First, Check Whether Your Court Offers eSR
Only about 29 of the 90 federal bankruptcy courts currently support Electronic Self-Representation. Courts in districts including California Central, New York Eastern, Illinois Northern, and New Jersey offer it. Many do not. If yours does not, you will prepare the same forms but file them in person or by mail at the clerk’s office. The legal requirements are identical either way; only the delivery method changes.

Confirm You Qualify Under the Means Test
Not everyone can file Chapter 7. Gather Your Documents Before You Open the Portal
The online system asks for detailed financial information. Having records in hand keeps the filing moving; estimating figures when the real documents exist is one of the fastest ways to draw trustee objections. - A complete creditor list with the legal name and current mailing address for every person or company you owe. Missing a creditor can leave that debt unpaid and un-discharged.
- An asset inventory covering real estate, vehicles, bank accounts, retirement funds, and household items.
- Pay stubs (payment advices) from all employers for the 60 days before filing. This is separate from the six-month income period used in the means test.

- A monthly budget showing actual living expenses: housing, food, utilities, transportation, insurance, child support.

The Petition and Schedules

- Schedules A/B list all real estate and personal property you own.

To file through eSR, create a secure account on your court’s website, work through the guided interface, and upload supporting documents as PDFs. You can save progress and return. Most courts accept a “/s/” followed by your printed name as a valid electronic signature.

Form 103A lets you pay in up to four installments over 120 days. Form 103B requests a full waiver if your income is below 150% of the federal poverty line; the court decides based on your circumstances.
Once the system accepts your petition, it generates a case number and confirmation. Keep the case number where you can find it, because it is what triggers the automatic stay and what you will give any creditor who contacts you after filing.
What Happens After You File
The instant the petition reaches the court, federal law freezes most collection activity against you. This automatic stay stops lawsuits, wage garnishments, collection calls, repossessions, foreclosures, and bank levies, and it prevents utility shutoffs based solely on unpaid pre-filing bills.12Office of the Law Revision Counsel. 11 USC 362 Automatic Stay It does not stop criminal proceedings, child support or alimony collection, most tax audits, or evictions where the landlord already holds a judgment for possession. Creditors can also ask the court to lift the stay, which happens most often when a debtor falls behind on car payments or post-filing rent.
The court assigns a bankruptcy trustee to your case. The trustee reviews your petition, looks for non-exempt assets that could be sold to pay creditors, and runs the meeting of creditors, known as the 341 meeting after the statute that requires it.13Office of the Law Revision Counsel. 11 USC 341 Meetings of Creditors and Equity Security Holders
The 341 meeting is usually set 21 to 40 days after filing, and in many districts it is held by phone or video. Under oath, the trustee asks a standard set of questions: whether you signed and reviewed your petition, whether all assets and creditors are listed, whether you have filed bankruptcy before, and whether you are due any tax refunds or lawsuit proceeds. Creditors have the right to attend, though most do not. You must give the trustee your most recent federal tax return at least seven days before the meeting.7Office of the Law Revision Counsel. 11 USC 521 Debtor Duties Missing the meeting or failing to send the documents will get your case dismissed.
Finish the Case: Debtor Education and Discharge
After filing but before you can receive your discharge, you have to complete a second course: the debtor education, or personal financial management, course. This is separate from the pre-filing counseling and covers budgeting, money management, and credit. It must come from a U.S. Trustee-approved provider and can usually be completed online.
You have to file the completion certificate with the court. If you do not, the court closes the case without granting a discharge, which means the entire filing was for nothing. A surprising number of cases fall apart here.
Assuming everything else goes smoothly, the court issues the discharge order roughly 60 to 90 days after the first date set for the 341 meeting, making the overall process about three to four months from the filing date in a straightforward case. The order permanently eliminates your qualifying debts and bars creditors from trying to collect them.
Know What Chapter 7 Will Not Wipe Out
Before filing, it is worth knowing that Chapter 7 does not erase everything. Federal law carves out several categories that survive bankruptcy no matter what.14Office of the Law Revision Counsel. 11 USC 523 Exceptions to Discharge Child support and alimony are untouched. Most recent income taxes, unfiled-return taxes, and fraud-related taxes stay. Student loans are not automatically discharged; you have to file a separate adversary proceeding and prove undue hardship, a historically high bar, though the Department of Justice has created a more standardized review for federal student loans. Debts from fraud, willful injury, and government fines or restitution also survive. So do debts you leave off your schedules if the creditor did not learn of the bankruptcy in time to participate.
Liens survive too. A discharge eliminates your personal obligation on a mortgage or car loan, but the lien stays attached to the property, so the lender can still repossess or foreclose if you stop paying.
