To fill out Form I-765, download the current edition from the USCIS website, identify your eligibility category code from the form instructions, complete every section (including your identifiers and the Social Security request if you want a card), attach two passport-style photos and the supporting documents your category requires, sign in black ink, and file it online or mail it to the lockbox address that matches your category with the correct fee. The category code you enter in Part 2 controls everything else — the fee, the filing address, the documents you need — so that single field is where most avoidable denials start.
One change matters before you begin: USCIS ended the 540-day automatic extension of expiring work permits for renewals filed on or after October 30, 2025.1U.S. Citizenship and Immigration Services. Confirm You’re Eligible and Find Your Category Code
Not everyone needs an EAD, and not everyone qualifies. Refugees and people granted asylum are already authorized to work; they only file if they want a physical card to show employers.2U.S. Citizenship and Immigration Services. Instructions for Application for Employment Authorization Parolees and people with deferred action cannot work until USCIS approves an I-765.
Common eligibility categories include:
- Pending adjustment of status: (c)(9), when you’ve filed Form I-485 and want to work while it’s pending.
- Pending asylum: (c)(8). You can file 150 days after submitting your asylum application, and USCIS can approve once it has been pending 180 days.3U.S. Citizenship and Immigration Services. The 180-Day Asylum EAD Clock Notice
- F-1 Optional Practical Training: (c)(3)(A) pre-completion, (c)(3)(B) post-completion, and (c)(3)(C) for the 24-month STEM extension.
- Temporary Protected Status: (a)(12) for granted TPS holders; (c)(19) for applicants with prima facie eligibility.
- DACA: (c)(33).
- H-4 dependent spouses of certain H-1B holders: (c)(26).
Codes that look similar are not interchangeable. Someone with a pending asylum case enters (c)(8); someone already granted asylum enters (a)(5). Wrong code, wrong fee, wrong evidence, and often a lost filing fee. Working Through the Form
Start with the current edition of the form from the USCIS I-765 page. Look at the version date in the lower-left corner; an outdated edition gets your package rejected before anyone reads it.4U.S. Citizenship and Immigration Services. Application for Employment Authorization
Part 1: Reason for Applying
You’ll indicate whether you’re filing an initial application, a renewal, or a replacement for a lost, stolen, or damaged card. This choice interacts with Part 2 — a renewal in the wrong category code will bounce.
Part 2: Category Code and Personal Information
Item Number 27 is where you enter your eligibility category. Write it exactly as it appears in the instructions, including the parentheses: (c)(8), not c8.2U.S. Citizenship and Immigration Services. Instructions for Application for Employment Authorization
The rest of Part 2 asks for your full legal name, any other names you’ve used, current mailing address, date and place of birth, and your identifiers. You’ll need your Alien Registration Number (A-Number) if you have one, your I-94 Arrival/Departure Record number from your most recent entry, and your SEVIS number if you’re an F-1 or M-1 student. Account for every period in your employment and residential history; unexplained gaps often trigger a Request for Evidence, even when you were simply unemployed or between apartments.
The Social Security Number Request
The form includes a Social Security section where you can ask for an original or replacement Social Security card at the same time as the EAD. Fill in every field — your name, date of birth, both parents’ names, country of birth, and sex. Incomplete answers stop the Social Security Administration from processing the request. If USCIS approves the EAD, SSA mails the card separately, and you should have it within 14 days of receiving the EAD. Signature
Sign in black ink. An unsigned form is rejected automatically — no notice, no chance to fix it on the spot.
Photos and Supporting Documents
Include two identical passport-style color photographs taken within the last 30 days: white background, full-face view, no head coverings unless worn for religious or medical reasons. Do not retouch the images digitally; USCIS warns that edited photos will delay processing and may prompt an in-person identity check.4U.S. Citizenship and Immigration Services. What else you attach depends on your category, but most applicants send a copy of the passport biographical page or a prior EAD, plus the Form I-797C receipt notice for any underlying pending application, such as the I-485 for (c)(9) or the I-589 for (c)(8). Any document not in English needs a certified English translation.
Where and How to File
Some categories can file online through a USCIS account; others must file by mail. Filing method affects the fee amount.
