To get an assumable mortgage, you find a home financed with an FHA, VA, or USDA loan, apply to take it over through the seller’s current mortgage servicer, pass the lender’s credit and income review, and bring cash or a second loan to cover the difference between the sale price and the remaining balance. If the seller’s rate is well below current market rates, the savings over the life of the loan can be substantial. The catch is that assumptions are limited to specific loan types, the underwriting is nearly as thorough as a new mortgage, and the equity gap is often larger than buyers expect.
Which Loans You Can Assume
Three loan types are assumable in practice:
- FHA-insured single-family mortgages, regardless of when they were originated.1U.S. Department of Housing and Urban Development. Are FHA-Insured Mortgages Assumable?
- VA-guaranteed home loans. You do not need to be a veteran to assume one.2Department of Veterans Affairs. VA Circular 26-23-10
- USDA Section 502 rural housing loans, with terms that depend on whether you qualify for USDA assistance on your own.
Conventional mortgages from private lenders are almost never assumable by an unrelated buyer. Federal law allows lenders to write a due-on-sale clause into the loan, letting them demand full repayment when the property changes hands, and nearly all of them exercise that right. The statute does carve out transfers a lender cannot block: to a spouse or children, on the borrower’s death, through divorce or legal separation, and into a living trust where the borrower remains a beneficiary. Finding an Assumable Loan and Starting the Application
Assumability is a feature of the specific loan on the property, not of the listing. If a home you’re interested in was financed with an FHA, VA, or USDA loan, ask the seller for the current servicer’s name and the remaining balance. That servicer, not a new lender, is who you’ll apply through. Contact the servicer’s assumption department early. Response times vary, and knowing whether the servicer accepts digital uploads or requires mailed paperwork affects how you assemble your file.
Qualifying as the Buyer
Assuming a mortgage is not a shortcut around underwriting. The lender evaluates your finances much the way it would for a new loan.
FHA
For FHA-insured mortgages originated on or after December 15, 1989, the lender must run a full creditworthiness review of the person taking over the loan.4U.S. Department of Housing and Urban Development. Debt-to-income ratios generally should not exceed 43 percent. You also inherit the loan’s mortgage insurance premium, which stays part of the monthly payment.
VA
VA assumptions use two underwriting standards together: debt-to-income ratio and residual income. The residual income test checks whether you have enough left each month after the mortgage, taxes, insurance, and other debts to cover food, transportation, clothing, and similar essentials. Thresholds vary by region and family size. If your DTI exceeds 41 percent but your residual income exceeds the guideline by at least 20 percent, the loan can still be approved without additional supervisory review.6eCFR. 38 CFR 36.4340 – Underwriting Standards, Processing Procedures, Lender Responsibility, and Lender Certification A non-veteran can assume a VA loan, but the seller’s entitlement question below is one you should raise before signing anything.
USDA
USDA assumptions on single-family Section 502 loans run through the local USDA Rural Development office. The terms depend on whether you qualify for USDA assistance yourself. Call the servicing office early to confirm which eligibility rules apply to that specific loan.
Covering the Equity Gap
The biggest practical hurdle is the difference between the sale price and the remaining loan balance. If the home sells for $400,000 and the outstanding mortgage is $250,000, you need to bring $150,000 to closing. That is the seller’s equity, and it has to be paid up front.
Some buyers pay in cash. Others use secondary financing: a second mortgage or home equity loan that sits behind the assumed first mortgage. Both FHA and VA permit secondary financing, with rules. For VA assumptions, the second loan must be subordinate to the VA-guaranteed first mortgage, the proceeds can only cover closing costs or the seller’s equity, and you cannot receive any cash back. The lender processing the assumption factors the second loan’s monthly payment into your debt analysis. Whatever the source of your funds, expect the lender to verify it, both to confirm the money is real and to rule out undisclosed debt.
Documents and Forms
The financial documentation is consistent across programs. Plan on two years of W-2s and federal tax returns, recent pay stubs covering at least 30 days of earnings, and 60 days of bank statements showing your closing funds are available and properly sourced.
The program-specific forms differ:
- FHA: Form HUD-92210, “Request for Credit Approval,” starts the lender’s review of you as the substitute borrower. - USDA: Forms come from the local Rural Development office handling the loan.
If the servicer requires paper, certified mail with return receipt gives you a verifiable record of delivery.
How the Process Moves
Once the package reaches the servicer, its underwriting team reviews your income, credit, assets, and debt load. This typically takes 45 to 90 days, and longer if the servicer is backed up or the file is incomplete. Answering document requests quickly is the single biggest factor within your control.
If you’re approved, the parties go to a formal closing. You sign an assumption agreement, the legal contract binding you to the original loan terms, including the interest rate, remaining balance, and repayment schedule. The release of liability for the seller is executed at the same time, and the transfer is recorded with the county.
Fees and Costs
Assumption costs are much lower than the closing costs on a new mortgage, but they are not trivial.
- FHA processing fee: servicers can charge up to $1,800 for processing an FHA assumption. That cap was doubled from $900 effective May 20, 2024.11U.S. Department of Housing and Urban Development. FHA INFO 2024-30 – FHA Publishes Updates to Single Family Housing Policy Handbook
- VA processing fee: up to $300 when the lender has automatic authority, or $250 when the assumption requires VA prior approval. If the assumption is denied, $50 must be refunded to the buyer if the denial stands after 60 days.2Department of Veterans Affairs. VA Circular 26-23-10
- VA funding fee: 0.5% of the remaining loan balance, paid by the buyer unless you qualify for an exemption such as a service-connected disability. On a $250,000 balance, that’s $1,250.12Veterans Affairs. VA Funding Fee and Loan Closing Costs
Beyond agency fees, budget for a title search, county recording fees (which vary by jurisdiction), and notary charges. Secondary financing brings its own closing costs from the second lender.
What Veteran Sellers Should Tell You Before You Assume Their VA Loan
When a veteran sells through a VA loan assumption, their VA loan entitlement stays tied to the property unless the buyer is a veteran with sufficient unused entitlement who substitutes their own for the seller’s.2Department of Veterans Affairs. VA Circular 26-23-10 If you’re a civilian buyer, or a veteran who doesn’t substitute entitlement, the seller can’t get that entitlement back until the loan is paid in full, which may block them from buying another home with a VA loan.
This matters to you as the buyer for one reason: some veteran sellers make entitlement substitution a condition of the sale. If you can’t or won’t substitute, the deal may not close. Raise the question early rather than finding out at the negotiating table.
The seller has their own paperwork to complete for release from personal liability on the loan, running parallel to your application. That’s their concern to see through, but a stalled release on their side can hold up your closing, so it’s worth confirming the servicer is handling both tracks together.
