How to File Taxes Late in Canada: Penalties, Refunds, and Relief

You can file taxes late in Canada by submitting the T1 Income Tax and Benefit Return for whichever year you missed, using that year’s tax package. If you owe a balance, the Canada Revenue Agency charges a late-filing penalty of 5% of the unpaid amount plus 1% for every full month the return is outstanding, to a maximum of 12 months.1Canada Revenue Agency. What You Need to Know for the 2026 Tax-Filing Season The standard deadline is April 30; self-employed filers and their spouses or common-law partners have until June 15 to file, but any balance owing is still due April 30. The CRA will accept returns going back many years, and there’s no penalty if you’re owed a refund, but the cost of waiting climbs quickly when you owe.

What Filing Late Actually Costs

The penalty is where procrastination gets expensive. On a $10,000 balance, 5% is $500 the day you’re late, and another $100 stacks on for each full month that passes. Twelve months in, the penalty alone is $1,700.2Justice Laws Website. Income Tax Act RSC 1985 c 1 (5th Supp) – Section 162

Repeat late filers get hit harder. If the CRA charged a late-filing penalty in any of the three preceding tax years and issued a formal demand to file, the rate doubles to 10% of the unpaid balance plus 2% per month for up to 20 months.3Canada Revenue Agency. Interest and Penalties on Late Taxes – Personal Income Tax Same $10,000 balance, twenty months late: $5,000 in penalty.

Interest runs separately. The prescribed rate for the first two quarters of 2026 is 7%, calculated from the original due date, and it compounds against the penalty as well as the tax.4Canada Revenue Agency. Interest Rates for the Second Calendar Quarter Filing stops the penalty from growing. Only paying stops the interest.

Self-employed filers should note one trap: the June 15 filing extension does not extend the payment deadline. Any tax you owe is still due April 30, and interest starts accruing May 1 if the balance isn’t paid.5Government of Canada. What You Need to Know for the 2026 Tax-Filing Season

Benefits That Stop When You Don’t File

The CRA uses your annual return to recalculate benefit eligibility every July. Miss the return, and the payments pause.

Canada Child Benefit payments are suspended until the CRA assesses your late return. Once processed, missed amounts you were entitled to arrive retroactively with your next scheduled payment.6Canada Revenue Agency. Keep Getting Your Payments – Canada Child Benefit (CCB) The GST/HST credit works the same way: quarterly payments stop until your return is on file, then back-payments follow.7Canada Revenue Agency. For seniors, the Guaranteed Income Supplement is the most immediate concern. GIS eligibility is reviewed each July using your federal return, and if the CRA can’t confirm your income, payments stop. Your July letter will state whether the benefit was renewed, adjusted, or suspended.8Government of Canada. Guaranteed Income Supplement – Receiving Your Benefit Late filing doesn’t disqualify you, but restarting the payments requires the return and a reassessment.

The Ten-Year Cutoff for Refunds

If the CRA owes you rather than the other way around, there’s no late-filing penalty. But there is a deadline for collecting. Under subsection 164(1.5)(a) of the Income Tax Act, the CRA cannot issue a refund or apply a credit for any return filed more than ten years after the end of the tax year involved. A refund claim for the 2015 tax year expires at the end of 2025.

The same ten-year window applies to penalty and interest relief. Any request must relate to a tax year ending within the ten calendar years before the year you apply.9Canada Revenue Agency. Documents You’ll Need

Reconstructing an older year is usually the hardest part. You need your Social Insurance Number and the information slips for the tax year you’re filing. The common ones are T4s for employment income, T4As for pensions and other payments, T5s for investment income, and T5007s for social assistance or workers’ compensation.10Canada Revenue Agency. Tax Slips – Personal Income Tax

Lost the paper copies? Your CRA My Account portal holds a digital record of every slip that employers, banks, and government programs reported to the agency. A tax preparer authorized through Represent a Client can pull them the same way. The CRA won’t have receipts you generated yourself — donations, childcare costs, medical expenses — so you’ll need those separately, but the slips give you a solid base.

