How to Fill Out and Submit VA Form 21-0966: Intent to File

VA Form 21-0966, the intent to file a claim for compensation and/or pension, or survivors pension and/or DIC, is a one-page notice you send to the Department of Veterans Affairs to lock in an earlier effective date while you assemble a full claim. You don’t need medical records or evidence at this stage — just your identifying information and a check mark next to the benefit type you plan to pursue: disability compensation, veteran’s pension, or survivors pension and/or Dependency and Indemnity Compensation (DIC).

Why Filing This Form Matters

Under 38 C.F.R. § 3.155, submitting an intent to file preserves your effective date while you gather the evidence for a complete claim. If the VA approves the claim, your benefits are calculated from the date the VA received your intent to file, not the date your full application arrived.¹ That gap often represents several months of retroactive payments, especially if you’re waiting on private medical evaluations or tracking down service records.

The deadline is strict. You have exactly one year from the date the VA receives your intent to file to submit a complete application for the same benefit type. If that year passes without a completed claim, the protected date expires and any back-pay advantage goes with it.² You can file a new intent to file, but the effective date resets to whenever the VA receives that new one.

One detail worth pinning down: the VA counts the date it actually receives your form, not the postmark on your envelope. If preserving a specific date matters, submitting online or by fax removes the transit-time risk.

What to Put on the Form

The form is one page and takes a few minutes. It asks for:

Veteran’s name, exactly as it appears in VA or military records
Social Security Number (required for the veteran; a separate block captures the claimant’s SSN if a survivor is filing)
Date of birth
Service number, if applicable — some veterans whose service predates the use of SSNs in DoD records have a separate service number on file
VA file number, if you already have one from a prior claim
Mailing address and phone number
Benefit type: check Compensation, Pension, or Survivors Pension and/or DIC. The DIC box is only for surviving dependents of the veteran.

If someone other than the veteran is filing — a surviving spouse, a fiduciary, or a Veterans Service Organization representative — the form has a separate section for the claimant’s identifying information and a field to indicate the relationship to the veteran.²

You do not need a separate intent to file for each medical condition. One Form 21-0966 with the Compensation box checked covers every service-connected condition you eventually include in your disability claim.³ But different benefit types are separate categories. If you’re pursuing disability compensation for yourself and DIC as a survivor of another veteran, each needs its own checkbox or its own form.

The VA also allows only one active intent to file at a time per benefit type. Once you file the completed claim, the intent becomes inactive and the effective date attaches to the claim itself.³

How to Submit the Form

Federal regulation recognizes three methods: a saved electronic application, a signed paper form, or an oral statement to designated VA personnel.¹ In practice, that gives you four channels.

Online Through VA.gov

The fastest option is the online submission tool on VA.gov’s supporting forms page. You’ll need an identity-verified account through Login.gov or ID.me.³ For disability compensation, starting an online application for VA Form 21-526EZ automatically creates an intent to file. If you begin the disability claim online and save it before completing it, the VA treats that saved draft as your intent to file date.

By Mail

Because the VA uses the receipt date rather than your postmark, certified mail with a return receipt is worth the small extra cost. It gives you proof of the delivery date if a dispute arises later.

By Fax

Fax the completed form to 844-531-7818 from inside the United States, or 248-524-4260 from outside the country.⁴ Keep the confirmation page. It shows the date and time of transmission, which serves as evidence of your filing date.

In Person or by Phone

Any VA regional office will accept the form in person. A staff member can take it on the spot, and you can ask for a date-stamped copy as your receipt. Calling the VA at 800-827-1000 and stating your intent to file to a designated VA employee also counts as a valid oral intent to file under 38 C.F.R. § 3.155(b)(1)(iii), as long as the employee documents it in your records.¹ The phone option matters if you can’t get to a computer or printer and every day counts.

What to File Next

The intent to file is not a claim. The form itself carries an acknowledgment, which you sign, that a complete application still has to follow before the VA will process anything.² The application you submit inside the one-year window depends on the benefit type you checked:

Disability compensation: VA Form 21-526EZ, Application for Disability Compensation and Related Compensation Benefits.⁴
Survivors pension and/or DIC: VA Form 21P-534EZ, Application for DIC, Death Pension, and/or Accrued Benefits.⁵
Veteran’s pension: VA Form 21P-527EZ, Application for Veterans Pension.

The complete application is where your medical evidence, service records, and supporting statements go. The intent to file just holds your place while you assemble everything.

Filing Through a Representative or Fiduciary

A Veterans Service Organization, an accredited attorney, or a claims agent can submit an intent to file for you, but only if you’ve already given them power of attorney by filing VA Form 21-22 (for a VSO) or VA Form 21-22a (for an attorney or agent). The intent to file form states that a representative may complete it only when a valid power of attorney is on file.²

If you’re incapacitated and can’t sign for yourself, a court-appointed fiduciary can file the form on your behalf. The form has a Fiduciary checkbox in the claimant-relationship field and an authorized-agent signature block. The fiduciary appointment paperwork should already be on file with the VA before the form is submitted.

If the Claimant Dies Before Filing the Full Claim

When a veteran or claimant dies with a pending intent to file or an open claim, a surviving spouse, child, or other eligible person may request to substitute into the claim. The designated form is VA Form 21P-0847, Request for Substitution of Claimant Upon Death of Claimant, which lets the survivor continue the deceased claimant’s pending claim or appeal.⁶ Substitution preserves the evidence already in the file and lets the survivor add more toward potential accrued benefits.

Separately, a surviving dependent can file their own intent to file for DIC or survivors pension benefits. If the survivor submits VA Form 21P-534EZ within one year of that intent, the application date relates back to the intent to file date.⁵ These are two different paths, and in many cases a surviving spouse should consider both.
