To file a 1099-NEC for an independent contractor you paid $2,000 or more during 2026, collect a completed Form W-9 from the contractor, enter their name, address, and Taxpayer Identification Number on Form 1099-NEC along with the total you paid them in Box 1, and send the form to both the IRS and the contractor by January 31, 2027. The $2,000 threshold is new for the 2026 tax year under legislation signed in mid-2025; payments from earlier years still use the older $600 amount, and the new figure will adjust for inflation starting in 2027.1Internal Revenue Service. 2026 Publication 1099 (Draft)
First, Confirm the Person Is Actually a Contractor
Filing a 1099-NEC for someone who should have been treated as an employee doesn’t fix the classification. It can trigger back employment taxes, penalties, and interest. The IRS weighs three categories together, with no single factor deciding the question: behavioral control (who directs how, when, and where the work happens), financial control (who supplies tools, bears expenses, and can profit or lose on the job), and the relationship of the parties (written contract, benefits, expectation of ongoing work).2Internal Revenue Service. Worker Classification 101: Employee or Independent Contractor If the arrangement feels close to employment, it probably is. When you can’t tell, either party can file Form SS-8 and ask the IRS to decide.3Internal Revenue Service. Which Payments Count Toward the $2,000
You file a 1099-NEC when four conditions all apply: the payee isn’t your employee, the payment was for services in the course of your trade or business, the payee is an individual, partnership, or estate, and total payments to that payee reached $2,000 or more during the calendar year.4Internal Revenue Service. Reporting Payments to Independent Contractors The total includes fees for services along with any parts and materials the contractor supplied during the year.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
Personal payments don’t count. If you hired someone to paint your kitchen or walk your dog and that’s unrelated to your business, no 1099 is required.
Card and App Payments Don’t Go on the 1099-NEC
Payments you made by credit card, debit card, or third-party payment network such as PayPal or Venmo are excluded. The payment processor reports those on Form 1099-K, and duplicating them on a 1099-NEC would double-count the income.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Only payments by check, cash, ACH, or wire count toward your $2,000 threshold.
Corporations and the Attorney Exception
Payments to corporations, both S-corp and C-corp, generally don’t require a 1099-NEC. The exception is legal services: if you paid an attorney or law firm $2,000 or more for legal work, you file a 1099-NEC regardless of whether the firm is incorporated.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC Medical and health care payments to corporations are also reportable, but those belong on Form 1099-MISC, not 1099-NEC.
Get a W-9 Before You Cut the First Check
You cannot complete a 1099-NEC without the contractor’s legal name, mailing address, and Taxpayer Identification Number. Form W-9 is the standard collection tool, and the practical rule is to get it signed before the first payment goes out, while you still have leverage. Chasing a W-9 in late January, after the work is done and the contractor has moved on, is a familiar year-end headache.6Internal Revenue Service. About Form W-9, Request for Taxpayer Identification Number and Certification
The TIN will be a Social Security Number for most sole proprietors and an Employer Identification Number for businesses. Federal law requires every party to a return to supply an identifying number so the IRS can match payer and payee records.7Office of the Law Revision Counsel. 26 USC 6109 – Identifying Numbers If the contractor refuses to give you a TIN, or the IRS later flags the one you have as incorrect, you may have to withhold 24 percent of future payments and remit it to the IRS. That’s backup withholding, and it stays in place until the contractor resolves the TIN issue.8Internal Revenue Service. Backup Withholding
Filling Out the Form
With the W-9 in hand, the form itself is short. In the payer section, enter your business name, address, and federal identification number. In the recipient section, enter the contractor’s name, address, and TIN copied from the W-9. In Box 1, enter the total nonemployee compensation for the year. If you did any backup withholding or otherwise withheld federal income tax, that amount goes in Box 4.9Internal Revenue Service. Form 1099-NEC
One trap catches new filers every year. Copy A, the version that goes to the IRS on paper, is printed in a special red ink that IRS scanners read. The PDF you can download from the IRS website is a sample, not a filing copy. Print it on regular paper and mail it in and the IRS may reject it and assess a penalty. To file on paper, order official scannable forms from the IRS or buy them from an authorized office supply retailer. Filing electronically avoids the problem entirely.9Internal Revenue Service. The January 31 Deadline
Both filings — the IRS copy and the contractor’s copy — are due January 31 of the year after payment. For 2026 payments, the deadline is January 31, 2027. Electronic filers get no extra time.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC When January 31 falls on a weekend or federal holiday, the deadline shifts to the next business day. The contractor’s copy (Copy B) can be mailed or delivered electronically if the contractor consents in advance.
