To file a federal whistleblower complaint, you send your report to the agency that has jurisdiction over the type of misconduct involved, using that agency’s form and meeting its deadline. Federal jurisdiction is split: the Office of Special Counsel handles retaliation against federal employees, the SEC takes securities-fraud tips, the IRS takes tax-fraud tips, OSHA handles retaliation in the private sector, agency Inspectors General take internal waste and abuse reports, and False Claims Act fraud goes to federal court as a qui tam lawsuit. Picking the right destination is the first real step, because filing in the wrong place can cost you the case.
Match the Misconduct to the Right Agency
Start by naming what you are reporting. The agency follows from that.
Federal Employee Retaliation: Office of Special Counsel
If you are a federal employee or applicant and you have been punished, or threatened with punishment, for reporting wrongdoing, the Office of Special Counsel (OSC) is the agency. The law bars supervisors from taking or threatening negative job actions because you disclosed what you reasonably believe to be a legal violation, gross mismanagement, a gross waste of funds, an abuse of authority, or a danger to public health or safety.1Office of the Law Revision Counsel. 5 USC 2302 – Prohibited Personnel Practices OSC also investigates other prohibited personnel practices, including nepotism and coerced political activity.
Securities Fraud: SEC Whistleblower Program
Insider trading, accounting fraud, market manipulation, and other violations of federal securities laws go to the SEC’s Whistleblower Program. Anyone can submit a tip; you do not have to work for the company. Successful tips that lead to sanctions above $1 million can produce awards of 10 to 30 percent of the amount collected.2U.S. Securities and Exchange Commission. Whistleblower Frequently Asked Questions
Tax Fraud: IRS Whistleblower Office
Reports of tax cheating and underpayment go to the IRS Whistleblower Office. The mandatory award track pays 15 to 30 percent of collected proceeds, but only when the amounts in dispute exceed $2 million; when the taxpayer is an individual, their gross income must also exceed $200,000 in at least one relevant year.3Internal Revenue Service. 25.2.2 Whistleblower Awards Smaller claims are still accepted under a discretionary award program.4Internal Revenue Service. Private-Sector Retaliation: OSHA
If you work in the private sector and your employer punished you for reporting safety hazards, environmental violations, pipeline safety issues, consumer-product defects, or similar concerns, OSHA takes the complaint. OSHA enforces the anti-retaliation provisions of more than 20 federal statutes covering workplace safety, transportation, environmental protection, and financial reform.5Occupational Safety and Health Administration. OSHA Whistleblower Protection Program
Waste, Fraud, and Abuse Inside a Federal Agency: Inspector General
Nearly every federal agency has an Office of Inspector General that accepts reports about that specific agency. If your concern is about how one agency operates and does not fit the categories above, the agency’s IG hotline is usually the right place to start.6U.S. Department of Justice Office of the Inspector General. Hotline
Fraud Against the Government: False Claims Act Qui Tam Suit
When a person or company is defrauding the federal government (overbilling contracts, submitting false Medicare claims, and the like), the reporting mechanism is not an agency complaint but a civil lawsuit. A qui tam action is filed under seal in federal court on behalf of the United States, and the complaint stays sealed for at least 60 days while the Department of Justice decides whether to intervene.7Office of the Law Revision Counsel. 31 USC 3730 – Civil Actions for False Claims If DOJ joins the case, you receive 15 to 25 percent of the recovery; if it declines and you press on alone, your share rises to 25 to 30 percent. Because these cases require formal court filings, you will need an attorney.
A boundary worth flagging: if the wrongdoing involves classified national security information, none of the standard forms above are appropriate. The proper channels are the Inspector General of the relevant intelligence agency, the Inspector General of the Intelligence Community, or the congressional intelligence committees.8House Office of the Whistleblower. Intelligence Community Whistleblowing Fact Sheet Putting classified material into an unclassified filing can expose you to criminal liability instead of protection.
Check the Deadline Before You Do Anything Else
Every program has its own clock, and it usually starts on the date the retaliation or misconduct happened, not the date you decided to act. A few of the deadlines are short enough to catch people off guard.
- OSHA retaliation complaints run from 30 to 180 days depending on the statute. Workplace safety retaliation under the OSH Act has a 30-day window; Sarbanes-Oxley and pipeline safety allow up to 180 days.9Occupational Safety and Health Administration. OSHA Online Whistleblower Complaint Form
- Direct appeals to the Merit Systems Protection Board must be filed within 30 calendar days of the effective date of the personnel action or receipt of the agency’s decision, whichever is later.10U.S. Merit Systems Protection Board. How to File an Appeal
- Individual Right of Action appeals to the MSPB (after OSC declines to act) must be filed within 65 days of the date OSC issued its closure notice, or within 60 days of the date you received it, whichever is later.11eCFR. 5 CFR Part 1209 – Practices and Procedures for Appeals and Stay Requests in Cases Involving Alleged Prohibited Personnel Practices
- False Claims Act qui tam lawsuits generally must be filed within six years of the fraudulent conduct, or within three years after the government knew or should have known about it, but never more than 10 years after the violation.
- SEC and IRS tips have no formal filing deadline, but reporting promptly strengthens your claim and improves the odds that your information actually drives an enforcement action.
Gather Your Evidence and Fill Out the Right Form
A complaint with specific, concrete details survives initial review; one built on generalizations usually does not. Before you touch a form, organize four things:
- Names and titles of everyone involved, including supervisors who ordered or knew about the conduct.
- Dates and locations of each incident. Approximate is better than nothing; exact is best.
