How to Get Brazilian Citizenship by Marriage: Documents and Filing

Marriage to a Brazilian citizen shortens the standard four-year naturalization residency to a single year, which makes Brazilian citizenship by marriage one of the fastest routes to a Brazilian passport. You still have to live in Brazil for that year, show you can communicate in Portuguese, produce a clean criminal record, and go through a Federal Police interview, but the application itself carries no government fee and runs through a single online platform.

Who Qualifies

Three conditions have to be met at the same time. You must be married to a Brazilian citizen, with the marriage still intact when the decision on your naturalization is made. You must have lived in Brazil for at least one year of continuous residence, measured from the date your permanent residency permit was issued rather than the day you arrived. And you must be able to demonstrate good conduct, meaning no criminal record in Brazil or in your country of origin unless you have been formally rehabilitated.

A registered stable union (união estável) counts the same as a formal marriage. If you and your Brazilian partner have registered the relationship at a cartório, you use the same one-year track.1UNHCR Brazil. Naturalization

Time outside Brazil during that year doesn’t automatically break your residency, but absences totaling more than 12 months during the required residency period will.2Ministério das Relações Exteriores. Brazilian Citizenship through Naturalization On a one-year clock, that ceiling is largely theoretical: a long absence in the middle of your qualifying year will invite questions about whether you actually reside in Brazil. Keep your national migration registry card (CRNM) valid throughout, and renew it with the Federal Police if it expires while your application is pending.

Register Your Marriage in Brazil First

If you married outside Brazil, your foreign marriage certificate isn’t usable for naturalization until it has been brought into the Brazilian civil registry. Two routes work.

You can register the marriage through a Brazilian consulate in the country where it took place. The consulate issues a Brazilian marriage certificate, which then has to be transcribed at the 1st Office of Civil Registry (1º Ofício de Registro Civil) in your Brazilian domicile, or at the equivalent office in the Federal District if you don’t yet have a fixed address in Brazil.3Ministério das Relações Exteriores. Alternatively, skip the consulate. Get the foreign certificate apostilled in the country where it was issued, have it translated by a sworn translator in Brazil, and register it directly at a Brazilian notary office. Either way, what you submit with the naturalization application is the resulting Brazilian marriage certificate, freshly issued.

Documents You’ll Need

The application file comes together around these items:

  • The naturalization application form, completed on the Naturalizar-se platform.
  • A valid identity document: your passport or your CRNM.
  • Proof of at least one year of residency in Brazil, such as utility bills, a rental agreement, or work records.
  • A recently issued Brazilian marriage certificate. Older certificates are typically rejected as outdated.
  • Birth certificates for both you and your Brazilian spouse.
  • Criminal record certificates from the Brazilian federal and state courts covering every place you have lived in Brazil over the past four years, plus a criminal record certificate from your country of origin.

Every foreign document has to be apostilled, or legalized if the issuing country is not part of the Hague Apostille Convention, and translated into Portuguese by a sworn translator registered in Brazil.1UNHCR Brazil. The Portuguese Requirement

You have to show you can communicate in Portuguese, but the standard is deliberately calibrated to the applicant. The rule asks for proficiency “commensurate with your possibilities as a naturalizing candidate,” which means the assessment takes your background into account rather than demanding fluency.2Ministério das Relações Exteriores. In practice, the Federal Police evaluate your Portuguese during the in-person interview. They want to see functional communication: understanding questions and responding coherently. Some applicants strengthen the file with a CELPE-Bras certificate (the official Brazilian Portuguese proficiency exam, offered twice a year with registration windows generally in late February and mid-August) or proof of schooling completed in Portuguese, but neither is required.

Filing Through Naturalizar-se

All naturalization requests go through the federal Naturalizar-se platform, which you access with a gov.br account at Bronze, Silver, or Gold level.4Governo Federal. Solicitar Naturalização Brasileira Select the “ordinary” naturalization category, fill out the form, and upload your documents.

Once the documentation clears the online review, you’re scheduled for an in-person appointment at your local Federal Police office. Bring the originals. The Federal Police verify your documents, collect biometrics, and conduct the Portuguese assessment during that visit. Your file then goes to the Department of Migration at the Ministry of Justice, which issues the final decision. Approvals are published in the Official Gazette (Diário Oficial da União).

How Long It Takes and What Comes After

The official processing estimate is up to 180 calendar days, though applicants commonly report 12 to 15 months in practice.4Governo Federal. Respond quickly; delays on your side extend the total timeline.

If your application is approved, you attend an oath ceremony, receive your naturalization certificate, and can then apply for a Brazilian passport, register to vote, and obtain a Brazilian identity card (RG). If it’s denied, the notice will explain why (most denials come down to incomplete documents or issues with a criminal record check), and you have 10 days from receiving it to appeal.4Governo Federal. If the Marriage Ends Before Approval

The marriage has to be intact when the decision is made. A divorce or legal separation before approval removes the basis for the one-year track, and you would fall back on the standard four-year residency rule. The death of a Brazilian spouse mid-process creates a similar problem, with treatment that can depend on how far along the application is. If the marriage is in trouble while your naturalization is pending, speak with a Brazilian immigration attorney before taking any formal step toward separation.

What Changes Once You’re Naturalized

Naturalized citizens have almost all the rights of native-born Brazilians: voting, public healthcare and education, social benefits, and a Brazilian passport. The Constitution reserves a specific set of positions for native-born citizens only:

  • President and Vice President of the Republic
  • President of the Chamber of Deputies
  • President of the Federal Senate
  • Minister of the Supreme Federal Tribunal
  • Minister of Defense
  • Officers of the Armed Forces
  • Positions in the diplomatic career

Outside those roles, the Constitution prohibits any legal distinction between naturalized and native-born Brazilians.5Constitute Project. Brazil 1988 (rev. 2017) Constitution

Voting is compulsory for citizens between 18 and 70 and optional between 16 and 18 and over 70.6Georgetown University – Political Database of the Americas. Brazil Code Title II The consequences of skipping an election without justification reach beyond a fine: two months after an unjustified absence you can be blocked from obtaining or renewing a passport, holding a public position, receiving government salaries, or accessing certain government-backed loans, and those restrictions last until you pay the fine and regularize your status. Male naturalized citizens between 18 and 45 are also subject to military service obligations. Brazil allows dual nationality when your other citizenship comes from birth or ancestry. If you acquired another nationality through voluntary naturalization abroad, Brazil could in principle open a formal administrative process through the Ministry of Justice to revoke your Brazilian citizenship, though this is not automatic.8Ministério das Relações Exteriores.