Filing Electronically Through IRIS
The IRS Information Returns Intake System (IRIS) is the current electronic filing platform. It has a free online portal for keying forms in manually and an application-to-application channel for accounting software.10Internal Revenue Service. E-File Information Returns With IRIS The older FIRE system is being retired after the 2026 tax year, so IRIS is where new filers should start.11Internal Revenue Service. Filing Information Returns Electronically (FIRE)
Electronic filing isn’t just an option for many businesses. If you file ten or more information returns of any type in a year — W-2s, 1099-NECs, 1099-MISCs, and others combined — you must file electronically.12Internal Revenue Service. E-File Information Returns The ten-return count aggregates across form types, not per form.
Filing on Paper
If you’re under the ten-return threshold and prefer paper, mail Copy A to the IRS service center for your region along with Form 1096, a cover sheet that totals the 1099s in the package.13Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of U.S. Information Returns Use a flat mailer and don’t fold the forms. Form 1096 also has to be an official printed form, not a photocopy.
State Filing
Many states want a copy of the 1099-NEC too. The IRS Combined Federal/State Filing program forwards your electronically filed 1099-NEC data to participating states automatically, which can eliminate a separate submission.14Internal Revenue Service. FIRE System Test Files and Combined Federal/State Filing Program Not every state participates, and some that do still require direct filing in certain situations. Where the combined program doesn’t cover you, use Copy 1 of the 1099-NEC and follow your state’s own deadline and instructions.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
Fixing a Mistake After You File
Wrong dollar amount, misspelled name, wrong TIN: you fix these by filing a corrected return. In IRIS, submit the correction through the portal. On paper, file a new 1099-NEC with the “CORRECTED” box checked at the top.5Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC
Do not check the “VOID” box on a correction. VOID tells IRS scanners to skip the form entirely, and your fix will never be recorded. The full correction procedures live in Part H of the General Instructions for Certain Information Returns on the IRS website.
Extensions Are Narrow
The 1099-NEC has one of the strictest extension rules of any information return. You can request only a single 30-day extension using Form 8809, it must be filed on paper with a written explanation, and it’s not automatic. The IRS grants it only in narrow circumstances — a federally declared disaster, serious illness or death of the person responsible for filing, or being in your first year of business, among a short list.15Internal Revenue Service. Form 8809, Application for Extension of Time to File Information Returns Falling behind on bookkeeping isn’t on the list. Plan to hit January 31 without one.
Keep the Paperwork
Keep every W-9 you collected and every 1099-NEC you filed for at least four years after the filing date. The IRS recommends a four-year floor for employment-related tax records, running from when the tax became due or was paid, whichever is later.16Internal Revenue Service. Employment Tax Recordkeeping Complex records warrant holding on longer, since the assessment window stretches to six years if income is underreported by more than 25 percent.17Internal Revenue Service. Publication 583, Starting a Business and Keeping Records
What Missing the Deadline Costs
The IRS charges separate penalties for failing to file a correct 1099-NEC with the IRS and for failing to deliver a correct copy to the contractor. For the 2026 tax year, per-form amounts run:18Internal Revenue Service. Information Return Penalties
- $60 per form if corrected within 30 days of the deadline
- $130 per form if corrected after 30 days but by August 1
- $340 per form if filed after August 1 or not at all
- $680 per form (or 10 percent of the amount that should have been reported, whichever is greater) for intentional disregard
Because the IRS filing penalty (26 U.S.C. § 6721) and the recipient copy penalty (26 U.S.C. § 6722) run separately, a single missed form can produce two penalties.19Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns The maximum annual penalty is $3,000,000 per type of failure. Small businesses (average gross receipts of $5 million or less over the prior three years) face lower annual caps: $175,000 for corrections within 30 days, $500,000 for corrections by August 1, and $1,000,000 overall.20Office of the Law Revision Counsel. 26 USC 6721 – Failure to File Correct Information Returns
