To create a 1099 and file it with the IRS, collect a completed Form W-9 from each payee, choose the correct form (usually the 1099-NEC for contractor pay or the 1099-MISC for rent, prizes, attorney proceeds, and similar categories), enter the payer, payee, and box amounts on an official scannable form or through the IRS’s free IRIS portal, send the recipient’s copy by January 31, and transmit the IRS copy by the deadline that matches the form and filing method. One thing to know before you start: for payments made after December 31, 2025, the reporting threshold rose from $600 to $2,000 per payee, so some payments that would have required a 1099 in prior years no longer do.1Office of the Law Revision Counsel. 26 USC 6041 – Information at Source
Confirm the Payment Actually Requires a 1099
You issue a 1099 when your business pays a non-employee $2,000 or more during the calendar year for services, rent, prizes, legal settlements, or a handful of other categories. The payment has to be made in the course of your trade or business, so hiring someone to mow your home lawn doesn’t count. The threshold is per payee, not per invoice. Two payments of $1,100 to the same freelancer add up to $2,200 and cross the line.
The recipient’s business structure matters. Payments to sole proprietors, single-member LLCs, partnerships, and individuals generally require a 1099 once the dollar threshold is met.2Internal Revenue Service. Payments Through Credit Cards or Payment Apps
If you paid a contractor through a credit card, PayPal, Venmo, Stripe, or another third-party payment network, don’t issue a 1099-NEC for that payment. The processor reports it on a 1099-K, and doubling up would double-report the income.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC If you paid the same contractor $1,200 by check and $1,500 through Stripe, only the $1,200 counts toward the 1099-NEC threshold.
Foreign Contractors Use a Different Form
The 1099 system applies to U.S. persons. When you pay a nonresident alien or a foreign entity, you use Form 1042-S instead, collect Form W-8BEN or W-8BEN-E rather than a W-9, and generally withhold 30 percent unless a tax treaty applies. Get a W-9 From Every Payee
Before you can create a 1099, you need the payee’s legal name, business name (if different), address, and Taxpayer Identification Number. Form W-9 collects all of it.6Internal Revenue Service. If a payee refuses to give you a TIN or provides one the IRS flags as incorrect, you must withhold 24 percent from all future payments and send the withheld amount to the IRS.7Office of the Law Revision Counsel. 26 US Code 3406 – Backup Withholding Skip that and the IRS can hold you responsible for the tax that should have been withheld.
Pick the Right Form: 1099-NEC or 1099-MISC
Two forms handle the vast majority of situations, and picking the wrong one is a common mistake.
The 1099-NEC reports nonemployee compensation. If you hired a graphic designer, bookkeeper, IT consultant, or any other independent service provider and paid them $2,000 or more, that goes on a 1099-NEC.8Internal Revenue Service. Form 1099 NEC and Independent Contractors
The 1099-MISC covers everything else that doesn’t fit on a more specialized form: rent, prizes and awards that aren’t for services, crop insurance proceeds, medical and health care payments, and gross proceeds paid to attorneys in connection with legal settlements.9Internal Revenue Service. 1099-NEC and 1099-MISC Income Treatment Scenarios The two forms have different filing deadlines, so misclassifying a payment causes trouble on both ends.
Fill Out the Form Correctly
The IRS uses optical character recognition on paper 1099s, so you must use official scannable forms rather than photocopies or downloaded PDFs. You can order scannable forms free from the IRS, generate them through IRS-authorized e-file software, or skip paper entirely and use the free IRIS portal.
Your business name, address, and Employer Identification Number go in the payer section. The recipient’s information, pulled straight from the W-9, goes in the payee section. On a 1099-NEC, total nonemployee compensation for the year goes in Box 1, and any federal tax you withheld (such as backup withholding) goes in Box 4.4Internal Revenue Service. Deliver the Recipient’s Copy
Each 1099 comes in multiple copies. Copy A goes to the IRS, Copy B goes to the recipient, and Copy C stays in your files.10Internal Revenue Service. Form 1099-NEC – Nonemployee Compensation
You can deliver the recipient’s copy by first-class mail or electronically, but electronic delivery requires the recipient’s affirmative consent first. The consent process has specific requirements: you must tell the recipient how to withdraw consent, how to get a paper copy, and what hardware or software they need to view the statement.11Internal Revenue Service. General Instructions for Certain Information Returns A blanket “we’ll email your forms” policy without individual opt-in doesn’t satisfy the rule. Keep proof of mailing or a delivery confirmation.
