Who Can File a Claim
You qualify as a class member if you are a U.S. resident who received a notice from WakeMed stating that your personal or health-related information was transmitted, or potentially transmitted, to Meta through the Meta Pixel installed on WakeMed’s MyChart patient portal and other WakeMed websites between March 2018 and May 2022.1WakeMed Pixel Incident Action. Notice of Proposed Class Action Settlement The class is defined by a master list maintained by the settlement administrator. If you did not receive a notice from Kroll and think you should have, the settlement website has a look-up tool.
Officers, directors, and legal representatives of WakeMed are excluded, along with any judge presiding over the case and anyone who timely opts out.1WakeMed Pixel Incident Action. Notice of Proposed Class Action Settlement
What the Claim Form Asks For
The form is short, and you do not need to prove any specific financial loss to receive a payment. A valid, timely submission is enough.2North Carolina Judicial Branch. Weddle v WakeMed Health and Hospitals – Order and Opinion on Motion for Final Approval of Class-Action Settlement You will be asked for:
- Your Unique ID and PIN, which appear on the notice Kroll mailed you. These link your claim to the class list. If you lost the notice, the settlement website has a look-up tool that uses the email address WakeMed has on file.
- Your full legal name, entered exactly as it appears in WakeMed’s records. A mismatch can slow verification.
- Your current mailing address, which is where any paper check would be sent.
- A phone number and email address so the administrator can contact you about corrections or send status updates.
- Your payment preference. Online filers can choose Venmo, PayPal, Zelle, ACH bank transfer, or a mailed paper check. If you file by mail, you will receive a paper check.

How Much You’ll Receive
Every valid claimant receives an equal pro rata share of the net settlement fund. The gross fund is $2,450,000, but several deductions come off the top before it is divided:1WakeMed Pixel Incident Action. Notice of Proposed Class Action Settlement
- Attorneys’ fees of up to 33.33% of the fund ($816,666.67), plus reasonable litigation expenses up to $40,000, subject to court approval.
- Service awards of $2,500 per named class representative.
- The administration and notice costs Kroll incurs to run the process.
Whatever remains is split equally among everyone who files a valid, timely claim. The fewer people who file, the larger each share. Because no proof of loss is required, this is a file-and-wait process for most people.
What Happens After You File
Kroll reviews claims to verify eligibility and remove duplicates. The court granted final approval of the settlement on October 16, 2025, so the remaining variable is whether any appeals are filed.2North Carolina Judicial Branch. Weddle v WakeMed Health and Hospitals – Order and Opinion on Motion for Final Approval of Class-Action Settlement Without an appeal, payments typically go out within a few months of the final approval order. An appeal can delay distribution by months or longer.
Your payment will arrive through the method you selected: electronic transfer for online filers who chose one, or a paper check to the address you provided. If you move before payments go out, use the settlement website to update your address with the administrator.
If You Want to Opt Out or Object Instead
The deadlines to opt out or object have already passed, but the distinction matters if you are deciding what filing a claim means. Opting out required a signed letter, postmarked by August 8, 2025, sent to Kroll and asking to be excluded from Weddle et al. v. WakeMed, Case No. 2022CVS013860.1WakeMed Pixel Incident Action. Notice of Proposed Class Action Settlement Objecting kept you in the class but asked the court to change or reject the terms, and required a written filing with the North Carolina Business Court in Charlotte by the same date. You could not do both. Filing a claim now means you accept the settlement and release your privacy claims against WakeMed for the covered period.
Taxes on Your Payment
Settlement payments for privacy violations are generally treated as taxable income. The IRS looks at the nature of the underlying claim, and payments that do not compensate for physical injury or physical sickness are typically includable in gross income.3Internal Revenue Service. Tax Implications of Settlements and Judgments Because this settlement resolves privacy and data-sharing claims rather than physical harm, your payment will likely be taxable.
For 2026, the threshold for issuing a Form 1099-MISC increased from $600 to $2,000. If your individual payment is below $2,000, the administrator may not send you a 1099, but the income is still reportable on your return.4Internal Revenue Service.