Online Filing
The guided online workflow is open to F-1 OPT applicants under (c)(3)(A), (c)(3)(B), and (c)(3)(C); pending asylum applicants under (c)(8); TPS holders under (a)(12); pending TPS applicants under (c)(19); parolees under (c)(11); and DACA recipients under (c)(33).6U.S. Citizenship and Immigration Services. Paper Filing
Mailing addresses vary by category. Asylum applicants under (c)(8) file with the Dallas Lockbox, F-1 OPT applicants send theirs to the Chicago Lockbox, and H-4 spouses go to either Dallas or Phoenix depending on which service center previously handled their case.7U.S. Citizenship and Immigration Services. For immediate confirmation the lockbox received your package, clip a completed Form G-1145 to the front. USCIS will send a text or email with your receipt number as soon as the filing is accepted.8U.S. Citizenship and Immigration Services. E-Notification of Application/Petition Acceptance
Fees and How to Pay
The fee depends on your category and filing method; online and paper amounts differ. Check the current USCIS fee schedule before you file; amounts are adjusted periodically.
USCIS no longer accepts personal or business checks, money orders, or cashier’s checks for paper filings unless you qualify for a specific exemption. Pay by credit, debit, or prepaid card using Form G-1450, or directly from a U.S. bank account using Form G-1650. The paper-payment exemption (which lets you use a check or money order) requires showing that you lack access to banking services, that electronic payment would cause undue hardship, or that another exception applies.9U.S. Citizenship and Immigration Services. Fee Waivers
If you can’t afford the fee, submit Form I-912, Request for Fee Waiver, with your I-765. Waivers are available for most I-765 categories, though not for DACA applicants filing under (c)(33). The strongest evidence is proof that you, your spouse, or a household family member currently receives a means-tested public benefit; include a letter from the issuing agency showing the recipient’s name, benefit type, and dates confirming it’s active.10U.S. Citizenship and Immigration Services. What Happens After You File
USCIS mails Form I-797C, Notice of Action, as your official receipt once it accepts the application. It carries a 13-character receipt number you can use to check status through the USCIS online portal or the Contact Center.11U.S. Citizenship and Immigration Services. Form I-797C, Notice of Action Keep it. You may need it as interim proof of authorization, and you’ll need it if you move, get an RFE, or contact USCIS.
Some categories require a biometrics appointment at a local Application Support Center for fingerprints and a photograph; in other cases USCIS reuses previously captured data. If you receive a biometrics notice, don’t miss the appointment — a no-show can lead to denial.
Processing times vary by category and are published on the USCIS site, with medians ranging from under a month for pending asylum applicants to several months for adjustment-based and parole-based cases.12U.S. Citizenship and Immigration Services. If USCIS needs something you didn’t send, it issues a Request for Evidence spelling out exactly what’s missing. Response windows typically run 30 to 87 days depending on the notice. Miss the deadline and USCIS decides on what you originally filed, which usually means denial. Respond to every item listed, not just the ones that seem most important.
Move while your I-765 is pending and you have 10 days to notify USCIS. The fastest method is updating your address through your USCIS online account, which pushes the change into the case system almost immediately. You can also mail Form AR-11, but USCIS warns that paper submissions don’t automatically update pending cases.13U.S. Citizenship and Immigration Services. Speeding Things Up
Premium processing through Form I-907 is available only for F-1 students filing pre-completion OPT, post-completion OPT, or the STEM OPT extension. It guarantees USCIS action within 30 business days. The premium processing fee increased to $1,780 effective March 1, 2026. No other I-765 category qualifies.
If you don’t qualify, you can submit an expedite request. Approval is entirely discretionary and needs supporting documentation. The most common grounds are severe financial loss and urgent humanitarian situations.14U.S. Citizenship and Immigration Services. Expedite Requests Simply needing work authorization is not enough on its own, and filing a humanitarian-based application like asylum doesn’t automatically qualify you — you still need to show time-sensitive circumstances beyond the nature of the case.
Renewals and the End of the Automatic Extension
USCIS ended the 540-day automatic EAD extension for renewal applications filed on or after October 30, 2025.1U.S. Citizenship and Immigration Services. A gap in work authorization is a real possibility. File your renewal as early as your category allows — many categories permit filing up to 180 days before the current EAD expires — and consider an expedite request if job loss is imminent. If you filed a timely renewal before October 30, 2025, the older automatic extension rules may still apply to that case.16U.S. Citizenship and Immigration Services. Don’t Start Working Until It’s Approved
Working before your EAD is approved carries consequences beyond losing the job. Under federal immigration law, unauthorized employment can bar you from adjusting to permanent resident status. The bar applies whether the unauthorized work happened before or after you filed an adjustment application, and leaving the country and returning doesn’t erase it.17USCIS. Some groups are exempt, including immediate relatives of U.S. citizens, VAWA self-petitioners, special immigrant juveniles, and certain members of the U.S. armed forces. Employment-based applicants may also qualify for a separate exemption under INA 245(k).17USCIS.
