How to Join a Tesla Class Action Lawsuit: Eligibility and Active Cases

Joining a Tesla class action depends on which lawsuit fits your situation. Only one Tesla case is currently certified as a class action, and none has reached the stage where members file claim forms for payment. If you bought Tesla’s Full Self-Driving package in California, own a recalled Powerwall 2, held Tesla stock during a specific window, or drove a Model 3 or Model Y in Australia, there is likely a case you can be part of. For most other complaints against Tesla, you are looking at individual arbitration or an individual lawsuit rather than a class.

Here is how to figure out which case applies to you and what to do next.

Match Your Situation to the Right Case

Before anything else, identify which lawsuit covers what happened to you. The eligibility rules are narrow and specific to each case.

  • You paid for the Full Self-Driving package on a Tesla purchased or leased in California between October 20, 2016, and July 31, 2024: the certified FSD class action may cover you.
  • You bought a new Model 3, Model S, Model Y, or Model X in California and believe the advertised range was inflated: a proposed range class action is pending.1Milberg. Tesla EV Range Lawsuit
  • You bought a new or used Tesla in California and think the odometer overcounts miles: a proposed odometer class action is pending.2ClassAction.org. Tesla Lawsuit Alleges Automaker Manipulates Odometer Readings to Avoid Warranty Obligations
  • You own a Powerwall 2 affected by the November 2025 recall: a proposed nationwide class action is pending in Florida.3AboutLawsuits.com. Tesla Powerwall Recall Class Action Lawsuit
  • You bought Tesla stock between April 19, 2023, and June 22, 2025, and lost money: a proposed securities fraud class action is pending in Texas.4Carrier Management. Tesla Securities Fraud Class Action
  • You acquired a Model 3 or Model Y in Australia between May 2021 and February 2025: an Australian class action is open for registration.5TeslaAction.com. Tesla Action

If none of those apply, there is currently no U.S. class action open to you against Tesla. Racial harassment claims by Fremont workers, WARN Act layoff claims, right-to-repair antitrust claims, and Autopilot crash injury claims are either being pursued individually or have already been dismissed or settled.

The Full Self-Driving Class Action: The Only One That’s Certified

The main Tesla class action is In re Tesla Advanced Driver Assistance Systems Litigation, Case No. 3:22-cv-05240, in the U.S. District Court for the Northern District of California before Judge Rita F. Lin. The suit alleges Tesla and Elon Musk marketed vehicles as having the hardware and software for full autonomy when the technology could not deliver, and brings claims for fraud, negligent misrepresentation, false advertising, violations of California’s Consumer Legal Remedies Act, breach of warranty, and unjust enrichment.6CPM Legal. On August 18, 2025, Judge Lin certified the case as a class action.7FindLaw. In Re Tesla Advanced Driver Assistance Systems Litigation That means if you fit the class definition, you are already a member. You do not sign up.

Who Is Automatically in the Class

The court defined two damages classes and one injunctive class:

  • The California Pre-Arbitration Class: buyers or lessees who paid separately for the FSD package between October 20, 2016, and May 19, 2017, and who reside in or bought the vehicle in California. Tesla’s arbitration program did not exist yet, so arbitration status does not matter for this group.7FindLaw. In Re Tesla Advanced Driver Assistance Systems Litigation
  • The California Arbitration Opt-Out Class: buyers or lessees who paid separately for FSD between May 19, 2017, and July 31, 2024, who reside in or bought the vehicle in California, and who opted out of Tesla’s arbitration agreement.7FindLaw. In Re Tesla Advanced Driver Assistance Systems Litigation
  • The Injunctive Relief Class: a narrower subset of members who would like to buy or subscribe to FSD in the future but cannot trust the current advertising.8CaseyGerry. Tesla Full Self-Driving Lawsuit Class Certification

Buyers of the Enhanced Autopilot package are excluded. The court found that the FSD-specific marketing claims at the heart of the case were not material to Enhanced Autopilot purchases.9U.S. News & World Report. Tesla Drivers Can Pursue Class Action Over Self-Driving Claims, Judge Rules

The Arbitration Question

If you bought FSD after May 2017, whether you opted out of arbitration is the deciding factor. Tesla’s purchase agreement requires disputes to go through binding arbitration unless the buyer opted out within 30 days of signing by mailing a letter to Tesla at P.O. Box 15430, Fremont, CA 94539-7970, stating the buyer’s name, the VIN, and the intent to opt out.10Lemoncarlawyer.com. Tesla Arbitration Clause the Opt Out and the California Lemon Law

If you did not send that letter, you are not part of the certified class. Some firms have pursued individual arbitration claims for owners in that position on similar theories, so a claim is still possible, just not through the class.11Labaton Keller Sucharow. What to Do If You Qualify

There is no claim form. The case has not been tried or settled, so there is no payout yet. If you fit the class definition, you are in unless you affirmatively opt out of the class itself, which is a separate step from the arbitration opt-out. To confirm your status or ask questions, class counsel at Cotchett, Pitre & McCarthy can be reached at (650) 697-6000, or through attorneys Julie Fieber (jfieber@cpmlegal.com) and Thomas Loeser (tloeser@cpmlegal.com).13CPM Legal. Tesla filed a petition with the Ninth Circuit in September 2025 seeking to appeal the certification before trial. As of the most recent case management filings, the appellate court had not ruled on the petition. Plaintiffs have proposed a January 2027 final pretrial conference; Tesla has proposed October 2026. Both sides estimate 10 to 15 court days for trial.14PlainSite. Matsko v Tesla Inc

Other Active Class Actions You May Be Able to Join

These cases are earlier along than the FSD suit. None has been certified yet, meaning the court has not decided whether the case can proceed as a class. Anyone in the proposed class definition would automatically be covered if certification is granted, without needing to sign up. What you can do now is contact the plaintiffs’ firms to be added to their intake lists.

