How to Get Rid of Sallie Mae Loans: Discharge, Bankruptcy, and Settlement

There are four realistic ways to get rid of Sallie Mae loans: a disability or death discharge, a negotiated lump-sum settlement for less than you owe, a bankruptcy discharge based on undue hardship, or waiting out your state’s statute of limitations so the lender loses the right to sue. Each path has different requirements, costs, and credit consequences. One more factor now sits on top of all of them: starting in 2026, a forgiven or settled balance may count as taxable income, because the temporary federal exclusion for canceled student debt expired at the end of 2025.

Why Sallie Mae Loans Are Harder To Shed Than Federal Loans

Sallie Mae today originates only private student loans. Private loans do not come with income-driven repayment, Public Service Loan Forgiveness, or the standardized deferment and forbearance rules that apply to federal loans.1Consumer Financial Protection Bureau. What Is Student Loan Deferment? Your rights are whatever your promissory note says they are. Any hardship accommodation Sallie Mae offers is discretionary and varies by contract. That is why the options for eliminating a Sallie Mae balance are narrower, and why most of them depend on your financial condition rather than on a program you can simply enroll in.

If you took out loans through Sallie Mae years ago that were federally guaranteed, those loans have since been transferred to other servicers, most often Navient or a Department of Education servicer. If that is your situation, you are dealing with federal loan rules, not the private loan options described below.

Disability or Death Discharge

Sallie Mae may waive the remaining balance on a private student loan if the borrower dies or becomes permanently and totally disabled and unable to work in any capacity.2Sallie Mae. Life Changes – How to Continue Managing Your Student Loans This is a contractual decision by the lender, not a statutory right. The language Sallie Mae uses is that the balance “may be eligible” to be waived, so approval is not guaranteed and anything you get should be documented in writing.

To request a disability discharge, contact Sallie Mae at 800-472-5543 or through their online chat. You will need medical documentation from a physician confirming that your condition prevents you from working and is expected to be long-term or permanent. If you are a veteran with a VA determination of 100% service-connected disability or individual unemployability, include that too. It strengthens the request even though Sallie Mae is not required to accept a VA determination the way federal servicers are.

A death discharge usually requires a certified copy of the death certificate. If a cosigner is on the loan, confirm in writing whether a disability or death discharge releases the cosigner as well. That depends on your loan agreement.2Sallie Mae. Life Changes – How to Continue Managing Your Student Loans

Negotiating a Settlement for Less Than You Owe

If you cannot pay in full, you may be able to settle the account for a lump sum. Settlements are most realistic when the account is already in default or seriously delinquent, because a lender with little hope of collecting the full balance has more reason to accept a discounted payoff. Settlements on private student loans often land somewhere between 40% and 70% of the outstanding balance. Results vary with the age of the debt, your repayment history, and your leverage.

Before you make an offer, put together a financial picture that shows a lump sum is the best the lender can realistically recover. Pull your last two years of federal tax returns showing limited income. Gather at least three months of recent bank statements showing limited liquid assets. Collect proof of hardship: Social Security award letters, documentation of medical expenses, unemployment records, or anything else showing long-term difficulty.

Then submit a formal written proposal stating a specific dollar amount and explaining where the money will come from, whether that is a gift from family, a retirement withdrawal, or savings. A concrete number paired with a credible funding source moves the process along faster than an open-ended request for help.

Expect several rounds of back-and-forth with Sallie Mae’s collections or recovery department over a few weeks. Keep notes of every call, including the representative’s name and title. When you reach an agreement, insist on a settlement letter on the lender’s letterhead before sending any money. The letter should state:

  • The exact dollar settlement amount.
  • That the payment resolves the obligation in its entirety.
  • How the account will be reported to the credit bureaus.
  • The payment deadline, typically within 30 days.
  • Whether any cosigner is released along with the primary borrower.

Payment is usually required by wire transfer or cashier’s check. Keep the letter, the cleared payment confirmation, and all correspondence. A settled account generally reports as “settled for less than the full amount” rather than “paid in full.” That still hurts your credit compared to full repayment, but it is far less damaging than ongoing default.

Discharging Sallie Mae Loans in Bankruptcy

Student loans, including private loans from Sallie Mae, are not automatically wiped out in bankruptcy. Under federal law, student loan debt is excepted from a standard bankruptcy discharge unless repaying it would impose an “undue hardship” on you and your dependents.3Office of the Law Revision Counsel. 11 USC 523 – Exceptions to Discharge That rule applies to private qualified education loans as well as federal ones.

