When to Start Chasing a Missing 1099

Don’t act immediately. Mail runs late, and many payers deliver electronically through a portal that expects you to log in and download the form yourself. Federal rules require the payer to keep an electronically delivered 1099 available online through at least October 15 of the filing year, so if you consented to electronic delivery in a prior year, check the account dashboard before assuming anything is missing.3Internal Revenue Service. Contacting the Payer
For contract or freelance income, your contact is whoever handles accounting or payroll at the business that paid you. For investment income, it’s your bank or brokerage. For government payments like unemployment compensation, it’s the issuing state agency.
Have your information ready before you reach out: full legal name, current mailing address, and Social Security Number or Individual Taxpayer Identification Number. The payer needs these to pull your account. If they ask you to complete a Form W-9, that’s routine. The W-9 collects your name, tax ID, and business type so the payer can report your income correctly, and filling it out accurately keeps them from applying 24% backup withholding to your future payments.5Internal Revenue Service. Email is the best first move because it creates a time-stamped record. Include your name, tax ID (or the last four digits if you’re worried about security), the tax year, and a clear request for the form. If the company has an accounts-payable or vendor-management department, address the message there. Vague requests get lost.
If email produces no result within two weeks, send a letter by certified mail with return receipt requested. The receipt proves the payer received the request, which matters if the IRS later asks whether you made a good-faith effort. Paper also tends to get more attention from unresponsive payers.
While you’re waiting, pull together your own records of what you were paid during the year: bank deposits, invoices, contracts, payment app histories. Those numbers let you check the 1099 for accuracy when it arrives, and they’re what you’ll file from if it doesn’t.
Escalating to the IRS

- Your name, address, phone number, and Social Security number
- The payer’s name, address, and phone number
- The dates you worked or received payments
The IRS will contact the payer directly and request the form. That carries more weight than your own follow-ups because the agency can impose penalties on payers who ignore their filing obligations. The process isn’t instant, though. It can take several weeks for the IRS to make contact and for the payer to respond.
Getting the Numbers From an IRS Transcript
Whether the payer ever sends you a copy or not, they almost certainly filed one with the IRS. You can get that data through a wage and income transcript, which lists every information return the IRS received under your Social Security number for a given tax year, including payer names, income amounts, and form types.7Internal Revenue Service. The fastest route is your IRS Individual Online Account at irs.gov. After signing in, look for the transcript option. Data for a given tax year typically becomes available in the first week of February of the following year, since payers file with the IRS around the same January 31 deadline.8Internal Revenue Service. If you can’t use the online system, mail Form 4506-T (Request for Transcript of Tax Return) to request the same information on paper.9Internal Revenue Service. The transcript isn’t a copy of the original 1099, but it contains the same income figures you need to file.
Filing Without the Form
Here’s where people get into trouble: you owe tax on the income whether or not you receive a 1099. The IRS is direct about it. File on time using your own records, even if the form is still missing.4Internal Revenue Service. Waiting for a form that may never come and missing the filing deadline costs more than estimating.
Form 4852 exists as a substitute, but only for a missing W-2 or 1099-R (retirement distributions). Attach it to your return with your best estimate of the income and any taxes withheld.10Internal Revenue Service. For those, report the income on Schedule C or the appropriate line of your return based on your own records; no substitute form is required.
If the missing 1099 eventually arrives and the numbers differ from what you reported, file Form 1040-X (Amended U.S. Individual Income Tax Return) to correct the difference.4Internal Revenue Service. What to Do When a W-2 or Form 1099 Is Missing or Incorrect
Leaving income off your return because you didn’t get a 1099 is one of the clearest ways to trigger an accuracy-related penalty. The IRS already has the payer’s copy, so its matching system will flag the gap. The penalty is 20% of the underpaid tax, plus interest until you pay in full.11Internal Revenue Service. When the 1099 Arrives With the Wrong Numbers
Sometimes the form comes, but the figures are off. Contact the payer and ask for a corrected version. Payers issue corrected 1099s routinely. Be specific: point to the box number, explain what the amount should be, and back it up with records. If the payer refuses or goes silent, use the same escalation path — call 800-829-1040 after the end of February and report the problem, and the IRS will contact the payer for a correction.4Internal Revenue Service. If you need to file before the correction arrives, report the income based on what you actually received, not what the wrong form says.
Some 1099s No Longer Exist to Request
Before you spend weeks chasing a form, check whether one was ever required. The One Big Beautiful Bill Act, signed into law on July 4, 2025, raised the 1099-NEC and 1099-MISC reporting threshold from $600 to $2,000, effective for payments made on or after January 1, 2026.1Office of the Law Revision Counsel. 26 U.S.C. 6041 – Information at Source If you earned less than $2,000 from a single payer for services in 2026, that payer no longer has to send you a 1099. You still owe tax on the income; the reporting obligation on the payer’s side is what changed. For 2025 work reported on forms that should have arrived in January 2026, the old $600 threshold still applies.
Other 1099 types are unaffected and follow their own thresholds. Banks and brokerages must issue a 1099-INT or 1099-DIV once interest or dividends reach $10.12Internal Revenue Service.
