To file an H-4 EAD, you submit Form I-765 (Application for Employment Authorization) to U.S. Citizenship and Immigration Services under eligibility category (c)(26), along with the filing fee, proof of your H-4 status, and evidence that your H-1B spouse has either an approved Form I-140 or an H-1B extension beyond the six-year limit under AC21.1U.S. Citizenship and Immigration Services. Employment Authorization for Certain H-4 Dependent Spouses
Confirm You Are Eligible Before Filing
You must hold valid H-4 nonimmigrant status, and you must keep that status through the entire adjudication. If your H-4 status lapses before USCIS decides your case, the application is denied.
Your H-1B spouse also has to meet one of two conditions:
- Be the principal beneficiary of an approved Form I-140 (Immigrant Petition for Alien Worker), or
- Have received an H-1B extension beyond the standard six-year cap under sections 106(a) and (b) of the American Competitiveness in the Twenty-first Century Act. This extension is available when a labor certification or I-140 was filed at least 365 days before the end of the sixth year.2Federal Register. Completing Form I-765
Download the current version of Form I-765 from the USCIS website, or start it inside a USCIS online account. Outdated editions are rejected automatically.
Two fields matter most for H-4 applicants:
- Item Number 27 (Eligibility Category): enter (c)(26).
- Item Number 29: enter the receipt number from your H-1B spouse’s most recent Form I-797 for Form I-129.4U.S. Citizenship and Immigration Services. Form I-765, Application for Employment Authorization
If you don’t already have a Social Security Number, you can request one on the same form; USCIS forwards the data to the Social Security Administration, and the card arrives separately in the mail.5U.S. Citizenship and Immigration Services. Documents to Gather
Assemble clear photocopies of everything below. Incomplete packages often trigger a Request for Evidence and stall the case.
- Your most recent Form I-94 Arrival/Departure Record, showing current H-4 status.
- Your marriage certificate. If it is not in English, include a certified translation.
- Your spouse’s I-140 approval notice (Form I-797), or evidence of the AC21 extension. For AC21-based filings, acceptable evidence includes documentation from the Department of Labor’s website on a pending labor certification, or the I-797 receipt notice for an I-140 filed at least 365 days before the AC21 extension began.1U.S. Citizenship and Immigration Services. - A copy of your passport biographical page and any prior EAD cards.
- Two identical passport-style photos taken within the last 30 days. They must be unmounted and unretouched; digitally enhanced photos delay processing and can prompt an in-person identity check.6U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization
Filing Fee and How to Pay
The filing fee for a paper-filed Form I-765 is $520 under the most recent fee schedule. Online filing may carry a different amount, so confirm the current fee on the USCIS filing fees page before you send anything.7U.S. Citizenship and Immigration Services. Filing Fees
USCIS no longer accepts personal checks, business checks, money orders, or cashier’s checks for paper filings. For mailed applications you have two payment options:
- Credit, debit, or prepaid card, using Form G-1450 (Authorization for Credit Card Transactions) placed on top of the package.
- ACH withdrawal from a U.S. bank account, using Form G-1650 (Authorization for ACH Transactions).7U.S. Citizenship and Immigration Services. Filing Fees

How and Where to Submit
You can file online through a USCIS account or mail a paper application to the correct lockbox. Online filing lets you upload documents, pay electronically, and track status in the same account.6U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization
If you mail the application, the lockbox address depends on your state of residence and whether you are filing I-765 alone or alongside other forms. Check the USCIS website for the current address just before shipping, and use a tracked service.
Filing Concurrently With I-539 and I-129
H-4 EAD applicants often file Form I-765 at the same time as Form I-539 (Application to Extend/Change Nonimmigrant Status) and the H-1B spouse’s Form I-129. When you file concurrently, send everything, including all fees and supporting evidence, to the address in the Form I-539 instructions, not the I-765 address.8U.S. Citizenship and Immigration Services. Speeding Up the Case
You can add Form I-907 (Request for Premium Processing Service) to the I-765. As of March 1, 2026, the premium processing fee for Form I-765 is $1,780. Premium processing obligates USCIS to act within a set number of calendar days or refund the fee.9Federal Register. Adjustment to Premium Processing Fees
You can also ask for a free expedite, but USCIS grants these only in narrow circumstances. Severe financial loss is one accepted basis, for example if a gap in your work authorization would cost you your job or force your employer to lay off other workers. Simply needing the EAD is not enough on its own.10U.S. Citizenship and Immigration Services. Expedite Requests
What Happens After You File
USCIS usually issues Form I-797C (Notice of Action) as a receipt within a few weeks. That notice carries a case number you can track through the USCIS portal. Some applicants receive a separate notice to appear at an Application Support Center for biometrics.
Processing times vary from a few months to over six months depending on filing volume and the service center. Current estimates are posted on the USCIS website; if your case runs past the posted timeframe, you can open a case inquiry through the USCIS contact center.
Once approved, the EAD card is mailed to the address on your application. Check the name, date of birth, and other details right away, and contact USCIS if anything is wrong.
Renewing an H-4 EAD
USCIS recommends filing the renewal Form I-765 at least 90 days before your current EAD expires, and no earlier than 180 days out.6U.S. Citizenship and Immigration Services. I-765, Application for Employment Authorization
A rule change that took effect on October 30, 2025, matters here. USCIS ended the automatic extension that previously let H-4 EAD holders keep working for up to 540 days while a timely renewal was pending. Renewal applications filed on or after October 30, 2025, no longer receive that automatic extension.11Federal Register. Removal of the Automatic Extension of Employment Authorization Documents
If your current EAD expires while the renewal is still being adjudicated, you cannot legally keep working until USCIS approves it. Filing as early as the window allows, and considering premium processing on the renewal, are the practical ways to avoid a gap.
If Your H-1B Spouse Loses Their Job
Your H-4 EAD depends on your spouse’s H-1B status. When that employment ends, a 60-day grace period begins, and your own work authorization stays valid during that window. If your spouse does not find a new H-1B employer, file a change of status, or file for adjustment of status within those 60 days, both of you may need to leave the United States. If either spouse departs during the grace period, the grace period ends immediately for the person who leaves, and that person would need a new visa and admission to return.12U.S. Citizenship and Immigration Services.