Courts evaluate undue hardship using one of two tests. In most federal circuits, the Brunner test applies. You must show that you cannot maintain a minimal standard of living while repaying the loans, that your financial situation is likely to persist for a significant portion of the repayment period, and that you have made good-faith efforts to repay. In the Eighth Circuit and some others, courts use a totality-of-circumstances test, looking at your whole financial picture without requiring you to meet each Brunner element independently.

Getting the discharge requires a separate lawsuit inside your bankruptcy case called an adversary proceeding. You file a Complaint to Determine Dischargeability. Both sides exchange evidence through discovery, which may include years of financial records and sworn testimony about your employment, health, and future prospects. Many cases go to court-ordered mediation, where the result can be a partial discharge or modified repayment rather than all-or-nothing. If mediation fails, a bankruptcy judge decides at trial.

The process typically runs six months to a year. Some courts have approved attorney fees in the range of $2,500 to $3,500 for these proceedings, though complex cases cost more. A successful outcome is a court order permanently barring the lender from collecting the discharged balance, and a bankruptcy discharge does not create taxable income.

Statute of Limitations on Private Student Loans

Private student loans are subject to state statutes of limitations that restrict how long the lender can sue you. Depending on your state and how the loan is classified, usually as a written contract, this window runs roughly 3 to 20 years, with most states around 6. Federal student loans have no such limit; private loans do.

Once the statute runs, Sallie Mae loses the legal right to file suit. The debt does not vanish. It can still appear on your credit report, and the lender can still contact you. But if they sue, you have a complete defense. Two cautions matter:

  • In many states, making a payment or acknowledging the debt in writing restarts the clock from zero.
  • Your promissory note may contain a choice-of-law provision specifying which state’s statute governs, and that may not be where you now live.

If you think your loan may be time-barred, talk to an attorney before contacting the lender or a collector. A single misstep can revive a lawsuit you would otherwise have been protected from.

Tax Consequences Starting in 2026

Any Sallie Mae balance that is discharged, forgiven, or settled for less than you owe may be treated as taxable income beginning in 2026. The American Rescue Plan Act excluded student loan cancellations from gross income, but only for discharges between January 1, 2021, and December 31, 2025.4Internal Revenue Service. Topic No. 431, Canceled Debt – Is It Taxable or Not? With that provision expired, the general rule returns: canceled debt is ordinary income.

When Sallie Mae settles your loan for less than the full balance, they will typically issue a Form 1099-C reporting the forgiven amount to you and the IRS.4Internal Revenue Service. Topic No. 431, Canceled Debt – Is It Taxable or Not? If you owed $50,000 and settled for $25,000, the remaining $25,000 could land on your return as income for the year of the settlement.

Two exclusions can reduce or wipe out that tax hit. First, the insolvency exclusion: if your total liabilities exceeded the fair market value of your assets immediately before the discharge, you can exclude the canceled amount up to the extent of your insolvency, using IRS Form 982. Many borrowers negotiating settlements are insolvent and qualify without realizing it. Second, debt discharged in a Title 11 bankruptcy case is excluded from gross income entirely, so a successful bankruptcy discharge does not trigger a tax bill.5Internal Revenue Service. Instructions for Form 982

Because the tax consequences of a large settlement can run into thousands of dollars, run the numbers before you accept any offer. A short consultation with a tax professional is usually worth the cost.

If You Have a Cosigner

Many Sallie Mae private loans involve a cosigner, often a parent or relative, who shares full legal responsibility for the balance. If you default, pursue a settlement, or fall behind, the cosigner is equally liable for everything owed. Any plan to eliminate your Sallie Mae debt has to account for that.

Sallie Mae does offer a cosigner release program, but the requirements are strict. The primary borrower must make 12 consecutive on-time principal and interest payments, provide proof of graduation, show sufficient income, pass a credit review, and have had no hardship forbearance on the loan in the prior 12 months. The borrower also cannot have been 30 or more days past due in the last 12 months and must show no recent bankruptcy, foreclosure, or default on any student loan.6Sallie Mae. If you are negotiating a settlement, confirm in the written settlement letter that the cosigner is released as well. Otherwise the lender can still chase the cosigner for the remaining balance after you have paid.

Filing a CFPB Complaint if Sallie Mae Will Not Engage

If Sallie Mae refuses to engage on a discharge, settlement, or other resolution, file a complaint with the Consumer Financial Protection Bureau. The CFPB is the primary federal agency overseeing private student loan lenders. Companies are expected to respond within 15 days and close complaints within 60.7Consumer Financial Protection Bureau. CFPB Now Taking Private Student Loan Complaints You get a tracking number and can monitor status online, and you can dispute an unsatisfactory response through the portal.

A CFPB complaint is not a lawsuit and does not force the lender to do anything specific. But formal federal oversight often produces a more responsive reply, particularly when a disability discharge request has stalled or settlement offers have been ignored.
