To get a Midland Credit Management lawsuit dismissed, you have to respond to the complaint on time, raise the right defenses in your Answer, and then push Midland to produce the documents courts require it to have — the original credit agreement, an unbroken chain of ownership from the original creditor, and an affidavit from someone with actual personal knowledge of the records. Midland buys charged-off debts in bulk for pennies on the dollar and often cannot produce that paperwork when a defendant fights back, which is why so many of its cases end in dismissal once the consumer shows up.

When Midland or its affiliated buyer, Midland Funding LLC, sues you, it carries the burden of proving three things: the debt is valid, the amount is correct, and Midland actually owns the specific account. A handful of defenses attack those elements directly, and they succeed often enough that they should be the starting point of any response.
Lack of Standing and Broken Chain of Title
Because Midland Funding buys debts in bulk from original creditors — often blocks of 15,000 to 25,000 accounts for roughly three cents on the dollar of face value3Greg Artim Law. A July 2025 case shows how this plays out. A defendant challenged Midland’s evidence and demonstrated that the bill of sale was generic and did not reference the defendant’s account. Midland claimed it had bought the debt in October 2019, but records showed the defendant made a final payment to the original creditor, Comenity Bank, in November 2020. Midland could not produce the original signed credit agreement, and an affidavit from Comenity did not reference the defendant by name. Defective Affidavits and Inadmissible Records
Midland usually supports its case with an affidavit from one of its own employees, attached to billing statements, data printouts, and a bill of sale.6Vermont Courts. Midland Funding Default Judgment Decision Courts have repeatedly found these submissions inadequate under the business records exception to the hearsay rule. The person signing usually has no personal knowledge of how the original creditor created, kept, or transferred its records.
In Midland Funding, LLC v. Mitchell-James, the Appellate Court of Connecticut reversed summary judgment because the affiant, a “legal specialist” at MCM, could not establish that the original creditor’s computer systems were reliable or explain how data moved from the bank to Midland. Without that foundation, the attached statements, data sheets, and bill of sale were inadmissible hearsay, and Midland failed to prove ownership.7CaseMine. Objecting to Midland’s affidavit — on personal knowledge grounds, on authentication grounds, and on hearsay grounds — is one of the most productive avenues for getting the case thrown out.
Expired Statute of Limitations
Every state sets a deadline for filing a debt collection lawsuit, and once it passes, the debt is time-barred. If you plead the statute of limitations as a defense and the debt is too old, the case can be dismissed.4Texas Debt Law. One trap to know about before you respond: in some states, making a partial payment on a time-barred debt or even promising to pay can restart the clock.10Harvard Law Review. Procedural Abandonment
In some jurisdictions, Midland loses cases simply by moving too slowly. Midland often cannot produce this documentation, which is precisely the pattern that has drawn regulatory attention. A 2015 CFPB consent order found that affiants had falsely claimed to have reviewed account-level documentation when they had only looked at summary data files.12Consumer Financial Protection Bureau. Consider a Counterclaim
If Midland violated the Fair Debt Collection Practices Act or the Fair Credit Reporting Act during collection, you can file a counterclaim seeking statutory damages and attorney’s fees.4Texas Debt Law. One boundary worth knowing. Federal courts have narrowed who can sue under the FDCPA. In Pierre v. Midland Credit Management, Inc., 29 F.4th 934 (7th Cir. 2022), the Seventh Circuit held that confusion, anxiety, and emotional distress from a collection letter do not qualify as “concrete injuries” for Article III standing. If Midland Already Has a Default Judgment Against You
Plenty of people learn about a Midland lawsuit only when a paycheck gets garnished or a bank account is frozen. If you were never properly served — sometimes called “sewer service” — you may be able to vacate the default judgment.
Under New York law, a default judgment can be vacated if you prove the affidavit of service was fraudulent, for example by showing you did not live at the address where service supposedly occurred.
