What Form 4422 Does
When someone dies, Internal Revenue Code Section 6324 puts an automatic lien on every asset in the gross estate. Form 4422 is how you ask for that release on a specific property. Which Documentation Tier Applies to Your Estate
Before you start filling in the form, figure out which of two paths you are on, because it changes what you attach.
If the estate is required to file Form 706, you submit the full application with the complete document package described below. If the estate falls under the filing threshold, you still file Form 4422, but the IRS only needs enough to confirm the threshold was not met. Filling Out the Form Section by Section

Decedent Information
Enter the decedent’s full name, date of death, legal residence at time of death, Social Security Number (or IRS-assigned number), and the estate’s EIN if one has been obtained. These identifiers tie the application to the right tax account.
Tax Filing and Payment Status
If Form 706 or 706-NA has already been filed, enter the filing date and the amount of tax paid. If the return has not been filed yet, enter your best estimate of the tax due. The IRS uses this figure to judge whether the remaining assets can still cover the liability once the property is released.
Gross Estate Breakdown
The form asks for the gross estate broken out into the same categories as Form 706: real estate; stocks and bonds; mortgages, notes, and cash; life insurance on the decedent; jointly owned property; lifetime transfers; powers of appointment; annuities; and other miscellaneous property. Total them for the gross estate figure. If Form 706 has been filed, your numbers here must match it.
Gifts, Deductions, and Exclusions
Report total adjusted taxable gifts that were or will be reported on Form 709 and any gift tax paid. Then list the estate’s deductions: funeral and administrative expenses, debts and mortgages, the marital deduction, the state death tax deduction, charitable deductions, and any other deductions. Enter any deceased spousal unused exclusion (DSUE) from a predeceased spouse and any qualified conservation easement exclusion.
Elections and Deferrals
Indicate whether the estate is electing special-use valuation for farm or business real property under Section 2032A, and whether payment of estate tax has been deferred under Sections 6161, 6163, or 6166. These affect how the IRS judges whether the tax is adequately secured.
Purchaser Information
If the property is being sold, give the buyer’s name and address, their relationship to both the applicant and the decedent, and the purchase price. Related-party sales draw closer review, so build in extra time if the buyer is a family member or a beneficiary.
Property Description and Reason for Application
Enter the property’s physical address and attach the full legal description from the deed. A street address alone is not enough. Then write a short factual statement about why you need the discharge: a pending sale with a specific closing date, the need to pay estate expenses, a refinance requirement.
Signature
The applicant signs under penalties of perjury. If a representative is authorized on Form 2848, that person signs separately.

- Letters testamentary or letters of administration showing your authority
- Complete legal description of the property and a copy of the deed
- Copy of the will
- Copy of the sales contract
- Closing statement or proposed closing statement
- Current title report
- Appraisal or other basis of valuation for the property
- Copy of Form 706 or 706-NA with schedules if already filed
- Draft Form 706, or a full asset inventory with date-of-death values, if the return has not been filed
If Form 706 has not been filed, a draft of it gives the IRS the clearest picture of where the estate stands. If a draft is not practical, at minimum submit a list of every asset the decedent had an interest in and its date-of-death value.

Two optional attachments are worth considering. Form 8821 (Tax Information Authorization) lets the IRS talk directly to your attorney, accountant, or title company during review. Form 2848 (Power of Attorney) lets a representative handle the application on your behalf.

Send it certified mail, return receipt requested, so you have proof of when the IRS received the package. There is no IRS filing fee, but you will pay for appraisals, title reports, and any legal work needed to put the application together.

Missing documents are the most common cause of delay, so check every figure on the form against its supporting attachment before mailing.
What Happens After You File
If the IRS decides the tax liability is adequately provided for, it issues Form 792, the United States Certificate Discharging Property Subject to Estate Tax Lien.6Internal Revenue Service. Internal Revenue Manual – 5.5.8 Advisory Responsibilities for Processing Estate Tax Liens – Section: 5.5.8.15 Preparation and Issuance of Certificates of Discharge Record Form 792 in the land records office for the county where the property is located. Recording puts the discharge on the public record and clears the lien from the chain of title. Only then can the property transfer to a buyer or beneficiary free of the federal estate tax lien.
If the IRS denies the application, it will state why. Common reasons: the remaining estate assets do not clearly cover the tax, the valuation looks low, or documentation is missing. You can resubmit with corrections, but a denial resets the review clock, which is why the first submission needs to be complete.
Why It Matters If You Skip This
Executors who distribute or sell estate property without addressing the lien carry real personal risk. Separately, 31 U.S.C. ยง 3713 makes a representative personally liable when the estate is insolvent and other debts are paid before the government’s claim.
