How to Find Your Bankruptcy Discharge Date on PACER

To find your bankruptcy discharge date, pull up the discharge order the federal bankruptcy court entered in your case. The quickest route is PACER, the federal courts’ online records system, where you can open your docket and read the date directly off the order. If you’d rather not use PACER, the same date appears on the paper copy the court mailed you, in your attorney’s file, on your credit report, and in the clerk’s records at the court that handled your case.

Look Up the Order on PACER

PACER (Public Access to Court Electronic Records) is the federal judiciary’s portal for viewing case documents in bankruptcy, district, and appellate courts.1United States Courts. Find a Case (PACER) Register for an account at pacer.uscourts.gov before you search.

Once you’re in, run a case search using your bankruptcy case number if you have it, or your full legal name if you don’t. The case number is faster and avoids matches for other filers who share your name. Open your case, scroll the docket for an entry titled “Order of Discharge” or similar, and open it. The discharge date is stated on the face of the order.

PACER charges $0.10 per page, capped at $3.00 per document.2PACER. PACER Pricing: How Fees Work Discharge orders are short. And if your total PACER usage stays at or below $30 in a calendar quarter, the fees are waived entirely, so a one-time lookup will almost certainly cost you nothing.

Other Places the Date Already Lives

The Copy the Court Mailed You

When the discharge is granted, the court mails copies to the debtor, the debtor’s attorney, all listed creditors, the U.S. trustee, and the case trustee.3United States Courts. Discharge in Bankruptcy – Bankruptcy Basics If you kept your bankruptcy paperwork, the order is probably in there. It’s a one- or two-page document with the court header, your case number, and the date the discharge was granted.

Your Bankruptcy Attorney’s File

If a lawyer handled your case, their office received the order too. Attorneys keep case files for years, and most will read you the date over the phone or send it by email. This is often the easiest option when you still have the contact information.

Your Credit Report

Bankruptcy filings show up on your credit report and generally list both the filing date and the discharge date. You can pull a free copy from each of the three major bureaus once a week through AnnualCreditReport.com, a program that is now permanent.4Federal Trade Commission. You Now Have Permanent Access to Free Weekly Credit Reports A caveat: the date on a credit report can be wrong. For a mortgage application or anything legal, treat the court’s own record as the definitive source.

Call the Bankruptcy Court Clerk

If nothing above works, call the clerk’s office at the bankruptcy court where your case was filed. The clerk maintains the official case records and can look up the discharge date. Have your full legal name and approximate filing date ready. A case number is best, but the clerk can search without one.

The clerk can confirm the date on the call or direct you to order a certified copy of the discharge order. Federal courts charge $12 to certify a copy of a document.5United States Courts. District Court Miscellaneous Fee Schedule A certified copy carries the court’s seal and is the version mortgage lenders and other institutions are most likely to accept as proof.

Estimating the Date If You Filed Recently

If you’re still waiting on your discharge or trying to estimate when it landed, the timing depends on the chapter.

In a Chapter 7 case, the court typically grants the discharge about four months after the petition is filed. The clock runs roughly 60 days past the first date set for the meeting of creditors (the “341 meeting”), which is the window for creditors and the trustee to raise objections.3United States Courts. Chapter 13 runs much longer, because the debtor has to finish a three-to-five-year repayment plan first. If your income at filing was below your state’s median, the plan lasts three years; above it, the plan generally runs five years. The discharge is entered after the final plan payment.6United States Courts. Chapter 13 – Bankruptcy Basics

One thing that trips people up: the discharge date and the case closing date are not the same. A case can stay open for administrative reasons well after the discharge is entered. The discharge date is the one lenders and creditors care about.

Why the Exact Date Matters

The discharge date is the starting point for the mandatory waiting periods mortgage lenders use before you can qualify for a new home loan. For an FHA-insured mortgage after Chapter 7, at least two years must pass from the discharge date before approval, and under certain hardship circumstances that drops to twelve months. For Chapter 13, you may qualify after twelve months of on-time plan payments even before the discharge itself.7HUD.gov. You’ll also want the date on hand if a creditor tries to collect on a debt that should have been wiped out, or if you’re disputing an inaccurate credit report entry. The discharge order is a permanent court injunction against collection on covered debts, and a creditor who knowingly violates it can be held in contempt.9Office of the Law Revision Counsel. 11 U.S. Code 524 – Effect of Discharge The order and its date are your proof.