File the IRS Copy
If you file 10 or more information returns of any type during the year, you must file electronically. The count combines all your 1099s, W-2s, 1098s, and other information returns.12Internal Revenue Service. E-File Information Returns
IRIS (the Free IRS Portal)
The Information Returns Intake System is the IRS’s free online portal for creating and e-filing 1099s. Any business can use it regardless of size. You can key in forms one at a time or upload them in bulk.13Internal Revenue Service. Topic No. 801, Who Must File Information Returns Electronically
FIRE Is Being Retired
The Filing Information Returns Electronically system has been the traditional bulk-upload channel for large filers. The IRS has targeted it for retirement after the 2026 tax year (filing season 2027), and IRIS will replace it entirely. If you currently use FIRE, plan the transition now.14Internal Revenue Service. Paper Filing
If you file fewer than 10 information returns total, you can mail paper. Every paper submission needs Form 1096 as a cover sheet summarizing the number of returns and total dollar amounts.15Internal Revenue Service. About Form 1096, Annual Summary and Transmittal of US Information Returns Use a separate 1096 for each form type: one for your 1099-NECs, another for your 1099-MISCs. Send them to the IRS Submission Processing Center for your region.
Deadlines
The 1099-NEC has a single unified deadline of January 31 for both the recipient’s copy and the IRS filing, paper or electronic.4Internal Revenue Service. Instructions for Forms 1099-MISC and 1099-NEC No automatic extension is available.
The 1099-MISC has a split deadline. The recipient’s copy is due January 31. The IRS copy is due February 28 on paper or March 31 electronically.16Internal Revenue Service. Publication 1099, General Instructions for Certain Information Returns Weekend and holiday due dates roll to the next business day. For most 1099 types other than the NEC, you can request a 30-day extension by filing Form 8809 by the original due date.
Penalties for Late or Incorrect Filing
The IRS charges penalties per form, and the amount climbs the longer you wait. For returns due in 2026:17Internal Revenue Service. Information Return Penalties
- Up to 30 days late: $60 per form
- 31 days late through August 1: $130 per form
- After August 1 or not filed: $340 per form
- Intentional disregard: $680 per form with no maximum cap
The same schedule applies separately to payee statements. If both the IRS copy and the recipient copy are late, you face two penalties on the same form. Small businesses with average annual gross receipts of $5 million or less qualify for lower maximum penalty caps, but the per-form amounts don’t change.
If you missed a deadline for reasons beyond your control, you can request a waiver by showing reasonable cause. You need to demonstrate that you exercised ordinary care, took steps to prevent the failure, and corrected the issue promptly.18Internal Revenue Service. Penalty Relief for Reasonable Cause A strong compliance history or a disaster that cut off access to records can help. Not knowing about the requirement generally won’t.
Fixing a 1099 After You File
If you discover an error on a 1099 you already filed, submit a corrected return and give the recipient an updated statement. The process depends on the type of mistake.11Internal Revenue Service. General Instructions for Certain Information Returns
Wrong dollar amount, code, or checkbox (Type 1): prepare a new 1099 with the correct information, check the “CORRECTED” box at the top, and submit it with a new Form 1096. Don’t attach the original.
Wrong payee name, wrong TIN, or wrong form type (Type 2): this takes two steps. First, file a corrected version of the original with the “CORRECTED” box checked and all dollar amounts zeroed out to void the wrong return. Second, file a brand-new form (without the “CORRECTED” box) containing all the correct information as if it were an original. Both go in under one Form 1096.
IRIS supports corrections through the portal. Filing the correction quickly reduces the penalty exposure on the original. If the only error is state-level, contact the state tax agency directly rather than sending anything to the IRS.
State Filing
Many states require their own copy of your 1099 filings. Rather than filing state by state, you can use the Combined Federal/State Filing program, which forwards electronically filed returns to participating state tax agencies at no cost.19Internal Revenue Service. The IRS acts only as a forwarding agent, so it’s still your job to check whether a participating state also wants direct notice, and states that don’t participate require a direct filing with their tax department.
Keep Your Records
Keep copies of every 1099 you file, the corresponding Form 1096 if you filed on paper, and the signed W-9 from each payee. The IRS requires employment tax records for at least four years after the tax becomes due or is paid, whichever is later.20Internal Revenue Service.
