How to Fill Out Form 1099-NEC for Subcontractors

To fill out Form 1099-NEC for subcontractors, collect a completed Form W-9 from each contractor, total what you paid them during the calendar year, and enter that total in Box 1 of the form along with your business information as payer and the contractor’s information as recipient. For payments made during 2025, you file a 1099-NEC for any contractor you paid $600 or more for services in the course of your trade or business. For payments made during 2026, the threshold jumps to $2,000, so some subcontractors who would have received a form in prior years no longer trigger the filing requirement.1Office of the Law Revision Counsel. 26 U.S. Code 6041 – Information at Source

Two conditions must both be true before a 1099-NEC is owed. You paid for services performed in the course of your trade or business, and the annual total meets the threshold.2Internal Revenue Service. Reporting Payments to Independent Contractors Hiring someone to remodel your personal kitchen doesn’t count, no matter the amount.

Before You Fill Out the Form

The form itself takes minutes. The preparation is where accuracy comes from.

Ask every contractor to complete Form W-9 before you issue the first payment.3Internal Revenue Service. Forms and Associated Taxes for Independent Contractors The W-9 gives you everything the 1099-NEC asks for later: legal name, business name if different, address, entity type, and Taxpayer Identification Number (a Social Security Number, ITIN, or EIN depending on how the contractor is set up). If a contractor refuses to supply a TIN or supplies one the IRS later flags as wrong, you are required to withhold 24% of every payment as backup withholding and remit it to the IRS.4Internal Revenue Service. Backup Withholding

Verify the name-and-TIN combination against IRS records using the free TIN Matching tool in the e-Services portal. It handles up to 25 combinations interactively or up to 100,000 in a bulk file returned within 24 hours.5Internal Revenue Service. Taxpayer Identification Number (TIN) Matching Tools A mismatch caught now is a two-minute fix; the same mismatch caught by the IRS after you file produces a CP2100 notice and potential penalties.

Keep a running ledger of every payment to each contractor across the year: checks, direct deposits, and any non-cash compensation. Reconcile the ledger against your bank statements before you touch the form. The number you enter in Box 1 has to be exact.

Confirm the Worker Is a Contractor

A 1099-NEC is only correct if the worker genuinely qualifies as an independent contractor rather than an employee. The IRS looks at behavioral control, financial control, and the type of relationship as a whole, and no single factor decides it.6Internal Revenue Service. Independent Contractor (Self-Employed) or Employee? Misclassifying an employee as a contractor exposes you to unpaid employment taxes plus penalties, so if the status is genuinely unclear, request an IRS determination with Form SS-8 before filing.

A few payments don’t belong on a 1099-NEC even when the amount is well over the threshold. Payments to C-corporations and S-corporations are generally excluded, with one firm exception: payments to attorneys for legal services are always reported on a 1099-NEC, even when the law firm is incorporated.7Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Payments routed through PayPal, Venmo, a credit card processor, or another third-party settlement organization get reported by that platform on Form 1099-K; you don’t duplicate them on a 1099-NEC.8Internal Revenue Service. Payer and Recipient Blocks

The upper-left block is yours as the payer: legal business name, address, and EIN, entered exactly as registered with the IRS. The upper-right block is the contractor’s, pulled straight from the W-9: legal name, business name, address, and TIN. Check these against the W-9 character by character. A name-and-TIN mismatch is the single most common error that triggers IRS notices.

The Numbered Boxes

Box 1 — Nonemployee Compensation. Enter the total you paid the contractor for services during the calendar year. For tax year 2025 this box is required if the total reached $600 or more; for tax year 2026 the threshold is $2,000 or more.10Internal Revenue Service. Form 1099-NEC and Independent Contractors

Box 2 — Direct sales. Used only for direct sales of $5,000 or more of consumer products for resale. Most subcontractor filings leave this blank.

Box 3. Reserved for fishing boat proceeds. Leave blank unless it applies.

Box 4 — Federal income tax withheld. Enter any backup withholding you applied to the contractor’s payments because they failed to provide a valid TIN.11Internal Revenue Service. Topic No. 307, Backup Withholding If you didn’t withhold, leave blank.

