How to File a Subpoena Without an Attorney: Forms and Service

To file a subpoena without an attorney in federal court, you fill out the correct standard form (AO 88A for testimony or AO 88B for documents), bring it to the court clerk for signature and seal, and then arrange for a non-party adult to personally deliver it to the witness along with any required fees. Pro se litigants can do all of this themselves, but Federal Rule of Civil Procedure 45 leaves no room for shortcuts, and a single misstep can get the subpoena quashed.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena State courts follow similar logic but use their own forms and fee rules, so check your local self-help resources if your case is not in federal court.

Pick the Right Subpoena Form

Federal courts use two main types of subpoenas, and picking the wrong one wastes time and money.

  • AO 88A, subpoena to testify: compels a person to appear and give spoken testimony at a trial, hearing, or deposition.
  • AO 88B, subpoena to produce documents: compels a person to produce records, electronically stored information, or other tangible items.2United States Courts. AO 88B – Subpoena to Produce Documents in a Civil Action

You can combine both if you need a witness to show up and bring documents. The forms are free from the clerk’s office or the U.S. Courts website.

Fill Out the Form

You will need the full case name, the court-assigned docket number, the witness’s complete legal name and address, and an exact date, time, and location for compliance. For testimony, that means the courtroom or deposition site. For documents, that means where and when the records should be delivered or made available for inspection.

When requesting documents, attach a specific list. Vague descriptions like “all records related to the dispute” invite objections. Descriptions like “monthly account statements from January 2024 through December 2025 for account number ending in 4821” are much harder to fight.

One requirement pro se filers routinely miss: if your subpoena commands document production before trial, you must serve a notice and a copy of the subpoena on every other party in the case before you serve it on the witness.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena Skipping this pre-service notice gives the other side clean grounds to challenge you.

Check the Geographic Limits

Rule 45(c) caps how far you can force someone to travel or produce documents. Ignoring these limits is one of the fastest ways to get a subpoena thrown out.

For trial, hearing, or deposition testimony, you can compel a person to appear within 100 miles of where they live, work, or regularly do business in person. A broader rule applies if the witness is a party to the lawsuit or an officer of a party, or if the witness is commanded to attend trial and would not incur substantial expense: in those cases, attendance can be compelled anywhere within the state where the witness lives, works, or regularly does business.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena

For document production, the same 100-mile radius applies from the person’s residence, workplace, or regular place of business.

If the witness lives across the country, issue the subpoena from the federal court in the district where they are located rather than from the court handling your case. The clerk in any federal district court can issue a subpoena for a case pending in another district.

Get the Clerk to Issue It

This is where pro se procedure diverges from what attorneys do. A licensed attorney admitted to practice in the issuing court can sign and issue a subpoena on their own. You cannot. Bring your completed, unsigned form to the clerk’s office and ask the clerk to issue it.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena The clerk signs it and applies the court’s seal, which converts the paper into an enforceable court order.

Some courts charge a small issuance fee, so call ahead. Bring the completed form, your document list if applicable, and payment for any fees. Clerks will not fix legal errors, but they will reject forms with missing information, so proofread every field before you go.

Serve the Subpoena

You cannot serve the subpoena yourself. Rule 45 requires service by someone who is at least 18 and is not a party to the case.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena A friend, family member, or professional process server all qualify.

Service must be personal delivery. The server physically hands a copy of the issued subpoena to the named person. Leaving it on a doorstep, mailing it, or handing it to a roommate does not count in most circumstances.

Tender the Witness Fee at Service

If your subpoena requires the witness to attend a proceeding, the server must hand over payment for one day’s attendance fee and mileage at the moment of delivery. Federal law sets the attendance fee at $40 per day.3Office of the Law Revision Counsel. 28 US Code 1821 – Per Diem and Mileage Generally The 2026 mileage reimbursement rate is $0.725 per mile, based on the GSA’s privately owned vehicle rate.4General Services Administration. GSA Bulletin FTR 26-02 Calculate the round-trip mileage from the witness’s home or workplace to the place of attendance, prepare a check or money order for the combined total, and make sure your server delivers it with the subpoena.

Failing to tender the fee is a common and costly error. Because the rule conditions valid service on tendering the fee, a witness served without payment has a strong argument that they have no obligation to comply. For document-only subpoenas that do not require the person to appear, fee tender is not required.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena

Give the Witness Reasonable Time

The subpoena must allow a “reasonable time” to comply.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena The rules do not name a specific number of days, which leaves it to the judge case by case. Serving a subpoena three days before a trial date and expecting the witness to reorganize their life is the kind of thing that gets quashed. Build in as much lead time as your schedule allows.

File Proof of Service

After delivery, the server prepares a proof of service. This is a short statement, signed under penalty of perjury, that records the date, the manner of delivery, and who received it.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena On the AO forms, the proof of service section is printed on the back of the subpoena itself.2United States Courts. AO 88B – Subpoena to Produce Documents in a Civil Action

You are only required to file this proof with the court if enforcement becomes necessary, but filing it promptly is smart practice. If the witness later claims they were never served, the court already has documentation. File it at the clerk’s office like any other court document.

If the Witness Pushes Back

Not every witness will cooperate. Rule 45 gives them two ways to resist.

Written Objections to Document Requests

A person who receives a document subpoena can serve a written objection on you. The deadline is the earlier of the compliance date or 14 days after service.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena Once the objection is served, production is paused until you file a motion asking the court to compel compliance. The burden then shifts to you to show why the documents matter and why the objection lacks merit.

Motions to Quash

A motion to quash asks the judge to cancel or narrow the subpoena. Under Rule 45(d)(3), the court must quash a subpoena that:

  • fails to allow reasonable time to comply;
  • requires the witness to travel beyond the applicable geographic limit;
  • demands privileged or otherwise protected material; or
  • imposes an undue burden.

The court also has discretion to quash subpoenas that demand trade secrets, confidential commercial information, or the opinions of an expert not retained by any party.1Legal Information Institute. Federal Rules of Civil Procedure Rule 45 – Subpoena If a motion to quash is filed against your subpoena, you will need to respond in writing and possibly appear at a hearing. Draft narrow, targeted requests from the start and this stage rarely bites.

If the Witness Just Ignores It

A subpoena is not a suggestion. A witness who ignores a validly served subpoena can be held in contempt. Federal courts have broad authority under 18 U.S.C. § 401 to punish contempt by fine, imprisonment, or both.5Office of the Law Revision Counsel. 18 US Code 401 – Power of Court Criminal contempt under 18 U.S.C. § 402 carries a fine of up to $1,000 and up to six months in jail. The key element is willful disobedience; a forgotten date or genuine emergency rarely draws criminal sanctions, but deliberate defiance is treated as an affront to the court, not just to you.

If your witness does not appear or produce documents, ask the court for an order to show cause. That compels the witness to appear before the judge and explain why they should not be held in contempt. The court can then order compliance, impose sanctions, or both. Make sure your proof of service is already on file before you file the request, because the judge will want to confirm the subpoena was properly served and any required fees were tendered.
