How to File Form BOC-3: Requirements, Process, and Keeping It Current

To file Form BOC-3, the Designation of Agents for Service of Process, you name a process agent with a physical street address in every state where you need coverage, and that agent electronically submits the form to the FMCSA on your behalf. There is no government filing fee.¹ Motor carriers cannot file it themselves; only the process agent can submit it for them. Brokers and freight forwarders that do not operate commercial motor vehicles are allowed to file on their own behalf.²

A process agent is just a representative at a physical address in a given state who can receive court papers or government notices if someone brings a legal action against your company there. You need an active BOC-3 on file before FMCSA will grant your operating authority.

Who Files and Which States You Cover

Federal rules under 49 CFR Part 366 apply to for-hire and private motor carriers, brokers, and freight forwarders, including carriers based in Mexico or Canada that operate in the United States.³⁴ How many states you cover depends on the type of authority:

Motor carriers designate an agent in all 48 contiguous states and the District of Columbia, unless their authority is limited to fewer states. Carriers operating exclusively in Alaska or Hawaii designate an agent only for that state.⁵
Brokers designate agents for each state where they have an office or write contracts.⁵
Freight forwarders follow the same rule as brokers: an agent in each state with an office or where contracts are written.⁵

Most carriers with nationwide authority end up needing all 49 jurisdictions covered. That is why blanket process agent services exist. One company lists itself across the whole form.

What to Have Ready

Before the filing goes in, pull together your legal business name and address exactly as they appear in your FMCSA registration, your USDOT number, and your MC, FF, or MX number, whichever applies. A small mismatch on the name or address can cause processing problems.

You also need the name and street address of a process agent for each required state. Every agent must have a physical address in the state they represent. A post office box will not work.² If you use a blanket service, that company supplies the addresses.

How the Filing Happens

In practice, a motor carrier hires a process agent service and that service files the BOC-3 electronically into the FMCSA system. Electronic filings typically show up in the Licensing and Insurance system within a day or two. FMCSA itself charges nothing.¹ Third-party service fees vary. Some providers advertise a one-time filing fee in the $20 to $50 range; others charge an annual fee that covers monitoring and change filings. Confirm before you sign up whether the quoted price is a one-time charge or a recurring subscription, and whether it includes future amendments.

You should also send a signed copy to each state where you designated an agent and keep one for your records. Paper filings sent to Washington take considerably longer to process than electronic submissions, sometimes several weeks.

Confirming the Filing Went Through

Once the agent submits the form, look up your MC or USDOT number in the FMCSA Licensing and Insurance public portal to check that the process agent designation shows on file.⁶ Do this soon after filing so any problem gets caught before it affects your authority.

Keeping the Designation Current

Changes are made by filing a new BOC-3. On an update, you only need to send copies to the states affected by the change, not every state on the original filing.² Any change to a designation, including name, address, or contact information, must be reported to FMCSA within 30 days, and you also need to notify your process agents or blanket designation company within that same window.⁷

Common triggers for a new filing:

A company name change. You will also need to file Form MCSA-5889 with FMCSA to update your carrier records separately.⁸
A business address change, which means updating both your BOC-3 and your FMCSA registration records.
Switching process agent companies. Your new provider files a replacement BOC-3 that supersedes the old one.

Missing the 30-day window does not trigger an automatic fine, but the gap can lead to suspension of your authority once FMCSA notices.

If Your BOC-3 Is Invalid or Missing

If FMCSA determines the designation is invalid or missing, it can issue an Order to Show Cause under 49 USC 13905 proposing suspension of your operating authority. You have 30 days from that order to file a new, valid BOC-3 or show that the existing designation is still good. Do nothing, and FMCSA may issue a final suspension pulling your authority.⁹ A suspended authority means you cannot legally operate as a for-hire carrier, broker, or freight forwarder until it is resolved.

Reinstatement takes two steps: file a valid BOC-3 with the corrected or new process agent designation, then request reinstatement through Form MCSA-5889, which you can submit through the Ask FMCSA web portal.⁸ FMCSA charges an $80 fee to reinstate revoked authority.¹⁰ Authority is usually active again within about a week of FMCSA receiving the application and valid payment.¹¹
