To fill out Form 8802, you confirm you’re eligible as a U.S. resident for the tax year you need certified, pay the user fee through Pay.gov, complete the two-page application with information that exactly matches your filed U.S. tax return, and send it to the IRS office in Philadelphia. The fee is $85 for individuals and $185 for entities, and the IRS asks that you submit at least 45 days before you need Form 6166 in hand.1Internal Revenue Service. Instructions for Form 8802 (PDF) Form 6166 is the letter foreign tax authorities and payers require before they’ll apply reduced treaty withholding rates or grant a VAT exemption.2Internal Revenue Service. Instructions for Form 8802
One boundary worth naming up front: Form 6166 only certifies residency. It does not prove you paid U.S. tax, so you cannot use it to support a foreign tax credit claim.3Internal Revenue Service. About Form 8802, Application for U.S. Residency Certification
Confirm You’re Eligible Before You Start
The IRS certifies residency by checking its own records against the return you filed for the year you want certified. If that return doesn’t show you as a U.S. resident, no amount of form-completion will fix the problem.
You qualify as an individual if you’re a U.S. citizen, a green card holder, or a resident alien who met the substantial presence test for the certification year.4Internal Revenue Service. Substantial Presence Test If you filed Form 1040-NR as a nonresident for that year, you are not eligible. Dual-resident taxpayers who used a treaty tie-breaker to claim residency in the other country lose eligibility for the year they made that election.1Internal Revenue Service. Instructions for Form 8802 (PDF)
A domestic corporation qualifies if it filed a regular U.S. corporate return. A return on Form 1120-F or Form 1120-FSC, both nonresident filings, doesn’t count.1Internal Revenue Service. Instructions for Form 8802 (PDF)
Partnerships, S corporations, grantor trusts, and single-member LLCs work through their owners. The IRS certifies that the entity filed its information return and that its partners, members, or beneficiaries filed their own returns as U.S. residents. Every partner or beneficiary who wants to benefit must consent, and each one is verified individually.1Internal Revenue Service. Instructions for Form 8802 (PDF)
Gather Your Information
Have these items on hand before you start:
- Your Social Security Number if you’re an individual, or your Employer Identification Number for a business, trust, or estate.
- The form number of the return you filed for the certification year (1040, 1120, 1065, 1041, and so on) and the tax year or fiscal year end.
- Every foreign country where you’ll claim treaty benefits or a VAT exemption. The IRS prints a separate Form 6166 for each country.
- The user fee: $85 for individuals, $185 for all other applicant types.
- Form 2848 if a tax professional is filing on your behalf.5Internal Revenue Service. About Form 2848, Power of Attorney and Declaration of Representative
Pay the User Fee First
The IRS will not process your application until the nonrefundable user fee is paid.1Internal Revenue Service. Instructions for Form 8802 (PDF) Most applicants pay electronically through Pay.gov. Search the site for “IRS Certs,” enter your name, TIN or EIN, contact information, and the number of Forms 8802 you’re submitting. The site calculates the fee based on your applicant type. You can pay by bank account (ACH) or debit or credit card.2Internal Revenue Service. Instructions for Form 8802
Pay.gov asks you to upload a copy of your Form 8802 during payment, but that upload is only for reconciliation. You still submit the actual application separately by mail or fax. When payment processes, you receive an e-payment confirmation number, either the Agency Tracking ID or the Pay.gov ID. Write that number on page one of Form 8802 before mailing. Skip this step and the IRS will not process the application, even though you paid.2Internal Revenue Service. Instructions for Form 8802
If you’d rather pay by check or money order, make it payable to the United States Treasury and include it with the mailed application. This route uses a slightly different mailing address, covered below.
Complete the Form
Form 8802 is two pages, and most fields track directly to your tax return. Keep a copy of the return open while you work.
Applicant Information (Lines 1 Through 4)
On Line 1, enter your name and TIN exactly as they appear on your filed return. The IRS matches these against its records and a mismatch stops processing. If you’ve changed your name since your last filing, update it with the Social Security Administration or IRS first. Certification won’t issue until the IRS database reflects the new name.1Internal Revenue Service. Instructions for Form 8802 (PDF)
Line 2 wants the address that corresponds to the certification year. Do not use a P.O. box or a “care of” address. Either one can result in denial. If your address has changed since your last return, explain the change on the form.1Internal Revenue Service. Instructions for Form 8802 (PDF)
Line 4 asks you to check a box for your applicant type: individual, partnership, trust, estate, corporation, S corporation, employee benefit plan or trust, exempt organization, disregarded entity, or nominee applicant.1Internal Revenue Service. Instructions for Form 8802 (PDF)
Countries, Tax Years, and Purpose
List each country where you need certification and the tax year or years involved. Requesting treaty benefits for a country that has no tax treaty with the United States will get your application returned for correction. You also need to state the purpose: income tax treaty benefit, VAT exemption, or both. A blank purpose field is another automatic return.1Internal Revenue Service. Instructions for Form 8802 (PDF)
Sign Under Penalties of Perjury
The form requires a penalties-of-perjury signature confirming the statements are true, correct, and complete. An unsigned form is treated as incomplete. If you’re requesting VAT certification, the perjury statement must also confirm your business activity (NAICS code) has not changed since your last filed return.1Internal Revenue Service. Timing Window
The IRS will not accept applications for a current-year Form 6166 postmarked before December 1 of the prior year. Applications that arrive too early are returned unopened.1Internal Revenue Service. Instructions for Form 8802 (PDF)
After You Submit
Plan on at least 45 days from mailing to receiving Form 6166. The IRS will contact you after 30 days if something is delaying the request.6Internal Revenue Service. Form 8802 Application for United States Residency Certification – Additional Certification Requests Peak season, especially early in the calendar year when many taxpayers apply for the prior year’s certification, can push processing beyond that window.
To check status, call 267-941-1000, which is not a toll-free line. When the automated system answers, choose the U.S. residency option.6Internal Revenue Service. Form 8802 Application for United States Residency Certification – Additional Certification Requests
Why Applications Get Returned
The IRS is specific about what triggers a rejection. Knowing these ahead of time saves weeks:
- No U.S. return filed for the certification year, or a return filed as a nonresident (1040-NR, 1120-F, or a U.S. territory return).
- Missing user fee, or an electronic payment without the confirmation number written on the form.
- Name or TIN that doesn’t match IRS records from your tax return.
- A P.O. box or “care of” address on Line 2.
- Purpose field left blank.
- Treaty benefits requested for a country that has no U.S. tax treaty.
- Application postmarked before December 1 of the year preceding the certification year.
- Missing penalties-of-perjury signature.1Internal Revenue Service. Instructions for Form 8802 (PDF)
If the IRS spots a problem, it sends a letter asking for documentation or an amended form. Responding quickly keeps your place in the queue rather than restarting from scratch.
Extra Copies and Future Years
If you’ve already been certified for a year and need Form 6166 for another country or an extra copy, file a new Form 8802 with the “Additional Request” box checked. This works only when nothing meaningful has changed from the original application: same address, same tax return, same filing status. The full user fee applies, but processing is faster because your information is already verified.6Internal Revenue Service. Form 8802 Application for United States Residency Certification – Additional Certification Requests
For multiple copies of Form 6166 for the same country on one application, the first copy is included in the base fee and each additional copy costs $5.2Internal Revenue Service. Instructions for Form 8802
Each certification is valid only for the tax year printed on it. There is no automatic renewal, and every new tax year of foreign income means a new Form 8802. If you earn income in the same foreign country each year, folding this application into your annual tax prep keeps you from scrambling when a foreign payer asks for the letter on short notice.
