To submit an SCRA request, write a signed notice to your creditor, landlord, or the court telling them you are on active duty and asking for the specific Servicemembers Civil Relief Act protection you want, attach a copy of your military orders, and send it by a method that gives you proof of delivery. There is no single government-issued SCRA form. The process is a letter you write (or generate through your lender’s SCRA portal) plus documents that prove your active-duty status.
What Your Written Notice Must Contain
Whatever protection you’re invoking, the notice itself carries the same core elements. The Department of Justice’s guidance on the 6% interest rate cap lists them plainly:1United States Department of Justice. - Your full legal name, mailing address, email, and phone number.
- A statement that you are on active duty and where you are currently stationed or assigned.
- An explicit statement that you are requesting protection under the Servicemembers Civil Relief Act, naming the specific protection (for example, the 6% interest rate cap, lease termination, or a stay of proceedings).
- Every account number, lease reference, or case number the request applies to.
- A copy of your military orders.
Your installation’s Judge Advocate General (JAG) office keeps template letters that cover each of these items. If you have several accounts at different creditors, a JAG attorney can help you adapt a single template for each. Many banks and servicers also run their own SCRA intake portals or dedicated forms that pre-fill the required fields; those can speed processing, but a plain letter containing the items above is legally sufficient.
Proving Your Active-Duty Status
A copy of your orders is the standard proof. If your official orders haven’t been issued yet, a certified letter from your commanding officer works as a substitute. You can also generate an official status certificate from the Department of Defense Manpower Data Center (DMDC) at scra.dmdc.osd.mil. No login is required. For a single record, enter the service member’s last name and either a Social Security number or date of birth, then pick the specific date you want the system to check (the date you entered active duty, the date a lawsuit was filed, or whatever date matters for your request). Creditors and courts have access to the same tool and can verify status themselves.5Defense Manpower Data Center. Status Finder Attaching your own certificate anyway removes any argument that the recipient couldn’t confirm your eligibility.
How to Send the Request
Use a delivery method that creates a paper trail. Certified mail with a return receipt is the most reliable option because you get a date-stamped proof of delivery. Many lenders also accept fax, secure upload through their websites, or dedicated SCRA email addresses. Whichever channel you use, keep a copy of everything and note the exact date you sent it.
Send a separate notice to each creditor, landlord, or court involved. If you want the 6% cap applied to a credit card, an auto loan, and a mortgage held by three different companies, that’s three notices. If a lawsuit is pending in state court and you also want to notify a creditor in that same matter, the court and the creditor each get their own filing.
When to Send It
Send your notice as soon as you receive orders. Protections generally begin on the date you receive orders to report to active duty,6Office of the Law Revision Counsel. 50 USC 3911 – Definitions and earlier notice means faster adjustments.
For the 6% interest rate cap, you have until 180 days after your military service ends to submit the request. What Happens After You Submit
After the creditor processes your request, you should see a revised statement showing the 6% rate and a credit for any excess interest already charged. If three billing cycles pass and nothing has changed, follow up in writing and reference your original notice date and delivery confirmation. Keep watching statements to confirm every eligible account has been adjusted; creditors with multiple product lines sometimes miss one.
Lease Termination Notices Work the Same Way
Terminating a residential or auto lease under the SCRA uses the same basic submission mechanics: written notice plus a copy of your orders, delivered to the landlord or lessor. What changes is the triggering event and the effective date.
For a residential lease, you qualify if you signed it before entering active duty and were then called up, or if you signed it while already on active duty and then received PCS orders, deployment orders for 90 days or more, or a stop-movement order of at least 30 days. Deliver the written notice with your orders. For a month-to-month lease, termination takes effect 30 days after the next rent payment is due. For a motor vehicle lease, the qualifying triggers are similar but the duration threshold is longer: a pre-service lease plus a call-up of at least 180 days, or a lease signed during service followed by PCS orders to an overseas location or deployment orders for 180 days or more. After delivering the notice, return the vehicle to the lessor within 15 days.7Office of the Law Revision Counsel. 50 USC 3955 – Termination of Residential or Motor Vehicle Leases Early-termination penalties are prohibited, though you remain responsible for taxes, past-due payments, and damage beyond normal wear.
If a Creditor or Landlord Ignores Your Request
If a creditor refuses to lower your rate, a landlord tries to charge an early-termination fee, or a lender forecloses without a court order, you have two enforcement paths.
First, you can file a private civil action in federal court. A court can award money damages, equitable relief, and, if you prevail, your attorney fees and court costs. Second, the U.S. Attorney General can bring a civil action against a person or company that engages in a pattern of SCRA violations or a single violation raising a significant public-interest concern. Courts can award monetary damages to affected service members and assess civil penalties of up to $55,000 for a first violation and $110,000 for each subsequent violation.8Office of the Law Revision Counsel. 50 USC 4041 – Enforcement by the Attorney General