Boxes 5, 6, and 7 — State information. Box 5 is state income tax withheld, Box 6 is your state tax ID number, and Box 7 is the state income amount, which usually matches Box 1.

Which Copies Go Where

The form is a multi-part set. Copy A goes to the IRS. Copy B goes to the contractor for their federal return. Copy 2 goes to the contractor for their state return. Copy C stays in your files along with the contractor’s W-9 and your payment records; the IRS recommends keeping employment tax records at least four years.12Internal Revenue Service. Employment Tax Recordkeeping

If you’re filing on paper, Copy A has to be the official red-ink scannable version. You cannot print a usable Copy A from the IRS website; order the official forms from the IRS or generate them with tax software. E-filing avoids the physical form requirement entirely.

Filing Copy A With the IRS

If you’re filing 10 or more information returns of any type during the calendar year, counting W-2s and other 1099s, you’re required to e-file.13Internal Revenue Service. E-File Information Returns The aggregate threshold catches most small businesses.

The IRS offers a free portal called IRIS (Information Returns Intake System) where you can key in up to 100 returns at a time, upload a CSV, and download payee copies for distribution.14Internal Revenue Service. E-File Information Returns With IRIS The older FIRE system still works for the 2025 filing season but is scheduled for retirement after the 2026 filing season, so new filers should start with IRIS.15Internal Revenue Service. Filing Information Returns Electronically (FIRE) E-filing eliminates the need for red-ink Copy A forms and the separate Form 1096 transmittal.

If you file fewer than 10 returns and choose paper, include Form 1096, the summary cover sheet that reports how many 1099s you’re submitting under your EIN.16Internal Revenue Service. Form 1096 – Annual Summary and Transmittal of U.S. Information Returns Form 1096 also has to be an official scannable copy, not a web printout.

Deadline and Extensions

The 1099-NEC runs on a single unified deadline. You must furnish Copy B to the contractor and file Copy A with the IRS by January 31 following the end of the calendar year. For tax year 2025, January 31, 2026 falls on a Saturday, so the deadline moves to Monday, February 2, 2026.

There is no automatic extension for the 1099-NEC. You can request a single 30-day nonautomatic extension by filing Form 8809 on paper, but you have to include a written justification and sign the form, and the IRS grants these only in narrow circumstances.17Internal Revenue Service. About Form 8809, Application for Extension of Time to File Information Returns Not having your records together is unlikely to qualify. Plan to hit the January 31 date.

Fixing Mistakes After Filing

If you spot an error after filing, submit a corrected return. The corrections process is in Part H of the General Instructions for Certain Information Returns, and one rule matters above the rest: do not check the “VOID” box on a correction. VOID tells IRS scanning equipment to ignore the form, which means your fix never lands.18Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC IRIS and FIRE both accept electronic corrections.

The usual errors are wrong TINs, misspelled names, and incorrect payment amounts. If a name-and-TIN mismatch sits unresolved after a CP2100 or CP2100A notice, the penalty matches the late-filing penalty. Correct errors as soon as you see them.

Penalties for Missing or Botching the Filing

Penalties apply per form, and they stack fast. For returns due in 2026:19Internal Revenue Service. Information Return Penalties

  • Filed within 30 days of the deadline: $60 per form
  • Filed 31 days late through August 1: $130 per form
  • Filed after August 1 or not filed at all: $340 per form
  • Intentional disregard: $680 per form, with no maximum cap

A business with 20 subcontractors that misses the deadline entirely is looking at $6,800 before any other consequences. The same schedule applies separately to payee statements you fail to furnish to contractors on time, so a single missed deadline can produce two sets of penalties. Businesses with average annual gross receipts of $5 million or less qualify for lower aggregate caps, but the per-form amounts are the same.

State Copies

Many states require their own copy of the 1099-NEC. If you e-file federally, the Combined Federal/State Filing (CF/SF) Program can forward your data to participating states automatically.20Internal Revenue Service. Topic No. 804, FIRE System Test Files and Combined Federal/State Filing (CF/SF) Program Not every state participates, and some participating states still want separate notification. Check your state tax agency’s website to confirm whether CF/SF covers your obligation or whether a separate state filing is required. If your state requires income tax withholding on contractor payments, that’s what Boxes 5 through 7 are for.
