To fill out and file Form 1099-MISC, collect a Form W-9 from each payee, enter each reportable payment in the box assigned to its category, send Copy B to the recipient by January 31, and file Copy A with the IRS either electronically through the Information Returns Intake System or on official pre-printed paper accompanied by a Form 1096. For 2026, P.L. 119-21 raised the general reporting threshold under 26 U.S.C. ยง 6041 from $600 to $2,000 for most payment categories, so many payments that would have been reportable in prior years no longer are.1Internal Revenue Service. Which Payments Go on Form 1099-MISC
The form covers specific categories of miscellaneous income, each with its own dollar threshold. Non-employee compensation paid to independent contractors and freelancers does not go here; it belongs on Form 1099-NEC.2Internal Revenue Service. About Form 1099-NEC, Nonemployee Compensation
Payments that meet the $2,000 general threshold for 2026 include rents for office space or equipment used in your business, prizes and awards that are not for services, medical and health care payments to providers, crop insurance proceeds paid to farmers, and other taxable income such as punitive damages that does not fit another box.3Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information
Two categories carry a much lower threshold. Royalty payments and substitute payments in lieu of dividends or tax-exempt interest must be reported when they reach just $10.3Internal Revenue Service. About Form 1099-MISC, Miscellaneous Information Direct sales of consumer products totaling $5,000 or more for resale outside a permanent retail establishment also trigger a filing, and this applies to buy-sell, deposit-commission, and similar arrangements.4Office of the Law Revision Counsel. 26 USC 6041A – Returns Regarding Payments of Remuneration for Services and Direct Sales
Two payments must be reported no matter the amount. Gross proceeds paid to an attorney in connection with legal services go in Box 10 regardless of dollar amount, and fishing boat operators report proceeds paid to crew members treated as self-employed in Box 5.5Internal Revenue Service. Payees You Can Usually Skip
Payments to a corporation generally do not require a 1099-MISC. Two exceptions matter: medical and health care payments to a corporation must still be reported, and attorney fees paid to a law firm organized as a corporation are not exempt.6Internal Revenue Service. Rev. Proc. 2004-43 The W-9 a payee returns to you will indicate their entity type if you are not sure.
Payments to tax-exempt organizations under Section 501(a), to the United States government, or to a state or political subdivision are also exempt. So are payments for merchandise, telephone service, freight, and storage.6Internal Revenue Service. Rev. Proc. 2004-43 Watch mixed payments: if a repair bill covers labor and parts and the parts are incidental to the service, the entire amount is reportable.
Get a W-9 Before You Pay
You cannot complete a 1099-MISC without the payee’s correct Taxpayer Identification Number. Have each payee complete Form W-9, which captures their legal name, address, entity type, and TIN (a Social Security number, ITIN, or EIN).7Internal Revenue Service. Request for Taxpayer Identification Number and Certification Ask at the start of the business relationship, not in January.
If a payee refuses to provide a TIN or gives one that does not match IRS records, you must withhold 24% of each payment as backup withholding.8Internal Revenue Service. Backup Withholding The rate remains 24% for 2026.1Internal Revenue Service. Publication 15 (2026), (Circular E), Employer’s Tax Guide Report any backup withholding in Box 4 of the 1099-MISC, and remit the total across all payees on Form 945 for the year.

Filing Copy A With the IRS
Each completed form has multiple copies. Copy A goes to the IRS, Copy B goes to the recipient, and Copy C stays in your records. Keep your copy for at least three years.12Internal Revenue Service. How Long Should I Keep Records
Electronic Filing Through IRIS
If you file 10 or more information returns of any type during the year, you must file electronically.13Internal Revenue Service. E-File Information Returns The IRS’s free Information Returns Intake System is the primary channel. The IRIS Taxpayer Portal lets you key in up to 100 returns at a time or upload them by CSV, and you can download payee copies to distribute.14Internal Revenue Service. E-File Information Returns With IRIS
You need an IRIS Transmitter Control Code, a five-digit identifier that links your filings to your business. Apply for one on the IRS website before your first filing. High-volume filers with compatible software can transmit batches through the IRIS Application-to-Application channel.
Paper Filing
If you file fewer than 10 information returns, paper filing is allowed. Do not print Copy A from the IRS website. The online PDF is not scannable, and filing an unscannable form can trigger a penalty. Order official pre-printed forms at IRS.gov/EmployerForms or by calling 800-829-3676.9Internal Revenue Service. IRS Form 1099-MISC15Internal Revenue Service. Forms and Publications by U.S. Mail
Paper submissions require Form 1096 as a cover sheet summarizing the total number of 1099-MISC forms and the total dollars reported in the batch. Form 1096 is not used for electronic filings.16Internal Revenue Service. Deadlines

One exception: if you are only reporting amounts in Box 8 (substitute payments) or Box 10 (attorney gross proceeds), the recipient deadline extends to February 15.5Internal Revenue Service. Publication 1099 (2026), General Instructions for Certain Information Returns
For the IRS copies, paper returns are due by February 28 and electronic returns by March 31. If any deadline falls on a weekend or legal holiday, you have until the next business day.
Fixing a Form You Already Filed
If you find an error after filing, submit a corrected 1099-MISC. For paper corrections, follow Part H of the General Instructions for Certain Information Returns. For electronic corrections, use the IRIS portal or the A2A channel depending on how you originally filed.11Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
On paper corrections, do not check the “VOID” box. That box tells the IRS scanner to skip the form entirely, and your correction will never be processed. Mark the “CORRECTED” checkbox at the top of the form instead, and send the corrected copy to both the IRS and the recipient.
Penalties for Late or Incorrect Filings
The IRS imposes penalties per form for late, incomplete, or incorrect information returns. For 2026:18Internal Revenue Service. Information Return Penalties
- Filed up to 30 days late: $60 per form.
- Filed 31 days late through August 1: $130 per form.
- Filed after August 1 or not filed at all: $340 per form.
- Intentional disregard: $680 per form with no aggregate cap.
For intentional disregard, the penalty is the greater of $680 or 10% of the total amount you were required to report on the form, and no maximum cap applies.19Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns Aggregate caps do apply to the non-intentional tiers, and a small business (average annual gross receipts of $5 million or less over the prior three years) faces a lower maximum than a large filer.20Internal Revenue Service. 20.1.7 Information Return Penalties
Separate penalties apply for failing to furnish correct payee statements (Copy B) on time, and they mirror the amounts above. Filing Copy A correctly but forgetting to send the recipient their copy by January 31 can double your exposure, because the IRS treats the two obligations independently.