Range Inflation

A class action filed in August 2023 in the Northern District of California alleges Tesla uses proprietary algorithms to inflate the range shown to buyers, suppresses range complaints through a dedicated “diversion team,” and fails to disclose that hitting the advertised range requires charging to 100%, which Tesla itself advises against as routine practice.1Milberg. Tesla EV Range Lawsuit The proposed class is California buyers of new Model 3, Model S, Model Y, or Model X vehicles. Owners who did not opt out of arbitration may need to bring an individual arbitration claim instead.11Labaton Keller Sucharow. Tesla

Odometer

A proposed class action filed by California plaintiff Nyree Hinton in early 2025 alleges Tesla odometers use predictive algorithms and energy consumption data rather than direct measurement, producing inflated readings. Hinton claims his Model Y logged mileage 15% to 117% higher than his previous vehicles under comparable conditions, which he says prematurely voided his warranty.15Road & Track. Tesla Odometers Are Inaccurate Lawsuit Claims The proposed class is all California residents who purchased a new or used Tesla for personal use. Tesla has denied the allegations, and the case is in early stages.16Business Insider. Tesla Lawsuit Odometer Fraud Inaccurate Mileage Warranty Void

Powerwall 2 Recall

After the U.S. Consumer Product Safety Commission recalled roughly 10,500 Powerwall 2 units in November 2025 for overheating risks, Brown v. Tesla, Inc. was filed on November 26, 2025, in the Middle District of Florida. The suit alleges Tesla remotely discharged recalled units to near-zero through software updates rather than replacing or refunding them, leaving owners without backup power.17Electrek. Shareholder Securities Fraud

Morand v. Tesla Inc. et al. in the U.S. District Court for the Western District of Texas alleges Tesla and its executives concealed internal testing data showing autonomous driving and Robotaxi capabilities were overstated, inflating the stock price.4Carrier Management. Tesla Securities Fraud Class Action The proposed class is shareholders who bought Tesla stock between April 19, 2023, and June 22, 2025. Co-lead plaintiffs Jacob Soto and Amiri Gandhi were appointed in December 2025, with Levi & Korsinsky and Pomerantz LLP as co-lead counsel. Australia: Model 3 and Model Y

In the Federal Court of Australia, law firm JGA Saddler, funded by litigation funder Woodsford, has brought a class action on behalf of roughly 10,000 Tesla owners against Tesla Motors Australia and Tesla, Inc.20Drive.com.au. Tesla Australia Owner Class Action Against Phantom Braking Autopilot Claims Builds Steam The case covers owners or lessees of Model 3 and Model Y vehicles acquired between May 2021 and February 2025, and alleges phantom braking, failure to meet advertised range, and misleading Autopilot representations.21Woodsford. Cases That Won’t Take New Members

A few widely reported Tesla cases are closed to new participation. The Delaware director-pay shareholder settlement approved in January 2025 has already resolved. Chin v. Tesla, the WARN Act layoff class action, was dismissed with prejudice in April 2025 after the named plaintiff settled, though other affected employees can still bring their own claims on the same facts.22Bloomberg Law. Tesla Settles Claims Over Failure to Warn Workers About Layoff Lambrix v. Tesla, the right-to-repair antitrust class action, was dismissed with prejudice in June 2025.23Law360. The Fremont racial harassment class action brought by former worker Marcus Vaughn was decertified in November 2025 when an Alameda County judge ruled that plaintiffs’ counsel could not secure enough randomly sampled class members. Those lawyers pivoted to individual lawsuits and reported filing more than 500, with plans for over 900.24KQED. What Joining Actually Looks Like Right Now

No Tesla class action is currently in the settlement or payout phase. That changes what “joining” means at this stage:

  • For the certified FSD case, membership is automatic if you fit the class definition. Nothing to file. Watch for a court-approved notice down the line if the case settles or goes to verdict.
  • For the proposed U.S. cases (range, odometer, Powerwall, shareholder), you do not sign up either. If the court certifies the class, anyone in the definition is included. Contacting the plaintiffs’ firms puts you on their list and lets them contact you if a claim process opens.
  • For the Australian case, registration through teslaaction.com is the intended path.
  • For anything else (workplace harassment, Autopilot injuries, arbitration-bound FSD or range complaints), the route is an individual claim with your own lawyer, not a class action.

The closest case to a resolution is the FSD suit, with a pretrial conference expected somewhere between October 2026 and January 2027 if Tesla’s pending Ninth Circuit appeal does not push the schedule back.14PlainSite. Matsko v Tesla Inc
