To fill out a mortgage assumption form, request the assumption packet from the current loan’s servicer, complete it with your identification, income, debt, and asset information, attach the supporting documents the servicer lists, pay the processing fee, and submit the package to the servicer’s assumption department. Approval runs through underwriting much like a new mortgage application, and after approval both parties sign a formal assumption agreement that transfers the debt.
The form itself is not standardized. Each servicer uses its own application, so the exact fields vary. The categories below cover what every assumption application asks for and what trips people up.
Confirm the Loan Is Actually Assumable First
Filling out the form is wasted effort if the loan cannot be assumed. FHA, VA, and USDA loans are assumable with servicer approval. Most conventional mortgages are not: they contain a due-on-sale clause, and the Garn-St. Germain Depository Institutions Act authorizes lenders to enforce that clause when residential property changes hands.1Office of the Law Revision Counsel. 12 U.S. Code 1701j-3 – Preemption of Due-on-Sale Prohibitions
One narrow exception matters for family situations: on residential property with fewer than five units, the same federal statute bars lenders from calling the loan due when the property transfers to a spouse or children, passes through divorce, moves to the borrower’s living trust, or passes at death to a joint tenant. The new owner can keep making payments on the existing loan without going through underwriting, but that is not the same as a full assumption and no form gets filled out.1Office of the Law Revision Counsel. 12 U.S. Code 1701j-3 – Preemption of Due-on-Sale Prohibitions If you are doing a true buyer-takes-over-the-loan assumption, the loan needs to be FHA, VA, or USDA.
Get the Right Form From the Right Place
For FHA, USDA, and VA loans held by a private lender, call the servicer and ask specifically for the assumption package. The assumption desk is sometimes housed inside the loss mitigation or transfer department, and some servicers will not release the forms without a written request. Confirm two things on that same call: whether the submission goes through a secure online portal or a specific mailing address, and what processing fee needs to accompany the application. Sending the package to the wrong department adds weeks.
VA direct loans, where the VA itself holds the mortgage, use a government form instead of a servicer packet. The seller initiates the process with VA Form 26-6381, “Application for Assumption Approval and Release From Personal Liability,” which the regional VA office mails along with an instruction letter after the seller contacts them.2Department of Veterans Affairs. What the Application Asks For
Regardless of which servicer issues the packet, expect to fill in the same categories of information. Every field matters. Servicers process these in volume, and incomplete forms get pushed to the back of the queue or returned outright. Write “N/A” in any field that genuinely does not apply rather than leaving it blank.
Personal Identification
Full legal name, Social Security number, date of birth, and current address for every person who will be on the assumed loan. If two buyers are assuming the loan jointly, both need complete sections.
Loan Details
The existing loan account number, the property address, the legal description of the property, and the current occupancy status. Pull the loan number from a recent mortgage statement the seller can share with you; getting a digit wrong here routes the file to the wrong account.
Income and Employment
Gross monthly income, employer name and contact information, and a two-year employment history. Self-employed applicants document their business separately. If you have gaps in employment or switched industries recently, be ready to explain in writing.
Monthly Debts
A complete breakdown of recurring obligations: auto loans, student loans, credit card minimums, child support, alimony, and any other installment or revolving debt. The servicer uses these figures to calculate your debt-to-income ratio. Pull current statements before you start the form so the balances and payments match what the servicer will see on your credit report.
Assets
Balances for checking and savings accounts, retirement accounts, and other liquid assets. The servicer wants to confirm you can cover closing costs and, in most cases, the difference between the loan balance and the purchase price.
Documents to Attach
The attachments mirror a new mortgage application. Gather everything before you submit so the servicer is not waiting on pieces:
- Federal tax returns and W-2s for the last two years. Self-employed applicants typically add two years of business returns.
- At least 30 days of recent pay stubs showing current income.
- Two to three months of statements for every checking, savings, and retirement account listed on the application.3Freedom Mortgage. How to Apply for a Loan Assumption
- A fully executed purchase agreement between buyer and seller.
- Government-issued photo ID (driver’s license or passport).
