How to Report Gifts on Your Tax Return: Form 709

To report gifts on Form 709, list each reportable gift on Schedule A with the date, a description, the recipient’s name and relationship to you, the fair market value, and your adjusted basis, then file the return by April 15 of the year after you made the gift. Only the donor files; recipients report nothing. Most people who file Form 709 owe no tax because the $15 million lifetime exemption for 2026 absorbs the excess over the $19,000 annual exclusion. The filing itself is a tracking exercise — the IRS uses it to keep a running total of how much of your lifetime exemption you’ve used.

Which Gifts You Actually Have to Report

You need to file Form 709 for a calendar year if any of these are true:

  • You gave more than $19,000 to any one person during 2026. The annual exclusion is per recipient, so $19,000 each to five people triggers no filing, but $20,000 to a single person does — even though no tax is due.1Internal Revenue Service. What’s New — Estate and Gift Tax
  • You and your spouse elected to split gifts. Both spouses must file, even if the combined gift falls under the exclusion.2Internal Revenue Service. 2025 Instructions for Form 709
  • You gave someone a future interest in property. Gifts the recipient can’t use or possess until later don’t qualify for the annual exclusion at all, regardless of value.3eCFR. 26 CFR 25.2503-3 – Future Interests in Property
  • You gave a non-citizen spouse more than the elevated threshold. The unlimited marital deduction doesn’t apply when your spouse isn’t a U.S. citizen. The 2025 threshold was $190,000; the 2026 figure adjusts for inflation.4Internal Revenue Service. Instructions for Form 709 (2025)

Gifts aren’t limited to cash. Selling property below fair market value, making an interest-free loan, or transferring stock all count to the extent the recipient gets more value than they paid.5Internal Revenue Service. Gift Tax

Transfers You Don’t Report

Several categories bypass Form 709 no matter how large:

  • Gifts of any amount to a U.S. citizen spouse — the unlimited marital deduction applies.6Office of the Law Revision Counsel. 26 USC 2523 – Gift to Spouse
  • Tuition paid directly to an educational institution. The word “directly” matters: pay the school, not the student.7Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts
  • Medical expenses paid directly to the provider on someone’s behalf.7Office of the Law Revision Counsel. 26 USC 2503 – Taxable Gifts
  • Gifts to political organizations.
  • Gifts to qualifying charities — deductible against gift tax; you’d list them on Form 709 only if you’re already filing for other reasons.8Internal Revenue Service. Frequently Asked Questions on Gift Taxes

The tuition and medical exclusions have no dollar cap. Paying $200,000 in tuition directly to a university for a grandchild requires no filing and uses no lifetime exemption. Give the grandchild the money and let them write the check, and it becomes a reportable gift.

What to Gather Before You Start

Pull the following together before opening the form:4Internal Revenue Service. Instructions for Form 709 (2025)

  • Your Social Security number or ITIN, full legal name, and address, plus the same for every recipient.
  • A description and fair market value for each gift, measured on the date of the transfer.
  • Your adjusted basis in any non-cash gift — generally what you paid, plus improvements, minus depreciation.
  • Appraisals for anything without an obvious market price: closely held business interests, undeveloped land, artwork, and similar property.
  • Your prior Form 709 filings. The IRS won’t remind you how much lifetime exemption you’ve already used; you’re expected to carry that total forward yourself.

Filling Out the Form

Form 709 has a main information page followed by schedules. The main page and Schedule A handle the vast majority of returns.

Part 1: General Information

The first section collects your personal details, filing status, and elections. If you’re splitting gifts with your spouse, check the appropriate box and have your spouse complete Part 3 (Spouse’s Consent). Part 1 also asks whether you’ve filed Form 709 in prior years and whether any transfer involves generation-skipping arrangements.4Internal Revenue Service. Instructions for Form 709 (2025)

Schedule A: Listing Your Gifts

Schedule A is where the reporting actually happens. For each reportable gift, enter the date of transfer, a description of the property, the donee’s name and relationship to you, the fair market value on the transfer date, and your adjusted basis. The schedule is divided into three parts based on how the gift interacts with the generation-skipping transfer tax:4Internal Revenue Service. Instructions for Form 709 (2025)

  • Part 1: gifts subject only to gift tax — typically transfers to children or other non-skip persons.
  • Part 2: gifts subject to both gift and generation-skipping transfer taxes, such as direct transfers to grandchildren.
  • Part 3: gifts subject only to gift tax now but potentially subject to GST tax later, such as gifts to certain trusts.

