You have several legal ways to get out of a OneMain Financial loan, and none of them cost you an early-exit fee: OneMain does not charge a prepayment penalty, so you are free to pay the balance off, refinance it with another lender, settle it for less than you owe, enroll it in a debt management plan, or discharge it in bankruptcy.1OneMain Financial. What Is a 10-Day Payoff, and How Does It Work Which option fits depends on whether you can still afford the payments, whether your loan is secured by a vehicle or other property, and how badly your credit can absorb a hit.
OneMain’s fixed APRs run from 18% to 35.99%, so the cost of staying in the loan is real, and the cost of leaving it the wrong way can be too.2OneMain Financial. Personal Loans – Apply Online Work through the options in order of least damage to your credit.
Pay It Off Early or Refinance
If you can afford to retire the loan — through savings, a windfall, or a new loan at a better rate — do it. Ask OneMain for a 10-day payoff statement, which gives you the exact amount needed to close the account on a specific date, including interest accrued since your last payment.1OneMain Financial. What Is a 10-Day Payoff, and How Does It Work You can request one by phone or through your online account.
Refinancing replaces your OneMain loan with a new loan from a different lender, ideally at a lower rate. Even a modest reduction off a 30%-plus APR can save you hundreds or thousands over the remaining term. This works best if your credit has improved since you originally borrowed, or if you now qualify with a lender whose pricing beats OneMain’s. Most refinancing lenders send the payoff funds directly to OneMain so the old balance clears immediately, and you then make payments only on the new loan.
Negotiate a Settlement
If you are already behind and cannot realistically catch up, you can try to settle for less than the full balance. Lenders accept reduced lump sums when the alternative is writing the debt off or chasing it through collections. Successful settlements typically land somewhere between 50% and 70% of what is owed, depending on how delinquent the account is and your overall financial picture.
Before you call, gather proof of hardship: medical bills, a layoff notice, bank statements showing a drop in income. OneMain tells borrowers in trouble to reach out by phone at (800) 961-5577 or through a local branch to discuss options.3OneMain Financial. Having Difficulties Making Payments Make a specific offer and explain why that figure is the most the lender can realistically collect.
Do not send money until you have a written settlement agreement in hand. It should state the dollar amount, confirm the payment satisfies the debt in full, and spell out how the account will be reported to the credit bureaus.
Credit Hit
A settled account is reported as “settled for less than the full balance.” Under federal reporting rules, that notation can stay on your credit report for up to seven years from the date of the first missed payment that led to the settlement. The score damage fades over time, especially if you pay other accounts on time afterward.
The Tax Bill That Can Follow
When a lender forgives $600 or more of your debt, the forgiven amount is generally taxable income. OneMain is required to send you IRS Form 1099-C reporting the canceled amount, and you are expected to include it on that year’s return.4Internal Revenue Service. About Form 1099-C, Cancellation of Debt Owe $12,000 and settle for $7,000, and the $5,000 difference may show up as income on next year’s return.
Two exceptions can reduce or wipe out that liability. The insolvency exclusion applies if your total liabilities exceeded the fair market value of your assets immediately before the cancellation; you can exclude the forgiven debt up to the amount by which you were insolvent, by filing IRS Form 982 with your return. Debt canceled in a Title 11 bankruptcy case is automatically excluded from taxable income, and the bankruptcy exclusion takes priority over insolvency when both would apply.5Internal Revenue Service. Try a Debt Management Plan First
If you are struggling but want to avoid the credit damage of a settlement or bankruptcy, consider a debt management plan through a nonprofit credit counseling agency. The agency negotiates with your creditors, including OneMain, to lower your interest rate and waive certain fees. You send one monthly payment to the agency and it pays each creditor.
Unlike a settlement, a debt management plan pays back the full principal, so it does not trigger a 1099-C and does not leave a “settled” mark on your credit report. The tradeoff is that plans typically run three to five years, and you may need to close other credit accounts while enrolled. Look for an agency affiliated with the National Foundation for Credit Counseling, which offers free or low-cost initial consultations.
