When to File

H4 status runs with the H1B principal’s status. Whenever the H1B holder extends, every H4 dependent needs to extend too, and your requested dates should match the H1B extension dates.2American Immigration Council. The H-4 Visa Classification

USCIS recommends filing at least 45 days before your I-94 expiration date. If USCIS receives your application before your authorized stay ends, you’re generally allowed to remain in the country while it processes. You have two workable timing patterns. You can file the H4 extension at the same time the H1B principal files Form I-129, sending everything as one package. Or you can file separately later using a copy of the H1B principal’s receipt notice or approval notice as evidence that the underlying petition exists.1USCIS. Documents to Gather Before You Start

Assemble everything before you open the form. An incomplete filing invites a Request for Evidence, and an RFE can add months. USCIS specifies the following for H4 dependents:

  • A copy of the front and back of the most recent Form I-94 for each person on the application.
  • Relationship evidence: marriage certificate for a spouse, birth certificate for a child. If either spouse was previously married, include proof the earlier marriage ended.
  • Proof of the H1B principal’s status. Photocopies are fine. USCIS does not require originals unless it later asks for one through an RFE.

Filling Out Form I-539

Enter biographical information exactly as it appears on your passport and I-94. Small mismatches cause real delays. For the requested period of stay, use the same dates the H1B principal is requesting or has been approved for. Part 8 asks how you’re being supported financially. If you’re not employed, state that the H1B principal supports the household and give the principal’s annual salary. Wherever the form asks for the principal’s details, include their name, date of birth, and the receipt number from their most recent I-797.

Adding Family Members With Form I-539A

Each additional family member beyond the primary applicant needs a separate Form I-539A attached to your I-539. A common setup has a spouse as the main applicant with one or more children as co-applicants. Fees and Whether You Can Pay for Speed

USCIS charges a filing fee for Form I-539 that has to accompany the application. Fees change, so check the USCIS Fee Calculator before filing to confirm the current amount.4U.S. Citizenship and Immigration Services. Calculate Your Fees Paper filers pay by check or money order made out to “U.S. Department of Homeland Security.” Online filers can use a credit or debit card.

The $85 biometric services fee no longer applies to Form I-539. Most H4 applicants won’t be scheduled for biometrics at all. Premium processing is not available for a standalone I-539. It’s available on the H1B principal’s Form I-129. When the H4 extension is filed together with the principal’s I-129 and the principal pays for premium processing, USCIS adjudicates the H4 application alongside the I-129.6U.S. Citizenship and Immigration Services. Where to Submit It

Online

You can file Form I-539 online if two things are true: you’re applying only for yourself, and you won’t use an attorney or accredited representative at any point in the case.7U.S. Citizenship and Immigration Services. Family members can each file separate online applications, but each pays a full fee. For most families, paper filing with one shared fee is the cheaper choice.

By Mail

Paper applications go to a USCIS Lockbox. The correct address depends on the H1B principal’s state of residence and whether you’re filing concurrently with an I-129. What Happens After You File

USCIS should mail Form I-797C, a receipt notice, within about 30 days. The receipt number lets you track the case online. H4 processing times vary and can stretch to several months. Check the USCIS processing times page for current estimates at the service center handling your case.

As long as you filed before your I-94 expired, you’re generally authorized to stay in the United States while the case is pending.3U.S. Citizenship and Immigration Services. Extend Your Stay

Do not travel abroad while your I-539 is pending. USCIS generally treats an international departure as abandonment of the application and denies it. An overseas trip during the months-long processing window can undo the entire filing, and you’ll need to refile and pay again after you return.

If USCIS sends a Request for Evidence, respond within the deadline printed on the notice. Filing for an H4 EAD at the Same Time

Some H4 spouses can work in the United States with an Employment Authorization Document. You’re eligible to apply if the H1B principal is the beneficiary of an approved Form I-140 or has been granted H1B status under AC21. You can submit Form I-765 with your H4 extension. Bundling them moves both through the system together, but USCIS won’t decide the EAD until the underlying H4 extension is approved. The I-765 has its own filing fee; confirm the current amount on the USCIS Fee Calculator. If you’re submitting the I-765 with the I-539 alone, use the Lockbox address listed on the I-765 direct filing addresses page. If a Child Is Approaching 21

H4 status is available only to unmarried children under 21. A child who turns 21 ages out of H4 status. They will need to move to another nonimmigrant status, such as F-1, before their 21st birthday, or leave the country. Mistakes That Sink Self-Filed Cases

  • Filing after the I-94 expires. Even a day of unlawful presence complicates the case. Set a reminder 60 days out.
  • Sending paper to the wrong Lockbox. Addresses change; verify against the I-539 instructions every time.
  • Leaving out the H1B principal’s evidence. Without proof the principal has status for the requested period, the H4 cannot be approved. Use the I-797 receipt notice if the H1B extension is still pending.
  • Inconsistent dates between your I-539 and the principal’s I-129. Mismatches raise questions and slow the case.
  • Traveling abroad while the case is pending. USCIS treats it as abandonment.
  • Missing an RFE deadline. That’s an automatic denial, and reopening a denied case is much harder than answering the RFE on time.

Self-filing an H4 extension is manageable when you’re methodical. The form is not the risk. The risk lives in the timing, the address on the envelope, and the way your paperwork lines up with the H1B principal’s.
