How to Get an SSN Denial Letter: Documents and Steps for ITIN

To get an SSN denial letter, walk into your local Social Security Administration office with your passport and immigration documents and ask for one. The formal name is Form SSA-L676, and the SSA can usually print it while you wait at no charge.1Social Security Administration. What Does It Cost to Get a Social Security Card It’s the document that proves to a state DMV, the IRS, or another agency that you aren’t eligible for a Social Security number.

Why You Might Need One

The denial letter is official proof from the SSA that you can’t get an SSN. Agencies that normally require a Social Security number will often accept it in place of one. A few common uses:

  • Applying for a state driver’s license or ID card. Many states won’t let you sit for the written test without either an SSN or a letter confirming you can’t get one.
  • Applying for an Individual Taxpayer Identification Number with the IRS so you can file a federal tax return.
  • Enrolling in state or local programs that ordinarily ask for an SSN.

The letter carries your identifying information and a short statement from the SSA explaining that your application could not be processed. Keep the original safe and make copies for each agency that asks.

Who Actually Needs a Denial Letter

You need a denial letter because you don’t qualify for an SSN. U.S. citizens qualify for a number, as do lawful permanent residents and noncitizens whom the Department of Homeland Security has authorized to work in the United States.2Social Security Administration. Social Security Numbers for Noncitizens Some noncitizens without work authorization can still get an SSN for a valid nonwork reason, such as qualifying for Medicaid, Temporary Assistance for Needy Families, or another benefit program that requires a taxpayer identification number by law.3Social Security Administration. If none of that describes you, the denial letter is the document you want. The typical case is a dependent spouse or child on someone else’s visa who isn’t working and hasn’t sought work authorization.4U.S. Department of State. One caution for international students. If you’re on an F-1 or J-1 visa and have authorized on-campus employment or curricular practical training lined up, don’t ask for a denial letter yet. With the right sponsor or school documentation you may qualify for an SSN.5Social Security Administration. Documents to Bring

Bring your valid, unexpired passport and your Form I-94 Arrival/Departure Record.4U.S. Department of State. Every document has to be an original or a certified copy issued by the agency that produced it. The SSA does not accept plain photocopies or notarized copies.2Social Security Administration. Behind the scenes, the SSA may run your immigration information through the Systematic Alien Verification for Entitlements (SAVE) system, which checks your records with DHS.3Social Security Administration. How to Request the Letter in Person

In-person is the fastest route. If you’re a dependent without work authorization, the office can issue Form SSA-L676 while you wait, and there’s no fee.4U.S. Department of State. Applying by Mail

If you can’t get to an office, you can apply in writing. Fill out Form SS-5, the standard Application for a Social Security Card, and mail it with your original documents to any SSA field office.8Social Security Administration. Form SS-5 – Application for a Social Security Card The form asks for your full name, date and place of birth, citizenship status, and contact information.

Mail is slow. The SSA estimates 2 to 4 weeks to process a mailed application and return your documents, versus same-day service at many offices.9Social Security Administration. For most people, the trip to the office is worth it. You skip weeks of waiting and you don’t put your passport and I-94 in the mail.

Using the Letter to Get an ITIN

The denial letter shows you can’t get an SSN, but it isn’t a taxpayer identification number itself. If you need to file a federal tax return or open certain financial accounts, you’ll want an Individual Taxpayer Identification Number. The IRS issues ITINs to people who have a federal tax obligation but aren’t eligible for an SSN.10Internal Revenue Service. About Form W-7, Application for IRS Individual Taxpayer Identification Number

File Form W-7 with the IRS, usually attached to a federal income tax return, along with documents proving your identity and foreign status. A valid passport is the simplest option because it’s the only stand-alone document the IRS accepts. Without a passport, you’ll need two documents from the IRS’s approved list, such as a national identification card and a visa. All documents must be originals or certified copies and cannot be expired.11Internal Revenue Service. ITIN Supporting Documents

An ITIN is for tax purposes only. It does not authorize employment, change your immigration status, or entitle you to Social Security benefits. Keep the SSA-L676 with your tax records as documentation of your ineligibility.

If You Think the Denial Was a Mistake

Sometimes the SSA issues a denial because of a records mismatch rather than actual ineligibility. The usual cause is a SAVE verification failure, where the DHS check doesn’t return a match even though your status is valid. In those cases the SAVE system generally flags the case for resubmission with more information instead of closing it out as a final denial.12U.S. Citizenship and Immigration Services. Updated Guide to Understanding SAVE Verification Responses

If you suspect a data error, start with DHS and confirm your immigration record is accurate. If DHS corrects it, go back to the SSA office with the updated documentation and ask for the SAVE check to be run again.

For an SSA-side error, visit the office and ask a representative to review the case. Bring every original immigration document you have, plus any prior notices from the SSA, including Forms SSA-L669 or SSA-L670 requesting additional evidence. If the denial was wrong, the SSA can reverse it and process the SSN application. If it was correct and you simply need the letter, the representative can confirm that the SSA-L676 you already have will do the job.
