A two-year green card cannot actually be renewed. To keep your status after the two years are up, you file Form I-751, Petition to Remove Conditions on Residence, with U.S. Citizenship and Immigration Services during the 90 days before your card expires. If USCIS approves the petition, you receive a standard 10-year permanent resident card.1U.S. Citizenship and Immigration Services. Conditional Permanent Residence Missing this step doesn’t just leave you without a card. It terminates your permanent resident status entirely and makes you removable from the country.2Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters
When to File
For a standard joint filing with your spouse, submit Form I-751 during the 90-day window immediately before your conditional card expires.3U.S. Citizenship and Immigration Services. Petition to Remove Conditions on Residence If your card expires on October 15, the window opens on July 17. File before that window opens and USCIS will reject the petition.
Different timing applies if you are filing alone under a waiver of the joint filing requirement (divorce, abuse, death of your spouse, or extreme hardship). Waiver-based petitions can be filed at any time: before the 90-day window, during it, or after the card has expired.4U.S. Citizenship and Immigration Services. Set a calendar reminder well before your window opens. This deadline drives everything else.
How to File and What It Costs
USCIS accepts Form I-751 online through a USCIS account or by mail to a designated lockbox.3U.S. Citizenship and Immigration Services. Petition to Remove Conditions on Residence Filing online is generally faster: you get the receipt notice sooner and can track the case in real time.
A filing fee applies. Check the current amount on the USCIS fee schedule, since fees change. USCIS no longer accepts personal checks, money orders, or cashier’s checks for paper filings unless you qualify for a specific exemption.5U.S. Citizenship and Immigration Services. G-1450, Authorization for Credit Card Transactions Mail filers can pay by credit, debit, or prepaid card using Form G-1450, or directly from a U.S. bank account using Form G-1650. Online filers pay through their USCIS account.
Evidence That Your Marriage Is Real
The heart of the petition is documentation showing you and your spouse built a genuine shared life across the two-year conditional period. USCIS wants to see that two people actually combined their finances, their home, and their daily existence. A handful of photos will not carry the case.
- Joint bank account statements, shared credit cards, joint tax returns filed as married
- Lease or mortgage documents listing both names, utility bills at the same address
- Health, auto, or life insurance policies naming each other as beneficiaries or dependents
- Birth certificates of any children born to the marriage
- Sworn affidavits from friends and family who know you as a couple
- Photographs spanning different points in your life together
Organize the evidence chronologically. Gaps in documentation raise questions, so aim for materials spread across the full two years rather than clustered around the wedding or the filing date.
After You File
Once USCIS accepts the petition, you receive a receipt notice (Form I-797C). That notice does more than confirm receipt. It automatically extends your conditional resident status for 48 months beyond the expiration date printed on your green card.6U.S. Citizenship and Immigration Services. Form I-751 and I-829 48 Month Extension During the extension, you keep working and traveling by carrying your expired green card together with the receipt notice.
USCIS will schedule a biometrics appointment for fingerprints and a photograph. Missing it without rescheduling can cause USCIS to treat the petition as abandoned and terminate your status.7U.S. Citizenship and Immigration Services. Traveling While the Petition Is Pending
You can travel internationally. Carry your expired green card and receipt notice together when re-entering the United States.8U.S. Citizenship and Immigration Services. Reporting an Address Change
If you move while the petition is pending, report the new address to USCIS within 10 days.9U.S. Citizenship and Immigration Services. AR-11, Aliens Change of Address Card The online change-of-address tool updates both the legal notification requirement and your pending case at once. Miss this and you could miss interview notices, requests for evidence, or the approval itself.
Processing Times and Possible Outcomes
Processing is slow. As of early 2026, USCIS takes roughly 27 to 30 months to decide most I-751 petitions, and some take longer. The timeline depends on the service center, whether USCIS requests more evidence, and whether the case is selected for an interview.
Not everyone is interviewed. USCIS can waive the interview when the petition is well-documented and no red flags appear. A thorough, consistent evidence package makes a waiver more likely. If USCIS does schedule an interview, both spouses are expected to attend and answer questions about the relationship.
Three outcomes are possible:
- Approval: a 10-year permanent resident card arrives in the mail.
- Request for Evidence: USCIS wants more documents. Respond by the deadline on the notice. Failing to respond leads to denial.
- Denial: USCIS terminates your conditional status as of the decision date and issues a Notice to Appear, placing you in removal proceedings.7U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 Part I Chapter 6 – Decision and Post-Adjudication
If You Miss the Filing Deadline
Fail to file at all and your permanent resident status automatically terminates on the second anniversary of when you received conditional status.2Office of the Law Revision Counsel. 8 USC 1186a – Conditional Permanent Resident Status for Certain Alien Spouses and Sons and Daughters You become removable, and in any later removal proceeding, the burden falls on you to prove you actually complied with the filing rules.
USCIS may still accept a late filing if the delay was outside your control. Include a written explanation showing that extraordinary circumstances caused the delay and that its length was reasonable.10U.S. Citizenship and Immigration Services. Instructions for Petition to Remove Conditions on Residence “I forgot” or “I didn’t know” is unlikely to qualify. Serious illness, a natural disaster, or bad advice from a former attorney might.
Filing Without Your Spouse
The standard I-751 requires both spouses to sign jointly. When the marriage has ended or become unsafe, you can file alone by requesting a waiver of the joint filing requirement.4U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 6 Part I Chapter 5 – Waiver of Joint Filing Requirement Four categories exist under federal regulation:11eCFR. 8 CFR 1216.5 – Waiver of Requirement to File Joint Petition to Remove Conditions by Alien Spouse
- Death of the petitioning spouse during the conditional period, where you entered the marriage in good faith.
- Divorce or annulment, where the marriage was genuine when you entered it. USCIS requires a final divorce decree before approving the waiver; a pending divorce or legal separation is not enough. You can file while the divorce is still in progress, and USCIS will typically issue a Request for Evidence for the final decree.
- Abuse or extreme cruelty by your U.S. citizen or permanent resident spouse against you or your child during the marriage.
- Extreme hardship, where your removal would cause severe hardship beyond what any person would normally experience from deportation.
Each category requires evidence specific to the situation. A divorce-based waiver needs the decree plus proof the marriage was initially real. An abuse-based waiver may include police reports, protective orders, medical records, or counseling records. Waiver cases carry a heavier evidentiary burden and higher stakes, and an immigration attorney is particularly valuable here.
If the 48-Month Extension Runs Out
The 48-month extension covers most pending cases. If USCIS still hasn’t decided the petition when those months run out, you need an ADIT stamp: a temporary notation placed in your passport that proves your lawful permanent resident status. It works as a List A document for employment verification and lets you re-enter the country after international travel.
Two paths exist. USCIS recommends starting with the phone. Call the USCIS Contact Center at 800-375-5283 and explain that your receipt notice extension has expired while the case remains pending. If USCIS can verify your identity and locate your photo in their system, they will mail you a Form I-94 carrying the ADIT stamp. If the phone route doesn’t work, schedule an in-person appointment at your local USCIS field office through my.uscis.gov. Bring your valid passport, expired green card, receipt notice, and appointment confirmation.
A Note for EB-5 Investors
If your conditional green card came through the EB-5 immigrant investor program rather than marriage, none of the I-751 process applies to you.
