How to Get Rid of Student Loan Debt Without Paying?

There are six real ways to get rid of student loan debt without paying the full balance: Public Service Loan Forgiveness, income-driven repayment forgiveness, total and permanent disability discharge, borrower defense to repayment, closed school discharge, and bankruptcy. Each one has strict eligibility rules, and all but bankruptcy are limited to federal loans. Which path fits you depends on your job, your income, your health, what your school did, and what happened to it.

Forgiveness Through Public Service Work

Public Service Loan Forgiveness wipes out your remaining Direct Loan balance after 120 qualifying monthly payments — roughly ten years — while you work full-time for a government employer at any level or for a tax-exempt nonprofit.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program Full-time AmeriCorps and Peace Corps service also counts.

Only Direct Loans qualify: Direct Subsidized, Direct Unsubsidized, Direct PLUS, and Direct Consolidation.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program Older FFEL Program loans and Perkins Loans have to be consolidated into a Direct Consolidation Loan first.2Federal Student Aid. What to Know About Federal Family Education Loan Program Loans Consolidation resets your qualifying payment count to zero, so only Direct Loan payments count toward the 120.

Those 120 payments have to be made on a qualifying plan. Income-driven repayment plans qualify, as does the 10-year Standard Repayment Plan, though the Standard Plan usually leaves nothing to forgive at the end unless you had qualifying deferment or forbearance along the way.3Federal Student Aid. What Repayment Plans Qualify for Public Service Loan Forgiveness An income-driven plan gives most borrowers lower monthly payments and a meaningful balance to forgive.

Apply using the PSLF Help Tool on StudentAid.gov. The tool sends the form to your employers for digital signature and submits it electronically.4Federal Student Aid. Public Service Loan Forgiveness Form Submit it once a year and whenever you change jobs so the Department of Education can keep your payment count current. PSLF forgiveness is permanently excluded from federal taxable income.5Office of the Law Revision Counsel. 26 U.S. Code 108 – Income From Discharge of Indebtedness

Forgiveness After 20 or 25 Years on an Income-Driven Plan

If you don’t work in public service, an income-driven repayment plan is the main long-term route. Your monthly payment is tied to your income and family size, and any remaining balance is forgiven after 20 or 25 years of qualifying payments.6Consumer Financial Protection Bureau. Student Loan Forgiveness

The timeline depends on the plan:

  • Pay As You Earn (PAYE): 20 years for all eligible loans.
  • Income-Based Repayment (IBR): 20 years if you first borrowed on or after July 1, 2014; 25 years otherwise.
  • Income-Contingent Repayment (ICR): 25 years.

The SAVE Plan previously offered the shortest timelines, but the Department of Education announced in December 2025 that a proposed settlement would end it.7U.S. Department of Education. U.S. Department of Education Announces Agreement With Missouri to End SAVE Plan FFEL and Perkins Loans have to be consolidated into a Direct Loan before you can enroll in most income-driven plans.

There is a serious catch starting in 2026. The American Rescue Plan Act temporarily shielded all student loan forgiveness from federal income tax through December 31, 2025, and that provision expired without being renewed.5Office of the Law Revision Counsel. 26 U.S. Code 108 – Income From Discharge of Indebtedness If your income-driven balance is forgiven in 2026 or later, the canceled amount will generally be added to your taxable income for that year. For a borrower with a large remaining balance, that can mean a tax bill in the thousands or tens of thousands of dollars.

Discharge If You Can No Longer Work

A severe disability that keeps you from working can qualify you for a total and permanent disability (TPD) discharge of your federal loans. You need documentation from one of three sources: the Department of Veterans Affairs, the Social Security Administration, or a licensed medical professional such as a physician, nurse practitioner, physician assistant, or certified psychologist.8eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge

What that documentation looks like depends on your situation:

Apply through StudentAid.gov, or by fax or upload.9Federal Student Aid. Total and Permanent Disability Discharge In some cases the Department of Education grants the discharge automatically after receiving qualifying data directly from the VA or SSA.10eCFR. 34 CFR 685.213 – Total and Permanent Disability Discharge

If your discharge is based on SSA documentation or a medical professional’s certification, you enter a three-year post-discharge monitoring period. Taking out a new federal student loan or TEACH Grant during that window reverses the discharge and reinstates your original debt.9Federal Student Aid. Total and Permanent Disability Discharge Veterans discharged on VA documentation have no monitoring period.

Discharge If Your School Lied to You

If your school misled you into borrowing — about job placement rates, credit transferability, program quality, or anything similar — a borrower defense claim can discharge the loans tied to that enrollment.11eCFR. 34 CFR 685.206 – Borrower Responsibilities and Defenses You have to show the school made a false or deceptive statement about something material to your decision to enroll, and that you were financially harmed as a result.

