlier notice went unanswered.

You can still appeal. File Form 12153 to request a Collection Due Process (CDP) hearing before the IRS Independent Office of Appeals. Filed within 30 days of the pre-levy notice date, a CDP hearing suspends collection while it is pending and preserves your right to challenge the Appeals decision in U.S. Tax Court.13Internal Revenue Service. Request for a Collection Due Process or Equivalent Hearing At the hearing you can dispute the underlying liability (if you have not already had that opportunity), propose collection alternatives, or argue that the IRS did not follow proper procedures.

If the 30-day window has passed, you can request an Equivalent Hearing within one year of the levy notice date. You get the same internal review, but the IRS is not required to pause collection while it happens, and you cannot take the result to Tax Court.13Internal Revenue Service. Request for a Collection Due Process or Equivalent Hearing

The Collection Appeals Program (CAP) is a faster, less formal alternative. CAP does not suspend the collection statute and offers no judicial review, but it can resolve certain levy disputes more quickly.14Internal Revenue Service. IRM 5.1.9 Collection Appeal Rights

If the Account Is Joint

When the IRS levies a joint bank account, the entire balance is exposed, not just the share belonging to the taxpayer who owes. The IRS treats all funds in the account as available. A non-liable co-owner can seek a partial release by producing evidence — deposit records, pay stubs, bank statements — that specific funds are theirs alone, but that process rarely moves fast enough to beat the 21-day hold without immediate action. If you share an account with someone who has a tax debt, keeping your own money in a separate account is the cleanest protection.

If the Property Was Not Yours to Levy

If the IRS took property that belongs to you but was seized to pay someone else’s tax debt, you have a wrongful levy remedy under Section 7426 in federal district court.15Office of the Law Revision Counsel. 26 USC 7426 – Civil Actions by Persons Other Than Taxpayers This is not the route for disputing your own liability. The deadline is two years from the date of the levy, and it is the exclusive remedy — you cannot repackage the claim under a different theory to get around that deadline.16Office of the Law Revision Counsel. 26 USC 6532 – Periods of Limitation on Suits An administrative claim through the Collection Appeals Program can sometimes resolve a wrongful levy more quickly than court.14Internal Revenue Service.
