How to Complete Each Section

Member Information
Fill in your first and last name, date of birth, Member ID, and Group Number. All four appear on your prescription benefit ID card. Add your phone number and full home address. Check the Member ID twice. A single transposed digit is the easiest way to send an appeal into limbo.
Authorized Representative
If a family member, caregiver, or your prescriber is filing for you, their name, phone number, address, and relationship to you go in this section. Capital Rx also requires a separate Authorization to Use & Disclose Protected Health Information form or an Appointment of Representative form, available at cap-rx.com or through Customer Care.3Capital Rx. Member Complaint Form Without that authorization attached, Capital Rx may refuse to process the appeal.
Complaint Details
List the medication name, the date of the denial, and the pharmacy name if one was involved. The description box is the field that matters. State the specific drug denied, your diagnosis, why your doctor prescribed it, what alternatives you have already tried, and what outcome you want from the appeal. Vague descriptions give reviewers nothing to work with. If your prescriber has written a letter of medical necessity covering these points, note that it is attached and refer to it.
Signatures
Both you and any authorized representative must sign and date the form. Capital Rx can reject an unsigned form without reviewing it.
Documentation to Attach
The form asks for “supporting documentation,” and this attachment is where most appeals succeed or fail. A complaint form submitted alone, with no clinical backup, almost always results in the original denial being upheld. Gather the following before you submit:
- A letter of medical necessity from your prescribing physician explaining your diagnosis, why this specific medication is needed, and why covered alternatives will not work. Specificity about your medical history makes the letter harder to dismiss.
- Recent medical records, including office visit notes relevant to the prescription.
- Lab results or diagnostic findings that support the clinical need.
- Treatment history. If the denial involves step therapy, include records showing you already tried the required alternatives and they failed or caused adverse effects. For step therapy overrides, this is the single most persuasive piece of evidence.
Ask your doctor’s office to prepare these materials while you complete the form. Prescribers familiar with the appeal process can usually draft a medical necessity letter quickly when they know one is needed.

You can also fax the appeal to the Appeals Department at (833) 434-0563, the same line used for prior authorization requests.4Capital Rx. Prescriber Resources If you fax, keep the transmission confirmation page. If you mail, use certified mail with return receipt requested so you have a tracking number and written proof of delivery. That receipt matters if there is ever a dispute about whether you filed on time.
Capital Rx’s member resources page does not currently list an online portal for appeal submissions. If that changes, mycapitalrx.judi.health is the place to check.
Filing Deadline
You have at least 180 days from the date of the denial notice to file your internal appeal. That floor comes from federal regulations governing group health plan claims procedures.1eCFR. 29 CFR 2560.503-1 – Claims Procedure Your plan documents may allow more time, but not less. Don’t wait until the final week. Collecting clinical documentation from a prescriber takes time, and a rushed appeal built on thin evidence is barely better than no appeal.
When You Should Get a Decision
The decision deadline depends on whether your claim is pre-service (you haven’t received the medication yet) or post-service (you already paid out of pocket), and whether the situation is urgent.
- Pre-service appeals: Capital Rx must decide within 30 days of receiving your appeal if the plan has one level of appeal, or within 15 days per level if the plan has two levels.1eCFR. 29 CFR 2560.503-1 – Claims Procedure

- Urgent care appeals: 72 hours, when a physician with knowledge of your condition confirms that waiting would seriously jeopardize your health or leave you in pain that cannot be adequately managed.5U.S. Department of Labor. Filing a Claim for Your Health Benefits
The decision arrives as a written determination letter explaining the rationale and citing the plan provisions behind it. If the appeal is granted, the medication is covered going forward under the terms of the decision.
Requesting an Expedited Review
Urgent care treatment is not available for every denial. It applies only when a physician with knowledge of your condition determines that the standard timeline would seriously threaten your health or leave you in uncontrolled pain.5U.S. Department of Labor. To trigger the faster track, your doctor should call Capital Rx at (888) 832-2779 and state that the appeal qualifies as urgent. Submitting the written form by fax at the same time your prescriber makes the call speeds the process considerably.
If Capital Rx Misses Its Deadline
If the plan fails to issue a decision within the required timeframe, federal regulations treat you as having exhausted all internal remedies. You can pursue legal action under ERISA without waiting any longer for the plan to respond.1eCFR. 29 CFR 2560.503-1 – Claims Procedure This is called “deemed exhaustion.”
A missed deadline also strengthens your position in external review. The plan’s failure to follow its own procedures is itself evidence the process broke down.
If the Internal Appeal Is Denied
When Capital Rx upholds the denial on internal appeal, you can escalate to an external review by an independent review organization unconnected to your plan. External review is available for denials involving medical judgment, determinations that a treatment is experimental, or coverage cancellations based on alleged misinformation in your application.6HealthCare.gov.