The legal standard depends on when your loans were first disbursed. For loans disbursed before July 1, 2017, state law applies. For loans disbursed between July 1, 2020, and July 1, 2023, federal regulations require proof by a preponderance of the evidence.11eCFR. 34 CFR 685.206 – Borrower Responsibilities and Defenses Promotional materials, enrollment agreements, emails, and records of your job search all help.

You file the claim with the Department of Education, which notifies the school and gives it at least 60 days to respond.11eCFR. 34 CFR 685.206 – Borrower Responsibilities and Defenses Your loans go into forbearance while the claim is pending. An approved claim discharges the remaining balance on the loans tied to that school and may refund some or all of what you already paid.12Federal Student Aid. Borrower Defense Loan Discharge Review can take months or years, especially when a single school generated many claims.

Discharge If Your School Closed

Federal loans for a program at a school that closed while you were enrolled — or that closed within 180 days after you withdrew — can be fully discharged.13eCFR. 34 CFR 685.214 – Closed School Discharge The Department may extend that 180-day window in exceptional circumstances. You don’t qualify if you finished the program through a teach-out at another school or by transferring your credits to a comparable program.

Often you don’t have to apply at all. The Department will automatically discharge the loans one year after the closure date if its records show you were enrolled and didn’t complete the program elsewhere.14eCFR. 34 CFR 685.214 – Closed School Discharge If you don’t want to wait, you can submit an application yourself. A successful closed school discharge eliminates the full balance, refunds payments you already made on those loans, and removes the debt from your credit record.

Bankruptcy as a Last Resort

Student loans aren’t automatically wiped out in bankruptcy. You have to prove that repaying them would impose an “undue hardship” on you and your dependents.15Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge The bar is deliberately high but not impossible.

Most federal courts use the Brunner test, which requires you to show you can’t maintain a minimal standard of living while repaying, that your situation is likely to persist for much of the repayment period, and that you made a good-faith effort to pay. Courts in the First and Eighth Circuits apply a broader totality-of-the-circumstances test that weighs your past, present, and foreseeable finances against your necessary living expenses.

In November 2022, the Department of Justice introduced an attestation-based process. A borrower who files an adversary proceeding can submit a sworn statement about their finances, which DOJ attorneys use to decide whether to consent to discharge rather than litigate. It applies in both Brunner and totality jurisdictions.

You start by filing an adversary proceeding, which is a separate lawsuit within your bankruptcy case, and serving the complaint on your loan servicer and the Department of Education. A judge reviews the evidence at a hearing, and a finding of undue hardship produces a court order eliminating the debt. Individual Chapter 7 and Chapter 13 debtors are generally exempt from the $350 adversary proceeding filing fee.16United States Courts. Bankruptcy Court Miscellaneous Fee Schedule Attorney fees vary widely, from a few thousand dollars to well over $10,000.

The Tax Bill That Can Follow Forgiveness

Which program you use decides whether forgiveness is taxable, and the answer changed on January 1, 2026.

PSLF forgiveness is permanently excluded from federal taxable income under a provision in the tax code that covers loan cancellation tied to qualifying public service work.5Office of the Law Revision Counsel. 26 U.S. Code 108 – Income From Discharge of Indebtedness There is no expiration date.

Income-driven repayment forgiveness is now taxable at the federal level. The American Rescue Plan Act had shielded it through December 31, 2025, but that temporary exclusion is gone. If your balance is forgiven in 2026 or later, the IRS will treat the canceled amount as income in the year it is forgiven. A handful of states may tax it as well, though most states with an income tax follow the federal exclusion or have their own exemption.

For TPD discharge based on SSA or medical professional certification, you are treated for federal tax purposes as receiving the discharge at the end of the three-year monitoring period, not when the discharge is first approved.9Federal Student Aid. Total and Permanent Disability Discharge Whether it’s taxable depends on the law in effect at the end of that period.

Private Student Loans Don’t Qualify

PSLF, income-driven forgiveness, TPD discharge, borrower defense, and closed school discharge all apply only to federal student loans. Private student loans from banks, credit unions, or other private lenders are not eligible, because federal regulations limit eligibility to specific federal loan types.1eCFR. 34 CFR 685.219 – Public Service Loan Forgiveness Program

Bankruptcy is the exception. The undue hardship standard applies to both government-backed educational loans and private “qualified education loans,” using the same Brunner or totality analysis.15Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge If you have both federal and private student debt and are considering bankruptcy, one adversary proceeding can address all of it.
