You can file Chapter 7 bankruptcy online for free only if the court waives the $338 filing fee, which it will do when your household income is below 150 percent of the federal poverty line and you can’t pay even in installments. The official forms are free to download, and roughly 29 of the 90 federal bankruptcy courts offer an Electronic Self-Representation (eSR) tool that lets people without a lawyer prepare and submit a petition online. Everything below walks through qualifying, preparing, filing, and surviving the months after you file.
Make Sure You Actually Qualify for Chapter 7
Two gates decide whether Chapter 7 is open to you. The first is the means test in 11 U.S.C. § 707(b), which compares your average monthly income over the six months before filing to the median income for a household of your size in your state.1Office of the Law Revision Counsel. 11 U.S. Code 707 – Dismissal of a Case or Conversion to a Case Under Chapter 11 or 13 Below the median, you pass. Above it, a longer calculation subtracts allowed expenses to see whether you have enough disposable income to repay creditors in a Chapter 13 plan instead. The U.S. Department of Justice publishes the Census Bureau median figures used in the calculation.2United States Department of Justice. Means Testing
The second gate is the eight-year rule. If you received a Chapter 7 discharge in a case filed within the last eight years, the court will deny a second discharge.3Office of the Law Revision Counsel. 11 USC 727 – Discharge The clock runs from the filing date of the earlier case, not from when the discharge was entered. Check both gates before doing anything else.
What “Free” Really Means
The total out-of-pocket filing cost is $338, combining a $245 statutory fee, a $78 administrative fee, and a $15 trustee surcharge.4Office of the Law Revision Counsel. 28 USC 1930 – Bankruptcy Fees5United States Courts. Bankruptcy Court Miscellaneous Fee Schedule The court can waive the whole thing if your household income falls below 150 percent of the federal poverty guidelines and you can’t pay in installments.
For 2026, the poverty guideline for a single person in the 48 contiguous states is $15,960, putting the 150 percent threshold around $23,940 a year. For a household of four, the guideline is $33,000, so the threshold is roughly $49,500.6HHS ASPE. 2026 Poverty Guidelines You apply using Official Form 103B, which asks for a line-by-line breakdown of your monthly income and expenses.7United States Courts. Application to Have the Chapter 7 Filing Fee Waived
If you earn too much for the waiver but can’t produce $338 in a lump sum, you can ask to pay in up to four installments. All payments must be made within 120 days of filing, and the court can extend to 180 days for good cause.8Cornell Law Institute. Federal Rules of Bankruptcy Procedure – Rule 1006 Filing Fee
One honest footnote on “free”: the two mandatory financial education courses (described below) typically cost between $10 and $50 each, though approved agencies may reduce or waive fees for people who can’t afford them. Budget for them even if your filing fee is waived.
Complete Credit Counseling First
Before the court will accept your petition, you must complete a credit counseling session from an agency approved by the U.S. Trustee Program. The session has to happen within 180 days before you file. The Department of Justice maintains a searchable list of approved agencies by state and judicial district.9United States Department of Justice. List of Credit Counseling Agencies Approved Pursuant to 11 USC 111 Most offer the session online or by phone, and it runs about an hour. You get a certificate that must be filed with your petition. Filing without a valid certificate is one of the most common reasons pro se cases get dismissed on day one.
Gather Your Financial Records
Pulling your records together before you open a single form will save hours of frustration. You will need:
- Your federal tax return for the most recent year. A copy must reach the trustee no later than seven days before the 341 meeting.10Office of the Law Revision Counsel. 11 USC 521 – Debtor Duties
- Pay stubs or other income records covering the 60 days before filing.11United States Courts. Chapter 7 – Bankruptcy Basics
- A complete list of every creditor with names, mailing addresses, account numbers, and exact balances. Include debts you think may be too old or too small. Every creditor needs notice.
- A property inventory: bank balances, vehicles, household goods, real estate, investments, anything you own.
- Your monthly expenses: rent or mortgage, utilities, food, insurance, transportation, and other recurring costs.
Guessing at figures or leaving blanks invites dismissal or, worse, suspicion that you’re concealing assets.
Fill Out the Required Forms
All official bankruptcy forms are free to download from the U.S. Courts website.12United States Courts. Bankruptcy Forms The core package runs to roughly two dozen documents. The ones that carry the most weight:
Official Form 101 is the voluntary petition. It captures your name, address, the last four digits of your Social Security number, and which chapter you’re filing under.13United States Courts. Voluntary Petition for Individuals Filing for Bankruptcy Schedules A/B through J then break your finances into categories: property owned (A/B), secured debts like a car loan or mortgage (D), unsecured debts like credit cards and medical bills (E/F), income (I), and monthly expenses (J). Schedule C is where you list the exemptions that protect your property.
Form 122A-1, and if needed 122A-2, are the means test calculations. If you’re seeking a fee waiver, Form 103B goes in the same package. Every number should match your source documents; inconsistencies between your means test income and your pay stubs draw trustee scrutiny fast.
Form 108, the Statement of Intention, is easy to miss. It tells the court and your creditors what you plan to do with secured property: surrender it, reaffirm the debt, or redeem the property. File it within 30 days of the petition date and follow through within 30 days after the 341 meeting.
Submit Your Petition Online
Roughly 29 of the 90 federal bankruptcy courts offer Electronic Self-Representation (eSR), a tool built for people filing without an attorney. You answer a series of questions, the system fills in the official forms, you sign electronically (which carries the same legal weight as a wet signature), and the system submits everything to the court. Districts in Arizona, Maryland, New Jersey, Oregon, and about two dozen others participate.
