You can get 1099-MISC forms three ways: order official scannable forms free from the IRS, buy a form kit at an office supply store like Staples or Office Depot, or skip paper altogether and file electronically through the IRS’s free IRIS Taxpayer Portal. If you have ten or more information returns of any type to submit for the year, electronic filing is required, which makes the “where do I get forms” question moot.1Internal Revenue Service. Why You Can’t Just Print the Form From IRS.gov
This is the trap most first-time filers fall into. The IRS website has a downloadable 1099-MISC PDF, and it looks like a normal form. It isn’t a normal form. The IRS processes paper Copy A submissions with optical character recognition equipment, and the machines only read forms printed on the special red-ink stock the IRS produces. A copy printed from your office printer will not scan, and submitting one can trigger a penalty for filing an unreadable return.2Internal Revenue Service. Form 1099-MISC (Rev. April 2025)
Copy B — the copy you give to the recipient — is different. You can print Copy B from the downloaded PDF on a regular printer in black ink and hand or mail it to the payee. The scannable requirement applies only to the Copy A that goes to the IRS, and only if you’re filing on paper.
Ordering Official Forms Free From the IRS
The IRS mails paper information returns to businesses at no cost. Go to IRS.gov/EmployerForms and place an order for the current year’s Form 1099-MISC and Form 1096 (the transmittal cover sheet you’ll need for any paper filing). Current-year forms ship as they become available, and prior-year forms usually arrive within about 15 days.3Internal Revenue Service. Order Paper Information Returns and Employer Returns
Order early. In January, when everyone else is doing the same thing, shipping runs behind. If you know in December that you’ll be filing on paper, place the order then.
Buying a Form Kit at an Office Supply Store
Staples, Office Depot, and similar retailers sell 1099-MISC kits during tax season. A typical kit contains scannable Copy A sheets, recipient copies (Copy B and Copy C), a Form 1096 transmittal, and window envelopes sized to fit. A 50-form kit generally runs around $50 to $60. Two things to check before you pay: confirm the kit is for the correct tax year, and confirm it says 1099-MISC and not 1099-NEC, which is a different form for a different kind of payment.
Skipping Paper: Filing Electronically Through IRIS
If you don’t want to deal with special paper stock at all, the IRS’s Information Returns Intake System (IRIS) is free and handles 1099-MISC directly. IRIS lets you key returns in one at a time (up to 100 per submission), upload a CSV file for larger batches, generate recipient copies you can print or send electronically, and request extensions.4Internal Revenue Service. E-File Information Returns With IRIS
Before you can transmit anything, you need an IRIS Transmitter Control Code (TCC), a five-digit ID the IRS issues to your business. Applying takes time, so start the process well before the filing deadline. Businesses with higher volumes can also file through the older FIRE system with compatible software.
Electronic filing is mandatory if you have ten or more information returns total for the year, counting all types together (1099-MISC, 1099-NEC, 1099-INT, W-2s filed with the Social Security Administration, and so on).1Internal Revenue Service. E-File Information Returns Below that count, paper is still allowed but rarely worth the hassle.
Make Sure 1099-MISC Is the Right Form
Payments to independent contractors for services go on Form 1099-NEC, not 1099-MISC. A freelance designer, a consultant, a contract bookkeeper — those are 1099-NEC payments. The 1099-MISC covers a different set of categories, and filing the wrong form generates IRS notices and, potentially, penalties.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
You need to file a 1099-MISC for each payee to whom you paid $600 or more during the year in categories including rents, prizes and awards not tied to services, medical and health care payments, crop insurance proceeds, and gross proceeds paid to an attorney (as in a settlement). A lower $10 threshold applies to royalties and to broker payments in lieu of dividends or tax-exempt interest.6Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information
Payments to most corporations are exempt from 1099-MISC reporting, but there are two exceptions worth knowing: payments to corporations for legal services and payments for medical or health care services are reportable regardless of the recipient’s entity type.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
Get a W-9 Before You Do Anything Else
You cannot complete a 1099-MISC without the payee’s legal name and taxpayer identification number. Form W-9 is how you collect it, and the time to request one is when you first engage the payee, not in January when they may be slow to return your calls.7Internal Revenue Service. Instructions for the Requester of Form W-9
If the name and TIN on your 1099-MISC don’t match IRS records, you’ll get a CP2100 notice listing the mismatches. You then have to send a “B notice” to the payee, and if they don’t correct the information, you must begin backup withholding at 24% on all future payments to them.8Internal Revenue Service. Understanding Your CP2100 or CP2100A Notice
Which Box to Use
Enter your business’s name, address, and TIN in the payer section, and the recipient’s information in the recipient section. Then put the payment in the box that fits:
- Box 1 for rents of $600 or more, including office space, equipment, and land.