- What actually happened, described as observable facts rather than conclusions, tied to the specific rule or law you believe was broken.
- Supporting documents: emails, memos, contracts, financial records, text messages, photographs. Organize them chronologically and, if there are many, build a short index that matches each exhibit to a point in your narrative.
Each program has its own intake form. OSC requires Form OSC-14 for prohibited personnel practice complaints.12U.S. Office of Special Counsel. OSC Complaint Forms The SEC uses Form TCR (Tip, Complaint, or Referral), on paper or through the SEC’s online portal.13U.S. Securities and Exchange Commission. Information About Submitting a Whistleblower Tip The IRS uses Form 211 (Application for Award for Original Information), which asks you to estimate the tax owed and describe the noncompliance.14Internal Revenue Service. Submit Through a Method That Confirms Receipt
Most agencies offer more than one submission channel. Choose the one that gives you proof.
OSC accepts complaints through its online portal, which is the preferred method. If the portal produces an error, you can email the completed form. Paper filings are not currently being processed.15U.S. Office of Special Counsel. File a Complaint The SEC’s TCR portal generates an immediate submission number and a printable confirmation receipt; hard-copy filings are accepted by mail, and if you go that route, keep the mail or fax confirmation.13U.S. Securities and Exchange Commission. Information About Submitting a Whistleblower Tip The IRS accepts Form 211 by mail and sends back a letter confirming receipt along with a claim number.4Internal Revenue Service. Submit a Whistleblower Claim for Award OSHA accepts complaints through its online form, by calling 1-800-321-OSHA (6742), or by visiting or writing to a local OSHA office.9Occupational Safety and Health Administration. Whichever agency you file with, save every confirmation number, receipt, or tracking document. Those are what prove you filed on time if a deadline dispute comes up later.
Filing Confidentially or Anonymously
The rules on identity differ by program.
OSC will not reveal your identity without your consent except in rare cases involving imminent danger to public health or safety, or an imminent criminal law violation, and it will try to contact you first if that exception applies. You must identify yourself to OSC when you file, but OSC will honor a request that your name not be shared outside the office. If you submit a disclosure completely anonymously, OSC will refer the matter to the relevant Inspector General and take no further action on it itself.16U.S. Office of Special Counsel. Confidentiality and Anonymity When Filing a Disclosure Claim
The SEC allows fully anonymous tips, but if you want to stay eligible for an award, an attorney has to submit on your behalf. The attorney completes the required certification, and you sign a hard-copy Form TCR under penalty of perjury that the attorney keeps on file.2U.S. Securities and Exchange Commission. Whistleblower Frequently Asked Questions
The IRS does not accept anonymous award claims because Form 211 requires your identity, but the IRS is prohibited from disclosing your information to the taxpayer you are reporting.
What Happens After You File
You should receive an acknowledgment with a unique case or submission number; reference it in every future communication. An intake officer or investigator then screens the complaint to decide whether it clears the threshold for a full investigation, and may follow up to clarify details or ask for more evidence. If the agency opens a formal investigation, you may get periodic status updates. If it declines, you typically get a written explanation.
Processing times vary widely. OSC may take 120 days or more before deciding whether to pursue corrective action on your behalf.11eCFR. 5 CFR Part 1209 – Practices and Procedures for Appeals and Stay Requests in Cases Involving Alleged Prohibited Personnel Practices IRS cases routinely take several years because they depend on the outcome of tax enforcement proceedings. SEC investigations vary with case complexity. OSHA retaliation investigations generally move faster because of the shorter statutory windows.
If the Agency Declines to Act
A denial is not always the end of the road.
Federal employees whose OSC complaints go nowhere can file an Individual Right of Action (IRA) appeal with the Merit Systems Protection Board. You have 65 days from the date OSC issued its closure notice, or 60 days from the date you actually received it, whichever is later. You can also file an IRA appeal if OSC has not acted within 120 days of your original complaint.10U.S. Merit Systems Protection Board. How to File an Appeal The MSPB accepts filings through its e-Appeal Online system and also by mail, fax, or personal delivery, and you file with the regional or field office that serves the area where your duty station was located. Include evidence that you exhausted the OSC process first.11eCFR. 5 CFR Part 1209 – Practices and Procedures for Appeals and Stay Requests in Cases Involving Alleged Prohibited Personnel Practices
In a qui tam case, if DOJ declines to intervene you can continue the lawsuit on your own, and your potential share of any recovery rises to 25 to 30 percent.7Office of the Law Revision Counsel. 31 USC 3730 – Civil Actions for False Claims SEC and IRS award denials can be challenged through procedures set out in each program’s rules.
Retaliation Protection While Your Case Moves
Federal law prohibits retaliation against whistleblowers, though the specific protection depends on your employment status and the program.
Federal executive-branch employees are covered by the Whistleblower Protection Act, which bars supervisors from taking negative job actions because an employee disclosed wrongdoing.17House Office of the Whistleblower. Whistleblower Protection Act Fact Sheet Retaliation reaches beyond firing to include unfavorable reassignments, poor performance evaluations, changes to duties or working conditions, and decisions affecting pay, benefits, or awards.18Office of Personnel Management Office of the Inspector General. Whistleblower Rights and Protections Federal contractor employees are also protected from retaliation for disclosures about federal contracts or grants.
Private-sector employees who face retaliation for reporting violations under any of the 20-plus statutes OSHA administers can file a retaliation complaint with OSHA.19U.S. Department of Labor. Whistleblower Protections The filing windows on those retaliation complaints are short, sometimes only 30 days. If you believe retaliation has already started, file immediately rather than waiting to see whether things settle down.