If your local court doesn’t offer eSR, download the blank forms, fill them in as PDFs, and either use the court’s standard electronic filing system (if it permits pro se electronic filing) or print and deliver them to the clerk’s office in person or by mail. Check your local bankruptcy court’s website for its specific procedure.
Once the court accepts your petition you get a case number, and the automatic stay takes effect immediately. The stay is a federal court order that forces creditors to stop collection calls, lawsuits, wage garnishments, and most other collection activity.14Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Relief is near-instant for you, though individual creditors may take a few days to update their systems once they get notice.
What Happens After You File
The Limits of the Automatic Stay
The stay is powerful but not total. It doesn’t stop criminal proceedings, and it doesn’t block actions to establish or collect domestic support like child support and alimony.14Office of the Law Revision Counsel. 11 USC 362 – Automatic Stay Tax audits, paternity actions, and certain government regulatory actions also keep moving. Secured creditors who think their collateral is losing value can ask the court to lift the stay on that specific asset.
The 341 Meeting of Creditors
The court schedules the 341 meeting between 21 and 40 days after filing. A bankruptcy trustee runs it; the judge is not present. The trustee puts you under oath and asks about your income, assets, debts, and claimed exemptions.15Office of the Law Revision Counsel. 11 U.S. Code 341 – Meetings of Creditors and Equity Security Holders Creditors can attend but usually don’t in consumer cases.
Bring a government-issued photo ID and proof of your Social Security number. Many courts now hold these by phone or video. The whole thing often takes under ten minutes if your paperwork lines up. Missing it is grounds for dismissal.
The Debtor Education Course and Discharge
After filing, you have to complete a second course, this one on personal financial management, which is different from the pre-filing credit counseling. The certificate must reach the court within 60 days of the first date set for your 341 meeting. Skip it and the court will close your case without discharging any debts, meaning you went through the whole process for nothing.11United States Courts. Chapter 7 – Bankruptcy Basics
If everything goes smoothly, the discharge order usually arrives about 60 days after the 341 meeting, so three to four months from the filing date. It permanently eliminates your personal liability for qualifying debts.
What Property You Keep
Chapter 7 is called liquidation bankruptcy because the trustee can sell non-exempt property to pay creditors. In practice, most consumer cases are “no-asset” cases where exemptions cover everything the filer owns. Federal exemptions in 11 U.S.C. § 522(d) protect specific dollar amounts of different property types. As of the April 2025 adjustment, the key federal amounts include:16Office of the Law Revision Counsel. 11 USC 522 – Exemptions
- Up to $31,575 in equity in your primary residence (homestead).
- Up to $1,675 of any property under the wildcard, plus up to $15,800 of any unused homestead portion. Renters who skip the homestead get the full wildcard.
- A set amount in one motor vehicle, adjusted periodically.
- Separate amounts for household goods, clothing, furniture, and appliances.
Roughly half the states let you choose between federal and state exemptions; the other half require state exemptions. You can’t mix: pick one system and use it entirely. If you own a home with real equity, a state homestead may protect more. If you rent and own mostly personal property, the federal wildcard is often more generous. Choosing wrong can cost you property, and this is one place where a lawyer’s input is worth seeking even if you otherwise plan to file alone.
Debts That Chapter 7 Does Not Erase
Several categories of debt are excluded from discharge by federal law, and careful form-filling won’t change that. The major non-dischargeable debts:
- Domestic support obligations such as child support and alimony survive in full.17Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge
- Most student loans, federal and private, unless you prove repayment would be an “undue hardship,” a standard courts read narrowly.17Office of the Law Revision Counsel. 11 U.S. Code 523 – Exceptions to Discharge
- Recent income taxes, taxes where no return was filed, and taxes involving fraud.
- Debts from fraud, false pretenses, embezzlement, or intentional injury to another person or their property.
- Criminal fines and court-ordered restitution.
A creditor can also file an adversary proceeding, basically a lawsuit inside the bankruptcy, to argue a specific debt should not be discharged. Those objections generally have to be raised within 60 days of the 341 meeting.
Co-Signers and Credit Impact
A Chapter 7 bankruptcy stays on your credit report for ten years from the filing date.18Office of the Law Revision Counsel. 15 USC 1681c – Requirements Relating to Information Contained in Consumer Reports The impact fades over time, and many people qualify for new credit within a year or two of discharge.
If anyone co-signed a loan for you, bankruptcy does not protect them. Your discharge eliminates your obligation, but the co-signer’s remains. The automatic stay halts collection against you, not against them, so creditors can turn to the co-signer for the full balance the moment you file. Have the conversation first.
Honest Risks of Filing Without a Lawyer
Filing pro se is legal and thousands of people do it every year. The real danger isn’t usually getting the case dismissed; it’s losing property you could have protected with better exemption choices, or triggering a problem a lawyer would have spotted in advance.
Common pro se mistakes include listing only the debts you want discharged instead of every creditor, failing to disclose all assets (which can be treated as fraud), choosing the wrong exemption system, missing the debtor education deadline, and showing up to the 341 meeting without the required ID. Any of these can mean dismissal, loss of assets, or denial of discharge.3Office of the Law Revision Counsel. 11 USC 727 – Discharge
If your situation is straightforward (below median income, no real estate, no recent large transactions, debts mostly credit cards and medical bills), filing on your own is realistic. If you own a home, run a business, have transferred property recently, or face debts that might draw fraud claims, the stakes rise sharply. Many bankruptcy attorneys offer free initial consultations, and some legal aid organizations provide free representation to people who qualify based on income.
