How to Renew Your EAD: Filing Timing, Fees, and Expedites

To renew an Employment Authorization Document, file Form I-765 with U.S. Citizenship and Immigration Services up to 180 days before your current card expires, pay the fee for your eligibility category, and wait for the new card to be approved and mailed. Since October 30, 2025, that timing carries real weight: USCIS no longer automatically extends work authorization while a renewal is pending, so any gap between your expiring card and the new one is a gap in your legal right to work.1U.S. Citizenship and Immigration Services. When to File

USCIS recommends filing your renewal up to 180 days before the expiration date printed on your current EAD.2U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization Six months of runway is not overkill. Processing times move, requests for evidence add weeks, and without an automatic extension backstop the only cushion you have is the one you build by filing early.

A few categories follow a different clock. F-1 students requesting Optional Practical Training can file up to 90 days before completing a full academic year, and STEM OPT extension applicants can file up to 90 days before their current OPT expires.2U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization The Form I-765 instructions spell out any category-specific window; if yours does not have one, treat the 180-day mark as the day the application goes out.

What to Include With Form I-765

Form I-765, Application for Employment Authorization, is available on the USCIS website for online or paper filing.2U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization You will need to identify your eligibility category using the classifications in 8 CFR 274a.12, which sorts applicants by immigration status and type of authorization.3eCFR. 8 CFR 274a.12 – Classes of Aliens Authorized to Accept Employment The code appears on the face of your current card. Enter it exactly; the wrong category can delay or derail the application.

Your package should include:

  • Your Alien Registration Number (A-Number), taken from your current EAD or prior immigration documents.
  • Your most recent I-94 arrival/departure record, retrievable online from Customs and Border Protection.
  • A clear copy of the front and back of your current EAD.
  • A government-issued photo ID such as a passport.
  • Two identical passport-style photographs meeting USCIS specifications.

Form I-765 also lets you request a Social Security Number or a replacement card in the same filing. If you complete that section, USCIS forwards your information to the Social Security Administration after approval and the card typically arrives within 14 days of the EAD.4Social Security Administration. Filing Fees and Fee Waivers

USCIS adjusted its fees effective January 1, 2026. Renewal fees vary by category:

  • Asylum applicant EAD renewal: $275
  • Parole-based EAD renewal: $280
  • TPS EAD renewal: $280
  • Initial asylum or parole EAD: $560
  • Initial TPS EAD: $560

If you cannot afford the fee, file Form I-912, Request for Fee Waiver. USCIS grants waivers on three grounds: current receipt of a means-tested public benefit, household income at or below 150 percent of the Federal Poverty Guidelines, or documented financial hardship even at a higher income.7U.S. Citizenship and Immigration Services. How to Submit and Track

You can file online through a USCIS account or mail a paper application to the designated USCIS Lockbox.2U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization Online filing lets you upload documents and pay electronically. For paper filings, check the USCIS website for the correct Lockbox address; it varies by eligibility category and by where you live, and the wrong address means avoidable delay.

Once USCIS accepts the filing, you receive Form I-797C, Notice of Action, with the receipt number you will use to track the case. Online filers see confirmation immediately; paper filers usually wait several weeks. USCIS may also schedule a biometrics appointment at a local Application Support Center, though the agency has reduced biometrics requirements for many categories. Missing that appointment or ignoring a request for evidence can result in denial, so watch your mail and your USCIS online account.

No More Automatic Extension

This is the change that matters most for anyone renewing in 2026. An interim final rule effective October 30, 2025 ended the practice of automatically extending work authorization for renewal applicants. If you file on or after that date, your current card expires on the date printed on its face and no extension attaches while the renewal is pending.1U.S. Citizenship and Immigration Services. DHS Ends Automatic Extension of Employment Authorization The regulation now states that for renewal applications filed on or after October 30, 2025, the validity of an expiring EAD “will not be automatically extended by a request for renewal.”8eCFR. 8 CFR 274a.13 – Application for Employment Authorization

A few narrow exceptions still run on their own legal authority: Temporary Protected Status holders whose EADs are extended by a Federal Register notice, F-1 students on STEM OPT extensions, and F-1 workers covered by the cap-gap provision while transitioning to H-1B.9U.S. Citizenship and Immigration Services. Interim Final Rule Published Ending the Practice of Automatically Extending Certain EADs Everyone else faces a real gap if USCIS has not approved the renewal by the expiration date.

If You Filed Before October 30, 2025

Renewals filed before that date still fall under the earlier rule. A final rule published in December 2024 permanently set the automatic extension at up to 540 days from the card’s expiration date, replacing the older 180-day standard.10E-Verify. Final Rule Permanently Increases Automatic Extension of Employment Authorization and/or EADs for Certain Individuals That extension lasts until USCIS decides your renewal or the 540 days end, whichever comes first.11U.S. Citizenship and Immigration Services. 5.1 Automatic Extensions Based on a Timely Filed Application to Renew Employment Authorization To qualify, the renewal had to be filed before the current EAD expired, filed before October 30, 2025, and based on the same eligibility category as the original card.9U.S. Citizenship and Immigration Services. Options if You Need It Faster

Premium processing on Form I-907 is available for only a limited set of EAD filings: F-1 students applying for Optional Practical Training and F-1 students seeking a STEM OPT extension.12U.S. Citizenship and Immigration Services. Request for Premium Processing Service The premium processing fee for Form I-765 is $1,780 as of March 1, 2026.13Federal Register. Adjustment to Premium Processing Fees For other categories, this option is not available.

USCIS also considers expedite requests case by case. Grounds include severe financial loss to a person or company, emergencies involving illness or disability, government interests or national security, and clear USCIS errors. Simply needing work authorization is generally not enough on its own. If you have documented financial hardship tied to the delay, submit evidence of it with the request.14U.S. Citizenship and Immigration Services. Expedite Requests

Keep Your Address Current

A renewed card mailed to an old address creates real problems, especially without an extension cushion. Federal law requires you to report any change of address to USCIS within 10 days of moving. Updating your address with the U.S. Postal Service does not update it with USCIS, and USPS does not forward USCIS mail, including your EAD. Change your address directly with USCIS through the online tool or by filing paper Form AR-11.15U.S. Citizenship and Immigration Services. How to Change Your Address

If you use the online tool, enter the receipt numbers for every pending application so the update reaches each file. If tracking shows your card as delivered but you never received it, wait at least 90 days after your approval notice and then file a non-delivery inquiry through the USCIS e-Request portal. You will need your receipt number, A-Number, and filing date.

What Happens if the Card Expires First

If your EAD expires and you do not have a valid automatic extension or a new card in hand, your work authorization ends on that date. There is no informal grace period. Federal law prohibits employers from continuing to employ someone they know has lost authorization, and that prohibition covers every kind of work, including remote, part-time, and freelance.16Office of the Law Revision Counsel. 8 USC 1324a – Unlawful Employment of Aliens

For the worker, unauthorized employment can jeopardize future immigration applications and lead to removal proceedings. If USCIS denies the renewal, any automatic extension terminates and employment authorization ends immediately. You cannot resume working until you receive an approved new EAD and present it for a fresh Form I-9 verification.17U.S. Citizenship and Immigration Services.
