How to Get a US Tax Residency Certificate (Form 8802)

To get a U.S. tax residency certificate, file Form 8802 with the IRS, pay the user fee of $85 for individuals or $185 for other applicants, and wait for the IRS Philadelphia office to mail you Form 6166 on U.S. Department of Treasury stationery. Allow at least 45 days before the date you actually need the certificate. Form 6166 is what foreign tax authorities accept as proof that you are a U.S. tax resident, and it is most often used to claim reduced treaty withholding on foreign income or to obtain a Value Added Tax exemption abroad.1Internal Revenue Service. Who Can Be Certified

The IRS will issue Form 6166 to anyone who qualifies as a U.S. resident for federal income tax purposes: U.S. citizens, green card holders, non-citizens who meet the substantial presence test, and corporations incorporated in the United States.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

Trusts and estates have their own rules. A complex trust qualifies on its own. A grantor trust or simple trust can only be certified to the extent that its owners or beneficiaries are themselves U.S. residents, and the application must include each owner’s or beneficiary’s name, taxpayer identification number, and a signed Form 8821 authorizing the IRS to share their tax information. For an estate, certification depends on the decedent’s residency, and you must submit proof that you are the executor or administrator, such as a court certificate naming you to that role.3Internal Revenue Service. Partnerships are generally not treated as U.S. residents under the residence articles of most tax treaties. They can still request Form 6166, but the documentation and the way the certification operates differ from what applies to corporations or individuals.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

Who Cannot Be Certified

You cannot obtain Form 6166 if you filed a nonresident return, such as Form 1040-NR or Form 1120-F, for the tax period in question. Dual-resident individuals who have invoked a treaty tiebreaker to claim residency in another country are also ineligible. A dual resident who has not invoked the tiebreaker may still qualify, but the IRS can deny the request unless you submit evidence showing you are a U.S. resident under the treaty’s tiebreaker rules.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

If you are not a citizen or green card holder, your eligibility rests on the substantial presence test, a day-counting formula that weights days in the current year at full value, days in the first preceding year at one-third, and days in the second preceding year at one-sixth. You need at least 31 days in the current year and a weighted three-year total of 183.4Internal Revenue Service. Substantial Presence Test

When To File

Timing is stricter than most applicants expect. The IRS will not process a request for the current year’s Form 6166 if the application is postmarked before December 1 of the prior year. The earliest you can request a 2027 certificate, for example, is December 1, 2026. Applications sent before that date are returned, not held.3Internal Revenue Service. For past years, there is no cutoff. You can request certification for any number of prior tax years on a single Form 8802. Estates, employee benefit plans, trusts, and exempt organizations have an additional option: a three-year procedure that covers the current year plus the following two tax years on one application, so refiling every year is not required.2Internal Revenue Service. Completing Form 8802

Form 8802 is available on IRS.gov as a downloadable PDF, and, since September 2025, as a digital mobile-friendly form for individual applicants. The mobile version is not yet available for business entities.5Internal Revenue Service. About Form 8802, Application for U.S. Residency Certification

Enter your name and taxpayer identification number exactly as they appear on the tax return for the period you want certified. Individuals indicate whether they are filing as a citizen, resident alien, or dual-resident taxpayer. Corporations confirm their entity type and that they are not treated as a foreign corporation. List every foreign country where you plan to use the certificate and how many copies you need for each, because the IRS prints a separate Form 6166 for each nation.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

Line 9 asks for the purpose of your certification request. Leave it blank and the IRS will return the entire application. Listing a country with no tax treaty with the United States also triggers a return for correction.3Internal Revenue Service. Sign the form under penalties of perjury. A tax professional or authorized representative filing on your behalf must attach a signed Form 2848 (power of attorney) or Form 8821 (tax information authorization). An unsigned application is treated as incomplete and will not be processed.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

Paying the User Fee

The IRS charges a nonrefundable fee for each Form 8802 submitted:2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

  • $85 per application for individuals, regardless of how many countries or tax years are covered.
  • $185 per application for all other applicants, including corporations, trusts, estates, and partnerships.

The fee is per application, not per certificate. Five countries across three tax years costs one fee if it all fits on a single Form 8802, so the IRS encourages bundling requests. Pay electronically through Pay.gov or by check or money order made payable to the United States Treasury. Electronic payment produces a confirmation number, which you must record on page one of Form 8802. If you pay by check, no more than 200 Forms 8802 can be associated with a single payment. Processing does not begin until the IRS confirms the fee.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024)

Processing Time and Checking Status

Mail your application at least 45 days before the date you need the certificate. If there is a delay, the IRS will contact you after 30 days.2Internal Revenue Service. Instructions for Form 8802 (Rev. October 2024) Seasonal volume, especially early in the calendar year, can stretch that window. Adding a daytime phone number on Line 15 helps, because IRS staff can resolve questions by phone rather than by mail.

To check on a pending application, call the IRS at 267-941-1000, which is not toll-free, and select the U.S. residency option.6Internal Revenue Service. Form 8802, Application for United States Residency Certification – Additional Certification Requests

Why Applications Get Returned

The IRS returns incomplete applications rather than fixing them, and every return restarts the 45-day clock. The mistakes that trip people up most often:3Internal Revenue Service. Instructions for Form 8802 Application for United States Residency Certification

  • Line 9 left blank, so the purpose of the request is missing.
  • Electronic payment made, but the confirmation number was not entered on the form.
  • No signature from a person with signing authority.
  • A listed country that has no tax treaty with the United States.
  • A P.O. box or care-of address instead of a physical address, which can trigger denial.
  • An application for the current year postmarked before December 1 of the prior year.

The name and taxpayer identification number on Form 8802 must match what the IRS has on file from your return for the relevant period. Small discrepancies are enough to cause rejection.

What Form 6166 Is Used For

The most common use is claiming reduced withholding rates on foreign-source income such as dividends, interest, and royalties. You present the certificate to the foreign tax authority, which then applies the lower rate specified in that country’s treaty with the United States.

Form 6166 also serves as proof of U.S. residency for obtaining a Value Added Tax exemption in some countries. One limit worth knowing: the IRS can only certify your U.S. federal income tax status. It cannot certify that you meet any other conditions a foreign country may impose for its VAT exemption, so any additional requirements from the foreign authority must be satisfied separately.1Internal Revenue Service. When You Also Need an Apostille

Some foreign countries will not accept Form 6166 on its own. Members of the Hague Apostille Convention may require an apostille, a standardized authentication confirming that the document was issued by a legitimate government authority.

Apostilles for federal documents are issued by the U.S. Department of State’s Office of Authentications. You submit Form DS-4194 with the original Form 6166 and a $20 fee per document. Mail-in processing takes up to five weeks; walk-in drop-off in Washington, D.C. runs about seven business days; and a same-day appointment is available only for life-or-death emergencies involving travel within two weeks.7U.S. Department of State. Requesting Authentication Services

If an apostille will be required, add that processing time on top of the 45 days for the IRS. Waiting for Form 6166 to arrive before starting the apostille request is the usual reason people miss a foreign tax deadline.