- A written explanation letter for any derogatory marks on your credit report, if the servicer asks for one.
- A divorce decree, if applicable to the transaction.
Two program-specific additions. For a VA assumption where a veteran buyer wants to substitute their entitlement onto the loan, include a Certificate of Eligibility showing sufficient available entitlement.4Department of Veterans Affairs. Fees to Include
Most servicers want the processing fee submitted with the application packet. Amounts depend on the loan type:
- VA loans: the servicer may charge a processing fee of up to $300. A VA funding fee of 0.5% of the loan balance also applies, unless the buyer qualifies for an exemption such as VA disability compensation. On a $250,000 balance, the funding fee is $1,250. The funding fee is normally collected at closing rather than with the application.6Department of Veterans Affairs. VA Circular 26-23-10 Change 1 – Assumption Fees7Veterans Affairs. VA Funding Fee and Loan Closing Costs
- FHA loans: HUD caps the assumption processing fee at $1,800. Individual servicers may charge less.
- USDA loans: fees depend on whether the assumption is on program or non-program terms. Confirm the current amount with the servicing office.
- Recording fees: your county recorder charges to record the assumption agreement, typically $10 to $112 depending on the jurisdiction. This is paid at closing.
For a VA direct loan assumption submitted on Form 26-6381, the instruction letter that accompanies the form specifies the exact amount, and payment goes to the VA by certified check or money order.2Department of Veterans Affairs. Submitting the Package and What Happens Next
Send the complete package through whichever channel the servicer specified when you requested the forms. Underwriting review generally runs 45 to 90 days, and some servicers run longer during high-volume periods. The servicer evaluates your credit, income, employment stability, and debt-to-income ratio using the same standards it applies to a new loan.
One point on FHA credit review: HUD exempts assumptions from the minimum decision credit score that applies to new FHA originations.8U.S. Department of Housing and Urban Development. Does FHA Require a Minimum Credit Score and How Is It Determined The servicer still reviews your credit history, but there is no hard floor set by HUD. For FHA loans closed on or after December 15, 1989, the servicer runs a full credit qualification review of the buyer.9U.S. Department of Housing and Urban Development. HUD 4155.1 Chapter 7 – Assumptions
Throughout underwriting, the seller stays responsible for every scheduled mortgage payment. A missed payment during this window can sink the assumption.
Signing the Assumption Agreement and Releasing the Seller
If the servicer approves, both parties sign a formal assumption agreement that legally binds the new borrower to the mortgage terms. The servicer updates its records to reflect the new borrower for billing, escrow, and tax reporting going forward.
Signing that agreement does not automatically release the seller from the loan, and this is the step most parties overlook. If the buyer later defaults, the original borrower can still be legally responsible for the debt. The release has to be requested and documented separately:
- FHA loans: the servicer must grant a release of liability when the assuming buyer is creditworthy and has agreed to take over the debt. The release is executed on HUD Form 92210.1, “Approval of Purchaser and Release of Seller.” Keep a copy; a future FHA lender will want to see it.10U.S. Department of Housing and Urban Development. HUD Form 92210.1 – Approval of Purchaser and Release of Seller11U.S. Department of Housing and Urban Development. Notice to Homeowner Release of Personal Liability for Assumptions of Mortgages
- VA loans with a private lender: the seller submits VA Form 26-6381 to request both assumption approval and release from personal liability to the government. The buyer must agree to assume the seller’s liability either through a clause in the deed or in a separate agreement. If the sale has already closed with an approved assumption clause in the deed, attach a recorded copy of the deed to the form. A veteran seller who wants to restore entitlement after the assumption files VA Form 26-1880 separately; restoration is not automatic.2Department of Veterans Affairs. VA Form 26-6381 – Application for Assumption Approval and Release From Personal Liability
- USDA Section 502 loans: the original borrower’s liability is not released even after the assumption is completed. Sellers need to go in understanding that.
Confirm in writing that your release has been processed before you consider the file closed. Years later, if your name is still on the loan because the paperwork was never finished, unwinding it is harder than filling out one more form today.
