How to Report a Death to the VA: Payments and Survivor Benefits

To report the death of a veteran to the VA, call the VA Benefits Hotline at 1-800-827-1000 as soon as you can. The representative can stop disability compensation and pension payments during that same call, which matters because any payment deposited after the date of death becomes a debt the VA will reclaim from the veteran’s bank account.1Veterans Affairs. How to Report the Death of a Veteran to VA Reporting also opens the door to survivor benefits, several of which have a one-year filing window that starts on the date of death.

Three Ways to Report

Phone is the fastest. The hotline runs Monday through Friday, 8:00 a.m. to 9:00 p.m. Eastern Time.2Veterans Affairs. Helpful VA Phone Numbers You do not need every document in front of you to make the call. Whatever you have is enough to start.

Reporting in person at a VA regional office lets staff review your paperwork on the spot. Bring copies rather than originals.

You can also mail documents to the Claims Intake Center:3Veterans Benefits Administration. Mailing Address for Disability Compensation Claims

Use certified mail so you have proof of delivery. Mail is the slowest option, and every week of delay is another potential overpayment that will need to be returned.1Veterans Affairs. How to Report the Death of a Veteran to VA

What to Have Ready

The VA asks for as much of the following as you can provide:1Veterans Affairs. How to Report the Death of a Veteran to VA

  • The veteran’s full name as it appears on their service records
  • Social Security number or VA claim number (the claim number appears on past benefit award letters)
  • Date of birth
  • Date of death
  • Branch of service

Missing items should not stop you from calling. Get the death on record first, then follow up with the rest.

For in-person or mail reporting, the VA also wants copies of the death certificate, the veteran’s DD214 or other discharge paperwork, and any VA benefit award letters. Order several certified copies of the death certificate from your county or state vital records office. You will need them for survivor benefit claims. Fees typically run between $15 and $25 per copy depending on the state.

What Happens to Payments

Once the death is recorded, the VA halts disability compensation and pension payments to the veteran’s account and performs a final accounting. If the veteran was alive for part of the month they died, a partial payment may still be owed.

Any full payment that hits the account after the date of death is treated as an overpayment. The VA contacts the bank and pulls the money back. This is where survivors get burned: if the funds were in a joint account and a surviving spouse has already used them to cover funeral costs or bills, the bank still returns the full amount to the VA, and the spouse is left to sort out the shortfall. Reporting the same day or within a few days prevents the problem.

After payments stop, the VA sends a formal letter confirming termination and outlining the survivor benefits that may be available. Keep that letter with any confirmation numbers you received when you first reported.

If You Receive a Debt Letter

When the VA has already deposited money it needs back, it sends a Notice of Indebtedness explaining the amount owed and your rights.4Department of Veterans Affairs. Chapter 02 – Benefit Debts Debts from disability compensation and pension overpayments do not accrue interest, penalties, or administrative costs.

You can dispute the amount or request a waiver if repayment would cause hardship. Requesting a waiver within 90 days of the first debt letter pauses collection while the VA reviews the request.5Veterans Affairs. Waivers for VA Benefit Debt The outside deadline is one year from the date of that letter. Past a year, the VA is required by law to deny the request.

To request a waiver, submit a Financial Status Report (VA Form 5655) with a written statement explaining why repayment would be unfair or create hardship. An executor of the estate, a VA-accredited attorney, or a Veterans Service Organization representative can file on the family’s behalf.5Veterans Affairs. Survivor Benefits to File Within One Year

The VA does not automatically convert the veteran’s benefits into survivor benefits. You have to apply, and the one-year window matters. VA Form 21P-534EZ covers Dependency and Indemnity Compensation (DIC), Survivors Pension, and accrued benefits in a single application.6Veterans Benefits Administration. VA Form 21P-534EZ

DIC is a monthly payment for surviving spouses, children, and in some cases parents when the veteran died from a service-connected condition or held a total disability rating for a qualifying period before death. To qualify as a surviving spouse, you generally need to have been married to the veteran for at least one year or had a child together, and you must not have been at fault for any separation.7Veterans Affairs. About VA DIC for Spouses, Dependents, and Parents Remarriage does not automatically disqualify you if you remarried at age 55 or older after January 5, 2021, or at 57 or older after December 16, 2003.

Survivors Pension is a needs-based benefit for survivors of wartime veterans whose deaths were not service-connected. Both income and net worth are considered; the net worth limit is $163,699 for the 2026 benefit period.8Veterans Affairs. Current Survivors Pension Benefit Rates

Accrued benefits are payments the VA owed the veteran but had not yet paid before death. They pass in a fixed order: spouse first, then children in equal shares, then dependent parents.9Office of the Law Revision Counsel. 38 USC 5121 – Payment of Certain Accrued Benefits Upon Death of a Beneficiary If none of those survive, the VA can reimburse whoever paid the veteran’s final medical and burial expenses.

Filing within one year of the veteran’s death sets the effective date to the first day of the month in which the veteran died, meaning you receive back pay for the months between the death and claim approval.10Office of the Law Revision Counsel. 38 USC Part IV, Chapter 51, Subchapter II – Effective Dates Miss the window and the effective date becomes whenever the VA receives your application. For accrued benefits the one-year deadline is absolute: file late and the claim is forfeited.9Office of the Law Revision Counsel. 38 USC 5121 – Payment of Certain Accrued Benefits Upon Death of a Beneficiary

Burial benefits are handled on a separate form, VA Form 21P-530EZ, which can double as part of the death notification.11Veterans Affairs. About VA Form 21P-530EZ File it as soon as you have receipts or estimates for burial expenses.

Separate Offices to Notify

Calling the benefits hotline does not notify every part of the VA. Two other programs need their own report.

A Veterans Service Organization representative can handle any of these filings at no cost. Most VSO offices at VA regional locations will review your situation and take the paperwork off your plate.