Attach supporting documents for anything that isn’t a straightforward cash transfer: appraisals, trust agreements, partnership documents, valuation methodology. The stronger your documentation up front, the less likely the IRS is to challenge values later.

Schedule D: Generation-Skipping Transfers

If any gift lands in Part 2 or Part 3 of Schedule A, complete Schedule D. It computes any GST tax owed and tracks how much of your GST exemption you’ve allocated. For 2026 the GST exemption is $15 million, matching the lifetime gift and estate tax exemption, and the GST tax rate is 40%.1Internal Revenue Service. What’s New — Estate and Gift Tax GST tax applies on top of any gift tax.

How Gift Splitting Changes the Return

Married couples can effectively double the annual exclusion by electing to split gifts. If one spouse gives $38,000 to a child in 2026, splitting lets the couple treat it as $19,000 from each spouse, keeping both halves under the annual exclusion.8Internal Revenue Service. Frequently Asked Questions on Gift Taxes Both spouses must file separate Form 709 returns. There is no joint Form 709. The consenting spouse signs a Notice of Consent on the other spouse’s return, and the IRS recommends mailing both returns together to avoid processing confusion.2Internal Revenue Service. 2025 Instructions for Form 709

Splitting requires that both spouses were married at the time of the gift, neither was a nonresident non-citizen, and neither gave the other a general power of appointment over the property. Divorce and remarriage during the same year disqualify the election for that year entirely.2Internal Revenue Service. 2025 Instructions for Form 709

Reporting Large 529 Contributions

Contributions to a 529 education savings plan count as gifts. A contribution over $19,000 to a single beneficiary’s 529 in 2026 normally has to be reported on Form 709.9Internal Revenue Service. 529 Plans: Questions and Answers

A special election on Form 709 lets you treat up to five years of annual exclusions as if they were contributed in one lump — $95,000 for a single donor, or $190,000 for a couple splitting gifts, in 2026. You make the election on the return for the contribution year and spread the gift ratably over five calendar years. If you die during the five-year window, the portion allocated to years after your death gets pulled back into your estate.

Deadline, Extensions, and Where to File

Form 709 is due April 15 of the year after the gift. If April 15 falls on a weekend or federal holiday, the deadline moves to the next business day.4Internal Revenue Service. Instructions for Form 709 (2025) Gifts made in 2026 are reported on a return due April 15, 2027.

Filing Form 4868 (the standard income tax extension) automatically extends the Form 709 deadline by six months. Form 8892 does the same specifically for gift tax. An extension buys time to file, not time to pay: interest and penalties on any tax owed run from the original April deadline.4Internal Revenue Service. Instructions for Form 709 (2025)

If You File Late or Not at All

The IRS applies the same penalty framework to late gift tax returns that it uses for income tax under Section 6651. The failure-to-file penalty is 5% of unpaid tax per month, capped at 25%, with a separate failure-to-pay penalty on top.11Internal Revenue Service. Failure to File Penalty Interest compounds daily on any unpaid balance at the federal short-term rate plus three percentage points — 7% for early 2026.12Internal Revenue Service. Quarterly Interest Rates

Most people filing Form 709 owe no actual tax because they haven’t touched their lifetime exemption, so the percentage penalty produces $0. Filing late is still not consequence-free. A return you never file can’t start the statute of limitations, and the Form 709 instructions warn of separate penalties for willful failure to file and for substantial or gross valuation understatements.2Internal Revenue Service. 2025 Instructions for Form 709

Once you file, the IRS generally has three years from the filing date (or due date, whichever is later) to assess additional tax or challenge the values you reported. After that, your reported values are locked in. The clock only starts if the gift is adequately disclosed, meaning the return gives the IRS enough detail to evaluate the nature of the gift and how you arrived at the value. Omit a gift or describe it too vaguely, and the statute never begins — the IRS can revisit that transfer decades later, typically when your estate is being settled.13Internal Revenue Service. 4.25.1 Estate and Gift Tax Examinations Thorough descriptions, full appraisals, and complete party information are what keep that clock running in your favor.