- Box 2 for royalties of $10 or more.
- Box 3 for other income, such as prizes and awards not tied to services and punitive damages.
- Box 6 for medical and health care payments of $600 or more to physicians or other providers.
- Box 10 for gross proceeds paid to an attorney in connection with legal services (the attorney’s own fees, by contrast, belong on a 1099-NEC).
The remaining boxes cover less common items like crop insurance proceeds, fishing boat proceeds, Section 409A deferrals, and nonqualified deferred compensation.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Most small businesses only ever touch Boxes 1, 3, and 6.
Submitting the Forms
You file Copy A with the IRS and give Copy B to the recipient. Copy C stays in your records.
Paper filers mail Copy A to the IRS Submission Processing Center for their area, along with Form 1096 as a cover summary. You need one 1096 per form type, and it must be the official IRS-printed version, not a printout.9Internal Revenue Service. Form 1096, Annual Summary and Transmittal of U.S. Information Returns The paper deadline is February 28.
Electronic filers submit through IRIS or FIRE, and the deadline is March 31. No Form 1096 is required with electronic returns.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
Recipient copies have their own deadline: January 31, regardless of how you file with the IRS. You can deliver recipient statements electronically, but only if the payee gives affirmative consent after you disclose that paper is available on request, explain how to withdraw consent, describe the software needed to view the file, and note how long the electronic copy will stay accessible.10Internal Revenue Service. Requirements for Furnishing Form 1099-G Electronically
If You Won’t Make the Deadline
File Form 8809 before the due date and you get an automatic 30-day extension for your IRS filing. No signature, no explanation. You can submit 8809 electronically through IRIS or FIRE, or mail a paper copy to the IRS in Ogden, Utah.11IRS. Form 8809, Application for Extension of Time To File Information Returns
A second 30-day extension is possible but not automatic; you have to explain the reason, sign the form, and submit it on paper. Neither extension changes the January 31 deadline for recipient copies.
Fixing an Error After You File
Dollar amount or code errors get a corrected 1099-MISC with the “CORRECTED” box checked at the top, the right numbers entered, and everything else left the same as the original. Send the corrected Copy A to the IRS with a new Form 1096, and send an updated Copy B to the recipient.
Payee name or TIN errors take two returns. First, file a corrected return that zeros out every money field of the wrong record. Then file a brand-new original return with the correct name or TIN and the actual dollar amounts. Both go to the IRS with a Form 1096.12Internal Revenue Service. 2025 General Instructions for Certain Information Returns Electronic corrections follow the same logic, submitted through IRIS or FIRE.
Speed matters. Corrections within 30 days of the original deadline face a much smaller penalty than corrections filed later.
Penalties for Late or Wrong Filings
The IRS charges penalties per return under Section 6721 for the IRS filing and Section 6722 for the recipient statement, and both can apply to the same mistake. For 2026:13Internal Revenue Service. Information Return Penalties
- Corrected within 30 days of the due date: $60 per return.
- Corrected after 30 days but by August 1: $130 per return.
- Filed after August 1, or not filed at all: $340 per return.
- Intentional disregard: $680 per return, with no annual cap.
The first three tiers have annual caps. The maximum for returns filed after August 1 is $4,098,500 per year, dropping to $1,366,000 for small businesses with average annual gross receipts of $5 million or less over the three most recent tax years.12Internal Revenue Service. 2025 General Instructions for Certain Information Returns The intentional disregard tier has no ceiling, which is where filing the wrong form on purpose, or ignoring the requirement, becomes genuinely expensive.