Keep supporting documents for at least six years from the date you file. On a late return, the six-year clock starts from filing, not from the original tax year, so a 2019 return filed in 2026 means holding onto records until at least 2032.11Canada Revenue Agency. Using the Right Year’s Tax Package

You have to use the T1 package that matches the year you’re filing. Brackets, credits, and deduction rules change every year, so a 2020 return has to be calculated on 2020 rules. The CRA posts archived packages going back ten years, and older packages live in the Government of Canada Web Archive.12Canada Revenue Agency. All Personal Income Tax Packages Each package contains that year’s T1 general return, the federal and provincial schedules, and a guide explaining the rules in force at the time.

If you were a Quebec resident during the year you’re filing, you have a second return to complete. Quebec administers its own income tax through Revenu Québec, so you need the federal T1 plus a provincial TP-1. The provincial late-filing penalty is 5% of the unpaid balance plus 1% per full month late, separate from and on top of the federal penalty.13Revenu Québec. Late-Filing Penalties

How to Submit the Return

NETFILE currently accepts electronic returns for tax years 2018 through 2025.14Canada Revenue Agency. NETFILE – Tax Software for Filing Personal Taxes For anything before 2018, print the completed T1 and mail it to the Tax Centre that handles your province; the correct address is on the CRA contact page based on where you live now.

The CRA aims for four weeks on electronic returns and eight weeks on paper.15Canada Revenue Agency. Check CRA Processing Times Late returns and any return flagged for review run longer.

Filing multiple years? File them in chronological order, oldest first. Credits and carryforward amounts flow from earlier years into later ones, and out-of-order filing can trigger reassessments that slow the whole stack down.

If You Can’t Pay the Balance

File anyway. The late-filing penalty is almost always the biggest number, and it stops growing the day the CRA receives the return. Interest keeps running on the tax owed, but you’ve capped the largest cost.

You can set up a payment arrangement through My Account with pre-authorized debit, or by calling 1-866-256-1147 for personal income tax debt. The CRA will expect you to work through their personal income and expense worksheet to determine what you can afford, make a first payment, and keep filing future returns on time while the arrangement runs.16Government of Canada. Arrange to Pay Your Debt Over Time Miss payments without calling to renegotiate and the CRA can garnish wages, freeze bank accounts, or register liens against property. Interest continues throughout the payment period.

Programs That Can Reduce What You Owe

Two separate programs can cut the penalty side of a late filing, and they work at different points.

The Voluntary Disclosures Program is used before or at the time you file to proactively disclose unfiled returns or unreported income. If your application is accepted, the CRA will not refer you for criminal prosecution and may grant partial or full relief from penalties. The tax and some interest still have to be paid.17Canada Revenue Agency. Voluntary Disclosures Program You apply on Form RC199, and to qualify the disclosure has to be voluntary (the CRA hasn’t already contacted you about it, opened an audit, or demanded the return), complete (all years and amounts included), tied to a situation where a penalty would apply, and overdue by at least one year.18Canada Revenue Agency. RC199 Voluntary Disclosures Program (VDP) Application The VDP is most useful when significant unreported income, offshore assets, or many unfiled years are involved. For one or two years with a modest balance, standard filing plus a payment arrangement usually does the job.

Taxpayer relief works after the fact, once penalties and interest have already been assessed. The CRA can cancel or reduce them when circumstances outside your control kept you from filing on time — natural disasters, serious illness, the death of an immediate family member — or when financial hardship means paying the interest would prevent you from affording food, shelter, or medical care.9Canada Revenue Agency. Cancel or Waive Penalties and Interest at the CRA Meeting the criteria doesn’t guarantee relief; the CRA decides case by case, and the request must relate to a tax year ending within the last ten calendar years.

Watch for the Unreported Income Penalty

Filing late is one problem. Filing incompletely is another, and it carries its own penalty. If you leave $500 or more of income off a return and the same thing happened in any of the three preceding tax years, the CRA charges the lesser of 10% of the unreported amount or 50% of the extra tax that reporting it would have produced.19Canada Revenue Agency. False Reporting or Repeated Failure to Report Income It applies federally and provincially.

When you’re reconstructing a return years after the fact, check every slip in your My Account records against what you’re reporting. A forgotten T4A from a side gig or investment income from a closed account is exactly the kind of omission the CRA catches when it cross-references its records against your return, and the penalty can land long after you thought the file was closed.
