How to Move on Section 8: Portability Rules, Steps, and Appeals

The Section 8 portability process lets you take your Housing Choice Voucher to almost anywhere in the country that runs a tenant-based voucher program. You tell your current public housing agency (the “initial PHA”) where you want to move, they send your file to the housing agency covering that area (the “receiving PHA”), and the receiving PHA issues you a new voucher and takes over your case.1U.S. Department of Housing and Urban Development (HUD). Housing Choice Vouchers Portability From there, you search for a unit, submit it for approval, wait for inspection, and sign a lease under the receiving PHA’s rules. Plan on several weeks to a couple of months from the day you give notice to the day you sign a new lease.

Behind the scenes, the receiving PHA either absorbs your voucher into its own program or bills your initial PHA for the assistance payments. Can You Port Right Now

Portability is a right built into the voucher program, but a few conditions decide whether you can use it today.

You have to be in good standing. A PHA can block your move if you owe money to any housing agency, have violated your lease, or have broken program rules such as failing to report income or letting unauthorized people live in the unit.3Department of Housing and Urban Development (HUD). The 12-Month Residency Rule

If you were pulled from a waiting list outside your initial PHA’s jurisdiction, you generally must live in that PHA’s area for 12 months before porting out. Your initial PHA can waive the wait, and some do for reasons like a confirmed job offer elsewhere. If you already lived in the PHA’s jurisdiction when you were admitted, the 12-month restriction does not apply to you.1U.S. Department of Housing and Urban Development (HUD). Survivors of Domestic Violence

Under the Violence Against Women Act, if you or a household member is a victim of domestic violence, dating violence, sexual assault, or stalking, you can move to protect your safety even when the move would otherwise break your lease or fall inside the 12-month waiting period. The PHA cannot terminate your assistance for moving without notice when the move is needed to escape imminent harm.4eCFR. 24 CFR 982.354 – Move with Continued Tenant-Based Assistance

One Catch for New Applicants

If you have not yet leased up and are still an applicant, the initial PHA has to check whether your income fits within the receiving PHA’s income limits before approving the port. If you earn too much for the new area, the move can be denied even though you qualified where you started. The Move, Step by Step

Give Notice to Your PHA

Tell your initial PHA in writing that you want to move and where. Federal rules don’t set a specific number of days for this notice, so timing depends on your PHA’s policy. Ask early. You also have to give your current landlord written notice of lease termination according to your lease, and provide a copy of that notice to the PHA at the same time.2eCFR. 24 CFR 982.355 – Portability: Administration by Initial and Receiving PHA

Your File Goes to the Receiving PHA

Once your initial PHA confirms you can port, it sends a package to the receiving PHA. It includes the Family Portability Information form (HUD-52665), your most recent Family Report (HUD-50058), a copy of your signed voucher, and the income and eligibility documents that support your case.5U.S. Department of Housing and Urban Development. Family Portability Information – HUD-52665 Regulations say the initial PHA has to send this “promptly,” but no specific number of days is set. If weeks pass with no movement, call your caseworker.

Contact the Receiving PHA

Reach out to the receiving PHA as soon as your paperwork is on its way. Many receiving PHAs require an orientation briefing that covers local policies, search procedures, and lease-up rules. The briefing is allowed as long as it doesn’t unreasonably delay your housing search, and the PHA has to grant reasonable accommodations for people with disabilities.3Department of Housing and Urban Development (HUD). Find a Unit and Submit It

With the new voucher in hand, look for a rental that accepts Housing Choice Vouchers. When you find one, the landlord fills out the Request for Tenancy Approval (HUD-52517), which gives the receiving PHA what it needs to evaluate the unit and the lease terms.6U.S Department of Housing and Urban Development. Inspection, Rent Check, and Lease

Before you can move in, two things must clear. The receiving PHA has to determine the rent is reasonable compared to similar unassisted units in the area, and the unit has to pass a physical inspection against federal health and safety standards. If it fails, the landlord usually gets a window to fix problems and request a reinspection.7Department of Housing and Urban Development (HUD). Don’t Let Your Voucher Expire

Your initial voucher has to give you at least 60 calendar days to find a unit.9eCFR. 24 CFR 982.303 – Term of Voucher When you port, the voucher the receiving PHA issues can’t expire any sooner than 30 calendar days after your initial voucher’s expiration date. If your initial voucher has already run out by the time you reach the receiving PHA, the receiving PHA must contact the initial PHA to see whether an extension will be granted.2eCFR. 24 CFR 982.355 – Portability: Administration by Initial and Receiving PHA

Extensions beyond the minimum are up to the receiving PHA and its administrative plan. If a disability makes searching harder, the PHA has to extend the term as a reasonable accommodation for as long as reasonably needed.9eCFR. 24 CFR 982.303 – Term of Voucher Start searching the day you arrive.

Your Rent and Voucher Size May Change

Moving to a new jurisdiction almost always changes the rent math. The receiving PHA uses its own payment standards. If they are higher than your old ones, your subsidy generally goes up and your out-of-pocket share may fall. The receiving PHA also sets your voucher bedroom size using its own subsidy standards. A family with a three-bedroom voucher in one place might get a two-bedroom in another, or the other way around.3Department of Housing and Urban Development (HUD). Housing Choice Voucher Program Guidebook – Moves and Portability Before you commit to the move, ask your initial PHA to walk you through how the receiving PHA’s standards would change your subsidy. They are required to explain the differences.

Money the Voucher Doesn’t Cover

The voucher pays part of your monthly rent. It doesn’t cover the upfront costs of moving. HUD guidance lists security deposits, moving expenses, and living costs during the transition as expenses families need to plan for on their own.3Department of Housing and Urban Development (HUD). Security deposits are typically one to two months’ rent, though state limits vary. Landlords cannot charge voucher holders a higher deposit than they charge unassisted tenants. Rental application fees generally run $30 to $75, and you may apply to several places before finding one that accepts vouchers. If your new lease starts before your old one ends, you could owe rent in both places during the overlap. Some PHAs allow a brief overlap of assistance payments during the moving month, but anything past that comes out of your pocket.

Grounds for Denial and Your Right to Appeal

Either the initial or receiving PHA can deny or end your assistance for specific reasons set out in federal regulations:

  • You owe rent or other amounts to any PHA, or you failed to reimburse a PHA for payments it made to a landlord on your behalf.
  • You broke family obligations under the program, such as not reporting income changes or allowing unauthorized occupants.
  • You committed fraud in connection with any federal housing program, or engaged in certain criminal activity.
  • You were evicted from an assisted unit for serious lease violations, which requires the PHA to terminate assistance.
  • The initial PHA lacks funding to cover the increased subsidy in a higher-cost area, but only when the receiving PHA would be billing rather than absorbing your voucher.

If either PHA denies or ends your assistance during the port, you have a right to challenge it. Current participants get an informal hearing; applicants get an informal review. The PHA issuing the denial has to give you the chance to request one.3Department of Housing and Urban Development (HUD). Read any denial letter carefully and respond fast. Miss the deadline and you generally waive your appeal rights.