If Your Loan Is Secured
OneMain writes both unsecured and secured personal loans. A secured loan is backed by a lien on collateral, usually a vehicle such as a car, truck, or motorcycle, though OneMain also accepts boats, RVs, and trailers.6OneMain Financial. Our Lending Process Falling behind puts that property at risk of repossession, which changes which exit makes sense.
In most states, a lender can repossess the collateral as soon as you default, often without advance notice, as long as the repossession does not involve threats, force, or breaking into a locked space. After a sale, if the proceeds do not cover what you owe, the lender can sue you for the deficiency in most states.7Consumer Advice – FTC. Vehicle Repossession You may have the right to reinstate the loan by catching up on missed payments plus repossession costs, or to buy the vehicle back before sale by paying the full balance plus costs.8Consumer Financial Protection Bureau. What Happens if My Car Is Repossessed If your loan is secured, acting before a repossession gives you far more leverage than acting after.
Discharge the Loan in Bankruptcy
Bankruptcy is the most powerful option for eliminating a personal loan, and the one with the longest-lasting consequences. An unsecured OneMain loan can be wiped out through a successful discharge. A secured loan can also be addressed in bankruptcy, though you may need to surrender the collateral or keep paying to keep it.
Chapter 7 liquidates certain non-exempt assets to pay creditors and then discharges most remaining unsecured debt, typically three to four months from filing. To qualify, your income has to fall below your state’s median or pass a means test that measures disposable income over a five-year period.9United States Department of Justice. Means Testing If your income is too high, the case may be dismissed or converted to Chapter 13.
Chapter 13 does not liquidate assets. You enter a court-supervised repayment plan lasting three to five years, make monthly payments based on your disposable income, and any qualifying unsecured debt remaining at the end of the plan is discharged.
Filing the petition triggers an automatic stay under federal law, which immediately stops most collection activity, including phone calls, lawsuits, and wage garnishments.10Office of the Law Revision Counsel. 11 U.S. Code 362 – Automatic Stay Federal law also requires you to complete a credit counseling course within 180 days before filing and a debtor education course before discharge.11U.S. Courts. Credit Counseling and Debtor Education Courses Court filing fees are $338 for Chapter 7 and $313 for Chapter 13, with fee waivers or installment plans available for filers who cannot afford to pay up front. Once the court issues a discharge order, OneMain can no longer pursue the covered balance as a personal liability.
Extra Rights for Active-Duty Servicemembers
If you were on active duty when you took out the loan, the Military Lending Act gives you protections most borrowers do not have. The law caps the Military Annual Percentage Rate on most consumer loans, including personal installment loans, at 36%, and the MAPR calculation includes interest, finance charges, credit insurance premiums, and fees like application or participation costs. A covered lender also cannot require mandatory arbitration, charge a prepayment penalty, or require a military allotment as a condition of the loan.12Consumer Financial Protection Bureau. What Are My Rights Under the Military Lending Act If a lender violates the MLA, the loan agreement can be declared void from the start, and the lender may face civil liability and criminal penalties for knowing violations.13Office of the Comptroller of the Currency. Military Lending Act, Comptrollers Handbook If you believe your loan broke those rules, contact a military legal assistance office or file a complaint with the Consumer Financial Protection Bureau.
The Three-Day Cancel Right Rarely Applies
There is a federal right of rescission under the Truth in Lending Act, but it is narrow: it applies only to loans secured by your principal residence, not to unsecured personal loans and not to loans secured by a vehicle. First-mortgage purchase loans are also excluded. If your OneMain loan did place a lien on your home, you have until midnight of the third business day after signing to cancel by sending written notice to the lender; once received, the agreement is voided, the security interest is released, and the lender must return fees you paid, though you must return the loan proceeds.14Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions Send it by certified mail with return receipt so you have proof. Outside that three-day window, or outside a home-secured loan, this route is closed and the other options above are what remain.
