To file Form 10E, log in to the income tax e-filing portal at incometax.gov.in, go to e-File → Income Tax Forms → File Income Tax Forms, select Form 10E for the assessment year in which you received the lump sum, complete the Annexure that matches your payment type, and e-verify the submission. Do all of this before you file your Income Tax Return for that year. If you claim Section 89(1) relief on your ITR without a Form 10E already on record, the Centralized Processing Centre will process the return but disallow the relief entirely.1Income Tax Department. Check That Your Payment Actually Qualifies
Form 10E only works for the five categories listed in Rule 21A of the Income-tax Rules, 1962. If your payment isn’t in this list, the form has nothing to offer you.
- Salary arrears or advance salary that pushed you into a higher bracket than you would have faced had the money arrived on time. This is by far the most common trigger, usually a pay commission revision or a delayed raise paid in a lump sum.
- Family pension arrears received by a legal heir as a lump sum.2Income Tax Department. Form 10E User Manual
- Gratuity for past services of five years or more.3Indian Kanoon. Section 21A(1) in Income Tax Rules, 1962
- Compensation on termination, but only where you completed at least three years of continuous service and the unexpired portion of your term was also at least three years.4Income Tax Department. Form 10E Income Tax India
- Commuted pension, where the taxable portion above the exemption ceiling can go through Form 10E.
Regular annual bonuses, commissions, and performance incentives do not qualify. They are ordinary income for the year they are paid. Voluntary retirement compensation is a separate case: if you have already used the Section 10(10C) exemption on a VRS payment, you cannot also claim Section 89(1) relief on that same amount.
What to Gather Before You Log In
The portal doesn’t save partial entries well, and hunting for old documents mid-session is where errors creep in. Have everything on your desk first.
- The arrears breakdown letter or salary slip from your employer showing the lump sum amount and which financial years it relates to. Without this, you cannot split the arrears correctly across prior years.
- Form 16 for the current year and for every past year to which the arrears relate.
- Your filed ITRs for those prior years. The taxable income figures you enter in Form 10E must match what you originally reported.
- Form 26AS or AIS for each relevant year, so you can cross-check TDS credits.
- Current-year salary details, split between regular salary and the arrears component.
Filing Form 10E Step by Step
The whole process is online. There is no PDF to print or paper to mail.5Income Tax Department. Form 10E FAQ
- Log in at incometax.gov.in with your PAN and password.
- Go to e-File → Income Tax Forms → File Income Tax Forms.
- Search for or select Form 10E from the list.
- Choose the Assessment Year in which you received the lump sum. This is the current year, not the year the income was originally due.
- On the “Let’s Get Started” screen, tick the income categories that apply: salary arrears, gratuity, termination compensation, or commuted pension.
- Confirm your PAN, name, and address, then save.
- Work through each applicable Annexure tab. Enter current-year and prior-year income and tax figures. Save each tab before moving to the next.
- Review everything on the Preview screen. The portal auto-calculates some totals, but it only checks what you entered against itself. A wrong prior-year figure will pass the preview and surface later when the CPC cross-references your original return.
Which Annexure to Fill
Form 10E is not one page. It contains separate Annexures, and you pick only the ones that match your payments.2Income Tax Department. Form 10E User Manual
- Annexure I: salary arrears, family pension arrears, or advance salary. Most filers use this one.
- Annexures II and IIA: gratuity for past services of five years or more.
- Annexure III: compensation on termination of employment.
- Annexure IV: commutation of pension.
If you received more than one qualifying payment in the same year, complete each relevant Annexure inside the same Form 10E filing. The portal lets you select multiple categories at the start.
How the Relief Is Computed
Knowing the calculation matters even when the portal does part of it, because the figures you type in come from this logic. You are comparing two things: the extra tax the arrears cost you this year, and the extra tax those same arrears would have cost had they been paid in the year they were due. If the current year costs more, the difference is your relief. If it doesn’t, there is no relief to claim.
For salary arrears in Annexure I, the sequence runs:
- Tax on current-year total income including the arrears.
- Tax on current-year total income excluding the arrears.
- Step 1 minus Step 2. This is the extra tax caused by receiving the arrears now.
- Tax on the prior-year income you actually reported (no arrears).
- Tax on that same prior-year income plus the arrears amount attributable to that year.
- Step 5 minus Step 4. This is the tax the arrears would have generated on time.
- If Step 3 exceeds Step 6, the difference is your relief. If not, no relief.
Every tax figure must include the applicable surcharge and the 4% Health and Education Cess.6Income Tax Department. Tax Rates Use the slab rates that were in force for each respective year. If the arrears cover several past years, repeat Steps 4 through 6 for each year separately and add the results before comparing with Step 3.
E-Verifying the Submission
After you click “Proceed to e-Verify,” authenticate the filing using one of the accepted methods:7Income Tax Department. How to e-Verify User Manual
- Aadhaar OTP sent to your Aadhaar-linked mobile number. Usually the fastest.
- A Digital Signature Certificate registered against your PAN.
- Electronic Verification Code generated through a pre-validated bank or demat account.
- Net banking, if your bank supports e-filing integration.
Once verified, the portal issues an acknowledgment number. Save it and download the PDF of the submitted form. Both are your proof if the tax department raises a query later. No physical signatures or paper follow-up are required.
Timing and What Happens If You Already Filed the ITR
Form 10E must sit on the portal before your ITR is processed for that assessment year. File the ITR first with a Section 89(1) claim and no Form 10E, and the CPC will strip the relief out. You’ll get an intimation under Section 143(1) showing a higher liability than you expected, plus a demand for the difference.
If you have already filed the return without submitting Form 10E, file the form now and then file a revised return claiming the relief, so long as you are still within the window for a revised return for that assessment year. What matters is that the Form 10E exists on the portal before the return claiming the relief is processed.
Getting the Prior-Year Figures Right
The single most common Form 10E problem is prior-year taxable income that doesn’t match what was originally reported. The portal cross-references your entries with the returns already on file. If your Form 10E shows ₹6,00,000 for a prior year but the filed return for that year shows ₹5,80,000, the mismatch can produce a notice or a downward adjustment to your relief.
Pull the exact taxable income figure from your filed return for each relevant year. Not from memory, not from a salary slip, not from an estimate. Where arrears cover multiple prior years, each year’s share must be identified separately, which is what the employer’s arrears breakdown letter is for.
When you compute the hypothetical prior-year tax, use the slab rates and exemption limits that applied in those years. The portal handles some of this automatically if you enter the assessment year correctly, but verify the output against your own working.
Penalties for Wrong Entries
Claiming Section 89(1) relief you are not entitled to — through inflated arrears, fabricated prior-year income, or applying the form to payments that don’t qualify — falls under Section 270A. Underreporting income due to a calculation error attracts a penalty of 50% of the tax payable on the underreported amount. If the department finds the misreporting was deliberate, the penalty rises to 200% of the tax payable on the misreported income.8Income Tax Department. Section 270A Interest under Sections 234B and 234C can also apply to the tax shortfall.
In practice, most trouble comes from careless data entry rather than intent: the wrong prior-year income figure, the wrong assessment year, arithmetic that doesn’t reconcile with the filed return. These usually don’t draw the 200% penalty, but if the CPC adjusts your relief and the shortfall crosses the threshold, the 50% underreporting penalty is on the table. Check every number against your source documents before you submit.
